Pictures which not allowed

Hay, I red your comment on my value שרה גלבוע I got many difficalties to write in English. All the rights of the pictures belong to me and my sister. We saw the contract and it says that we agry everybody to use the pictures - we can not accept making other use out of wikipedia. I did not had the time to look for another agriment that can protect our rights. I spend a lot of effort to write the value and I will do much work on it. I am new and it is very difficalt to make the first steps. I hope the value will not be deleted. I have to find the solution. Thank you for understanding. Je suis à la recherche d'un administrateur francophone pour répondre à une requête que j'avais posé en mars dernier sur Administrators' noticeboard et sur le Bistro et qui était resté sans suite. Je te la retranscris ici:

Pour corriger des erreurs, à la suite du renommage du fichier File:Nathan Beaulieu WJC12 press conference.jpg en File:Ryan Murray WJC12 press conference.jpg, il faudrait supprimer la redirection pour pouvoir corriger le nom du fichier File:Jonathan Huberdeau WJC12 press conference.jpg (qui représente en fait Nathan Beaulieu), puis en faire de même avec ce dernier pour renommer le fichier File:Quinton Howden WJC12 press conference.jpg (qui représente Jonathan Huberdeau).

These pictures were copied from Facebook, so they are not your pictures. You are not allowed to upload images without a formal written permission from the copyright owner, i.e. usually the photographer. Please see COM:OTRS for the procedure to send a permission. The base map seems scanned from a book. See e.g. the coastlines of Sweden showing that the way of printing in different colors was not yet so sophisticated as what you would see with the current equipment. Permission

Hi, can you tell me why you think there is "obviously" no permission required for pictures like this file and this one? According to the metadata the photographer (not the same as the one who uploaded this pic) even claims copyrights for this one and yet you decide it doesn't need permission. Hi Ronn,
These are very simple utilitarian objects, which are not under a copyright in most part of the world. So unless there is a real proof of a copyright, I don't think a permission is necessary. Undeleted some files uploaded by Vpe (suite)

Je me permet de revenir vers toi concernant le sujet des affiches électorales. Le but de ma démarche n'étant ni politique, ni personnel mais dans un esprit de clarification pour la communauté et dans ce cas dans adapter les règles se référant au sujet dans la mesure où il peut évoluer. J'ai été rechercher dans nos textes administratifs ce qui pourrait nous être utile pour mieux comprendre ce sujet, dans l'ordre :

  • La réglementation du Cncc, qui nous rappelle les principaux textes fondateurs ;
  • Chapitre III : L’affichage du conseil-constitutionnel, qui nous fournit des indications sur la liberté de la presse en application de la Loi du 29 juillet 1881 ;
  • l'article 15 suivant la Loi. Heureusement pour nous le texte est court et précise les modalités sur l'affichage et les dégradations ;
  • le traitement et valorisation d'un fonds d'affiches qui représente un mémoire sur le sujet traitant en page 57 du « paradoxe des affiches électorales » et conclut par : En effet, au nom de la liberté d’information, la jurisprudence considère que « la publication de personnes directement impliquées dans un évènement est licite », sous la seule réserve du respect de la dignité de la personne humaine. On peut donc considérer que les affiches politiques illustrées de la photographie des candidats entrent dans ce cadre-là.

Entre temps, le fichier Affiches électorales 2012.JPG, pour lequel j'avais demandé une révision de situation a été effacé pour cause de copyright.

Concernant, le fichier Montpellier montage couv.jpg : Je l'ai repris sur la base de certains fichiers sources (pour ne pas les avoir tous trouvé) et j'y ai adjoint des fichiers complémentaires mais le résultat ne me convient pas pleinement à cause de la photo Hôtel de Ville de Montpellier dont je ne suis pas sûr de la légalité. A ce titre, j'ai été reprendre des photos en ville pour trouver dans les architectures anciennes un sujet représentatif et valorisant pour la ville, que je pense avoir trouvé à cette heure. Juste quelques manipulations pour régénérer un fichier viable !

Concernant, le fichier Montpellier-fac droit bat2.jpg : J'ai été reprendre des photos mais d'importants feuillages empêchent une prise de vue adaptée.
Concernant, le fichier Cloitre fac droit montpellier.jpg : J'ai également pris quelques photos mais pas depuis l'étage comme sur la photo en cours car cette personne travaille sur les lieux.

Actuellement, je suis en train de faire les plans d'accès et de représentations des bâtiments des facultés de Montpellier afin d'établir une meilleure représentation des sites. Et, j'ai quelques dizaines de photos, dont certaines intéressantes, à uploader !

Mais la loi sur la liberté de la presse n'est pas le problème. Et donc tous les textes que tu cites n'ont rien à voir. Il s'agit uniquement de la question du droit d'auteur sur 1. les sujets photographiés, 2. les photos elles-mêmes. Si Vpe ne donne aucune information, les images ne seront de toute façon pas restaurées. Il vaut donc mieux que tu refasses les montages à partir de tes propres images. Si elles incluent des bâtiments récents, il faut mettre les photos et le montage sur Wikipédia en français et non sur Commons. Et oublie les affiches électorales, elles ne peuvent pas être publiées sans un accord des auteurs, ce qui est quasiment impossible. Cordialement, Yann (talk) 18:45, 1 May 2017 (UTC)[reply]

Dear Yann, why you removed my uploaded files (Ewa Podles by Juliusz Multarzynski)? The written permission was sent already DIRECTLY by the author, Juliusz Moltarzynski to a OTRS (permissions-commons-pl@wikimedia.org)? I wrote it few times and I have resent the written permission. The files I deleted didn't have any permission. @Ankry: Do you know what's going on? Also Jcb deleted some files which were mentioned as copyright by Juliusz Moltarzynski, which is very unlikely, seeing the date (early 20th century). Hi Yann, I saw your message on my talk page and I have some questions.. even if I uploaded lot of images on WikiCommons, they were often election maps and potraits of politicians, with a clear and simple copyright. Probably your warning was about the last logos that I uploaded and, about this, my question: is how can I know which copyright is the correct one? Hi, Yann!! Hope all is well on your end. My purpose in contacting you now is in regards to the image File:HarryRLewis_Harvard_demonstrating_SHAPESHIFTER_1967or1968.jpg and I ask that you please read my comment on EEng's TP. Under copyright laws that were in effect before 1978, a work that was published without copyright notice fell into the public domain. As I explained at the user's TP, the image which is owned by Harry R. Lewis per the image upload information was actually published courtesy of Harry R. Lewis in the Harvard Magazine back in 1974, I believe. The image did not have any copyright notices on it, therefore it is considered a published work (See Kernal Records Oy v. Mosley,794 F. Supp.2d 1355, 1364 (S.D. Fla. 2011). Citing Getaped.com, Inc., the Eastern District of Arkansas found that photographs that were accessible online to others who could download them freely were published.)
