The paper examinees the 2009-10 constitutional crisis of Nigeria, where President Umaru Musa Yar’... more The paper examinees the 2009-10 constitutional crisis of Nigeria, where President Umaru Musa Yar’adua’s deteriorating health and failure to issue a written declaration transferring power over to his next-in-line resulted in a governance deadlock. It makes use of the contending theoretical contributions of Oren Gross and David Dyzenhaus to assess whether the legislature may be considered as having acted extra-legally. The Nigerian case partially exemplifies Gross’ contention that the law may be subverted in emergency situations, because the Senate appointed a Vice President to act in the role of the President, without constitutional provisions to do so. However, given that the executive cabinet abstained fro declaring the President incapacitated in the absence of a written declaration from him stating as such, which was a constitutional requirement, the situation also partially subscribed to Dyzenhaus’ argument that the law cannot be subverted even in emergencies. Nevertheless, considering that inaction would have resulted in dangerous anarchy, and therefore the subversion of the law by the Senate should be applauded in this context, it may ultimately be said that the law is but the agent of politics, as Cerar would have it.

This has seen the dominance and hegemony of the United States of America across the world. But as history has been sure to prove, ideologies like other virtues are cyclical, and thus after the peak of one order, the order dies and then a new order will arise. However, the case in this paper, is that there is a fight back of ideologies in this case communism against Liberalism. This is seen in the rise of powers such as China and North Korea as examples. Thus the paper discusses first on what liberalism is, states about the rise of liberalism, and then interrogates the question whether there has been a decline in the Liberal order across the world. The paper concludes that indeed there has been a fight back by communism, autocracy and rife nationalism, but that these remain to be seen in the future trend worldwide.
The world over, the rise of radical terrorist attacks and groups in democracies has raised a lot ... more The world over, the rise of radical terrorist attacks and groups in democracies has raised a lot of concern for the safety and continuity of democracies. Nigeria as a newly emerging democracy is no exception. This article sets as its main aim to answer the question why people or groups rebel against the constitutional democratic state by resorting to Terrorism. Using primarily secondary sources, inculcating mainly the descriptive methodology, the article shows that deprivation of constitutional rights and violation of fundamental human rights can lead to the radicalization of groups. Bokoharam as a radical terrorist group tested against this hypothesis falls into the category of a terrorist group who, although associated with a barbaric ideology, and against the background of poverty youths find appealing to join, especially in the North Eastern part of Nigeria.

This is against the background of the war on terror and the need by states to limit collateral damage (troop loss). By extension the introduction of drones onto the scene has implications for human rights, especially for innocent civilians. The paper analyses the challenges of the new technology to the right to life, right to privacy, and the right to human dignity. The conclusion from the research shows that even though drone technology and its use has greatly aided the war on terror and has limited the number of KIA’s (killed in action), from a humanitarian perspective more has to be done to ensure its efficiency in pursuit of the protection of human rights.

The Chinese state has seen unprecedented amount of political and economic development since openi... more The Chinese state has seen unprecedented amount of political and economic development since opening up its borders for capitalist investments. This has meant the surge forward for the state economically and then has translated into political strength and the projection of national power. In this wise, the paper seeks to show that china has seen a rapid rise in the Asian sub-continent, and has sought to challenge the hegemonic configuration of the world political order. This as to be seen has yielded a mixed result as China has termed itself as still a developing nation. The paper also compares economically and militarily the strengths of the US and China in terms of socio-politico and economic considerations in an attempt to show if china is catching up. Soft power considerations are also looked into to see if China has sought to attract and persuade rather than coerce and hassle for moving states towards the Chinese Foreign and domestic policies.

The paper answers the question that china has looked to be attracted to Africa and in this way has made inroads in terms of soft power in the selected countries, thus showing the general outlook of Africa as a whole. The hypothesis tested is that Yes Africa has become attracted to the China.
