Droits de reproduction concédés à la mairie de Toulouse. Tout autre utilisateur doit obligatoirement demander l'autorisation aux ayants droit d'Emile Godefroy.
Also an image taken in 1960 cannot be in the French public domain as the minim protection is 70 years. Günther Frager (talk) 12:36, 21 June 2024 (UTC)
- Keep: This is a part of collection archives of Emile Godefroy. As collective work, this picture is PD-France, according to this issue : ”Cette photographie fait partie des archives municipales de la ville de Toulouse et placé sous licence CC BY-SA 4.0 par la délibération n°27.3 du 23 juin 2017 du Conseil Municipal de la Ville de Toulouse". The only matter is to precise détails for the source. Tisourcier (talk) 12:48, 21 June 2024 (UTC)
- I don't know if he took the photo or not, the source you provided states he is the author. Your argument for {{PD-France}} is nonsense. If it were a collective work, it would enter in the French public domain after 70 years of publication. That would be in 2031 and not earlier. If the Toulouse government release their content under CC-BY-SA, it means it grants that specific license. It doesn't put it into the public domain. Having a permissive license is not the same as being in the public domain. Also, it seems you didn't dare to spend 30 seconds reading the link provided or the quotation from that link. The government of Toulouse is acknowledging they are not the copyright holders. If you are not the copyright holder of an artwork / book / photo you cannot grant a license.

Please do not delete. (1) This category has been entered for deletion without discussion. (2) There are two main reasons why our readers search for this type of subject: because they want to know what is like today, and because they want to see it in a historical context, i.e. a picture of how it looked in the past. In the future, after many more pictures have been added, this category will make it easy to find the older pictures of the building. I would rather move all the historical images into this category, and remove them from the main Wardown Park Museum category, but as this is a discussion, I have left them in both categories for the present. If you can find another and better way for our readers to quickly and easily differentiate between current and very old pictures of this subject, I would be happy to cooperate with that. Storye book (talk) 09:03, 21 June 2024 (UTC) Storye book (talk) 09:06, 21 June 2024 (UTC)
- The category name should at least follow how similar categories are named "historical images of X subject." Not "X subject, historical images." It's just convoluted and not how the categories are named. Although I still it's totally pointless overcategorization given the small amount of images. --Adamant1 (talk) 10:05, 21 June 2024 (UTC)
- The above category can now be deleted, because it has now been replaced by Category:Historical images of Wardown Park Museum. Thank you, Adamant1, for approving that. Storye book (talk) 10:16, 22 June 2024 (UTC)

Probable copyvio. This is one of several photos taken of this incident by Neil Leifer for Sports Illustrated. It's listed for sale on his site here so it's unclear why it's sourced to eBay. Sports Illustrated was very much published with a copyright notice back in 1965, including the specific issue in which another of Leifer's photos of the incident was published. I don't have a smoking gun here but it seems very unlikely that this isn't protected by copyright. Denniscabrams (talk) 15:14, 21 June 2024 (UTC)

The image is no longer available on Flickr but the license was verified by File Upload Bot (Magnus Manske) at the time of upload. However, the Flickr account holder is not the photographer. Although the image is no longer on Flickr, account is still there. Per the information in the first file, the source account is https://www.flickr.com/people/16367219@N03 which identifies as Railways of Australia by Daryle Phillips (emphasis added). The EXIF shows the author of the photo is Weston Langford, and not Daryle Phillips. And indeed, in the first image, the watermark identifying "© Weston Langford" is in the original uploaded image but then cropped out. Weston Lanford's web site has an explicit CC BY-ND 4.0 license statement for all his photographs. I doubt that the Flickr license is valid. --Whpq (talk) 17:31, 21 June 2024 (UTC)
- Delete unfortunately, Weston Lanford’s website in 2011 was © Weston Langford. Bidgee (talk) 19:35, 21 June 2024 (UTC)
- Delete Given the background, I must support deletion. Weston Langford is now deceased, and a relative, who maintains the westonlangford.com website, changed copyright coverage to Creative Commons Attribution-NoDerivatives 4.0 International. Weston, whom I knew when he was alive, was a superb photographer, and his photos are reproduced quite widely. They are not only very good, they are of subjects that, often, have not been published by anyone else -- as in the images nominated. But the relative, whom I contacted in relation to another photo, is firm in not making a waiver on the No Derivatives front for any photo. SCHolar44 (talk) 04:59, 22 June 2024 (UTC)
- I think we could undelete this on 30 January 2084, as it would be 70 years after the creator's passing. Bidgee (talk) 07:37, 22 June 2024 (UTC)

Nonsense {{PD-France}} claim. Nothing published on 1954 or later is in the French public domain. This manifesto is not even anonymous, it was penned by Monique Wittig (died 2003), Gille Wittig (died 2009), Marcia Rothenburg (no data), and Margaret Stephenson (no data). The full publication where this scan was taken can be found on https://collections.library.yale.edu/catalog/2057932. - It shows water pilling up on a waterproof garment. I'm not sure whether we have other/better pictures of that. If we don't, then this is quite useful. Even if we do, it doesn't seem worth having started a DR on something this innocuous. - Jmabel ! talk 18:43, 21 June 2024 (UTC)
- I've added some categories since it was uncategorized. Might make it easier to judge whether it's useful or not. Nakonana (talk) 12:11, 22 June 2024 (UTC)

[edit]Photo by Harcourt Studio published in 1954. They are currently copyrighted in France because protection for collective works is 70 years after publication (they will enter in the French public domain in 1954 + 70 + 1 = 2025). The source of these images confirm that they were taken in 1954. That is, there are other Harcourt photos claimed to be taken in 1954, e.g. File:JacquelineHuet-1954-Harcourt.png, that I didn't include in this DR because its source didn't state a creation or publication date. We can undelete them in 2050 when they enter in the US public domain.

x-wiki hoax of glob. blocked user, see en:WP:Sockpuppet investigations/Stluciainformation/Archive. --Nolispanmo 11:12, 21 June 2024 (UTC)
- @Billinghurst I don't really understand why you declined the speedy deletion request [3]. The image was uploaded by a sockpuppet of Stluciainformation and is part of ongoing xwiki spam. Given this is self-promotion (by a globally locked user) I think Commons:CSD#G10 and Commons:CSD#F10 are fulfilled. That's why other pictures related to this spam have been deleted as well. Based on my own speedy deletion requests there were e.g.

[edit]Lightly modified tracing of a portrait photo by André Crudo (https://www.alamy.com/french-actor-pierre-tornade-on-the-set-of-the-tv-series-nestor-burma-april-25-1991-image475635627.html), flipped left-to-right. Per COM:BASEDONPHOTO, a drawing based on a single specific photograph requires the permission of the photographer. (This is a specific Commons policy, which differs from fr.wikipedia.org's policy on drawings of photographs.)
Belbury (talk) 15:18, 3 October 2023 (UTC)
- Hi !
- My drawing is not at all inspired by this photo. You can verify the mouth, teeth, the eyes, the attitude, face dimension and the hair are distinctly differents.
- My work is done mostly by memory. So, your request is unfounded. Tisourcier (talk) 15:46, 3 October 2023 (UTC)
- With this principle, it would be necessary to remove plenty of portraits, like this, for instance :
- - https://commons.wikimedia.org/wiki/File:Wandbild_Portrait_George_Floyd_von_Eme_Street_Art_im_Mauerpark_(Berlin).jpg
- - https://en.wikipedia.org/wiki/File:George_Floyd.png
- As everyone can see, this portrait is directly based on the photo. Tisourcier (talk) 16:00, 3 October 2023 (UTC)
- Once the Alamy photo is flipped left-to-right a lot of it lines up - the uneven shoulders and asymmetrical shirt collar appear to be from where you've used some lines from Tornade's jacket and drawn just the shirt instead.
- I appreciate that you've drawn the eyes, mouth and hair freehand, but your drawing appears clearly based on this one particular photograph of Tornade.
- Yes, there probably are other images on Commons which go against this copyright rule and should be amended or deleted, although there are some unusual exceptions for freedom of panorama in some countries. Belbury (talk) 16:03, 3 October 2023 (UTC)
- In this case :
- The file is copyrighted and the use of this image is not permitted in any case but is still granted by Commons.
- My drawing is not inspired by the photo by Crudo at all. This actor has a very specific face and you could consider that any drawing of him is a copyvio because you'll find his face similarities on any other photo.
- Its a subjective point of view or opinion and not a rational démonstration.
- So let others experienced contributors give their analysis of it. Tisourcier (talk) 16:22, 3 October 2023 (UTC)
- Sorry but I believe that you must have used this specific photograph for a significant amount of reference. As well as the unusual shape of collar and shoulders corresponding to the outline of the jacket he is wearing in Crudo's photograph, the general dimensions of the face also line up. I opened both images in an editor to check whether they corresponded when superimposed at the same scale, and the curve of Tornade's mouth, the position of his nose, his chin, his bags under the eye, etc, line up. There are original details and alterations here, but also a lot of Crudo's original photograph. --Belbury (talk) 16:31, 3 October 2023 (UTC)
- If you draw the Eiffel tower, you will reproduce several parts of it. Commons or WP dont determinate the amount of inspiration of a drawing : 40%, 60%, 80% ? This consideration is subjective. My artwork is original, by hand and made without copying this particular photo. Tisourcier (talk) 17:17, 3 October 2023 (UTC)
- For your own reference and that of other contributors, this is the drawing superimposed over Crudo's photograph: https://i.imgur.com/NDDb8cB.png Belbury (talk) 17:38, 3 October 2023 (UTC)
- For the outline this is similar, but for the others and main parts of the face, this is very different.
- You can se here this others pictures I just found via Google that other parts are similars with numbers of other existing photos.
- The main question is : wich percentage of a model is allowed in Commons and wich is not : 20%, 40%, 60% ?
- Other "mixes" with differents photos of the same people :
- https://zupimages.net/up/23/40/8evo.jpg
- So, it's really a matter of subjective point of view. Tisourcier (talk) 12:09, 4 October 2023 (UTC)
- How much of Crudo's photograph would you say that you used here? And did you refer to any other specific photographs when drawing Tornade's eyes and mouth? Belbury (talk) 12:48, 4 October 2023 (UTC)
- It was designed by hand (I used a grid for proportions). It could be 20 or 30% for the outline. The other details are by memory or inspiration but not photo. Tisourcier (talk) 15:11, 4 October 2023 (UTC)
- So we've gone from My drawing is not inspired by the photo by Crudo at all, to saying that 20% to 30% of your drawing is based on copying this specific photo.
- The eyes you've drawn are a match for the picture at https://www.rottentomatoes.com/celebrity/pierre_tornade (overlay example at https://i.imgur.com/gVRQx3d.png). Did you also use that image as a close reference? Belbury (talk) 07:50, 5 October 2023 (UTC)

[edit]These photos were taken in the 1950s in France in photo studios (mostly Harcourt), but there is not evidence that they were created / published on the year the description claims it was. Any photo published in 1954 or later is currently not in the French public domain (there are several in this DR), and any photo published in the 1950s that was not simultaneously published in the US is still copyrighted in the US. That the uploader invents the dates seems to be evident. For example, Commons:Deletion requests/File:PierreRepp-1953.png is the cover of an EP published in 1955 and it was stated in the source link. The source link of Commons:Deletion requests/File:MarinaVlady-1952-Harcourt.png clearly states the photo was taken in 1955. Some of the files in this DR give also good evidence made up dates. File:CatherineLangeais-1954.png the back states the postcard was issued for an event on September 5, 1968. File:MaryMarquet-1953-Harcourt.png mentions the year 1965 on the back. File:Denys-deLaPatelliere-1951-Harcourt.png is from a eBay item that sells photos from 1955 until 1971. File:Caccia-Harcourt-1950-Harcourt.jpg is from an eBay item that says it was taken in the 1960s. File:JeanRichard-1953-Harcourt.png actually states it was taken 1949 (not included on this DR as it states when it was published).
All in all, there is no evidence that the date of publication are correct, the claimed ones make them either copyrighted in France or close to the limit, and there is no evidence they are in the public domain in the US even assuming the dates are correct. Following, COM:EVID and COM:PCP we cannot keep them.

Some of them can be re-printed or re-published later but the year to be considered is when they have been published for the fist time in France. Günther Frager is not giving a proof for almost all these picture that they have not been taken or published before 1954. I had studied each biography data for any of these artists or people before to upload in Commons, according to each period of their carreer.

- I have to remind you that it is your duty as uploader to provide the evidence that the files are in the public domain, see COM:EVID. Reading a bibliography you might infer that a photo was taken in the 1950s, but you cannot known the exact date it was taken, and I showed plenty of cases you clearly made up the dates. You also uploaded plenty of photos that even assuming the dates were correct were or are still copyrighted in France. Moreover, you are still ignoring the fact that images have to be in the public domain in the US, see COM:L. Are you also inferring from reading bibliographies that they were simultaneously published in the US without a copyright notice? Günther Frager (talk) 21:08, 23 June 2024 (UTC)

- Hello,
- Thank's a lot for the selective ranking and acknowledgements (Yann, Richard Arthur Norton, Asclepias). Concerning the "non Harcourt studio" pictures, they mainly are from "studios", "agencies" or companies employing different anonymous photographers, because this is "collective work", as such as Harcourt Studio. In this case in France, PD applies for any collective work's photography wich has been taken 70 years before (or earlier of course). So, the criteria for PD France still applies. Finally, for these photographs, I allways refer to books or check archives to select myself any picture and determine if they are 70 yo, or more. Tisourcier (talk) 10:28, 2 July 2024 (UTC)

Photo by Harcourt Studio taken in 1960. The French copyright protection for collective works in 70 years after publication. Clearly {{PD-France}} does apply. We can delete it in 2056 when it enters in the US public domain. Günther Frager (talk) 10:10, 21 June 2024 (UTC)
- Keep The French state bought the photo archives of Studio Harcourt in 1991 and released them under a Creative Commons Attribution 3.0 Unported license. We currently have 691 hosted at Commons. Instead of nominating a dozen or more images, you should have read the copyright info in the category, or asked at Village pump/Copyright. --RAN (talk) 11:23, 27 June 2024 (UTC)
- There is no reference that the French government releases the collection under a Creative Commons license. This particular photo doesn't appear at https://www.photo.rmn.fr where Harcourt collection from the French goverment is digitalized. Of course maybe not all images are online, however, the source cited is "Fonds N. NOLIBOS" and also all Harcourt photos on RMN state "(C) Ministère de la Culture". The source of this image is the cover of the EP Le fin diseur published in 1955. It is clearly still copyrighted in France (70 years, its country of origin. We can undelete it in 2051 when it enters in the US public domain. Günther Frager (talk) 19:15, 21 June 2024 (UTC)
- Keep. No, this photography has been taken and published before 1954 for the show promotion poster in Paris and this file is under PD-France as a collective work. The record was reprinted later in 1954. As for other cases, please refer to this decision : https://commons.wikimedia.org/wiki/Commons:Deletion_requests/Files_uploaded_by_Tisourcier. — Preceding unsigned comment added by Tisourcier (talk • contribs) 19:10, 3 July 2024 (UTC)
- Signing your posts is required on talk pages and it is a Commons policy to sign your posts on deletion requests, undeletion requests, and noticeboards. To do so, simply add four tildes (~~~~) at the end of your comments. Your user name or IP address (if you are not logged in) and a timestamp will then automatically be added when you save your comment. Signing your comments helps people to find out who said something and provides them with a link to your user/talk page (for further discussion). Thank you.
- The source was https://www.cdandlp.com/pierre-repp/a-propos-des-trois-baudets-un-fin-diseur-bonne-annee/45t-ep-4-titres/r120048299/ and it is an LP published in 1955. Even, it it was published in 1954, it would be copyrighted in France until December 31, 2024. Moreover, as it was not in the public domain in France in 1996 it would be copyrighted in the US until 2051 in the US due to URAA. Note that the resolution of the mention DR was because there is a VRT from Harcourt. This photo is not a Harcourt photo. Günther Frager (talk) 19:29, 3 July 2024 (UTC)
No, this photograph has been taken and published without identification of the author before 1954 and this criteria is according to french regulation for PD-France as collective work. The reference is this book :
Alain Poulanges, Janine Marc-Pezet : Le Théâtre des Trois Baudets, Dumay Editions, 1994 (page 95).
If you can demonstrate any proof that this source is not relevant, please give your own source references. Without these, the PD-France applies. Tisourcier (talk) 19:54, 3 July 2024 (UTC)
- Read my comment again even if it was published in 1954 it would be copyrighted in France until December 31, 2024. You can read the law yourself [4]. And even, a poster published in France in 1950 and not simultaneously published in the US would have its US copyright resored in 1996 due to URAA. Günther Frager (talk) 20:22, 3 July 2024 (UTC)
- No again, this photograph has been first published before 1954 (book reference source is given), so as collective work, it's still PD-France. Tisourcier (talk) 21:26, 3 July 2024 (UTC)
- And does the reference state it was published simultaneously (within 30 days) in the US? Günther Frager (talk) 21:35, 3 July 2024 (UTC)
- This second criteria that you indicate now, is out of the PD-France matters and Commons rules, so your request based only on this point is not relevant :
- https://commons.wikimedia.org/wiki/Commons:Massive_restoration_of_deleted_images_by_the_URAA Tisourcier (talk) 21:53, 3 July 2024 (UTC)
- You are citing a resolution that was discarded 10 years ago, it clearly states Note -- the above conclusion was superseded by Commons:Review of Precautionary principle; current policy is at Commons:Licensing#Uruguay_Round_Agreements_Act.. The licensing policy requires images to be in the public domain in its county of origin and in the US. Günther Frager (talk) 23:19, 3 July 2024 (UTC)

- Ah OK. Yann (talk) 09:51, 4 July 2024 (UTC)
- But this photography is collective work, taken before 1954, so it is PD-France and the URAA criteria can't be used as the only motive of deletion. Tisourcier (talk) 10:11, 4 July 2024 (UTC)

- Question @Tisourcier: Why do you say this is a collective work? A court determined this for Studio Harcourt photos. And there was a second case about product photos of some web site selling sporting goods. But neither of these cases said that just any photo by a photo studio is a collective work, which is what you seem to imply. Also note that URAA-restored copyrights can be the sole reason for deletion. --Rosenzweig τ 13:26, 21 July 2024 (UTC)
- See Commons:Deletion requests/File:Mine-deFunes-1934.png for a more detailed explanation of this angle. --Rosenzweig τ 13:34, 21 July 2024 (UTC)
- No. The name of the photographer is not published. This photograph is from Studio Reflets wich is under collective work status. As Ruthven explained allready, URAA can't be the sole motive for deletion. Tisourcier (talk) 11:15, 22 July 2024 (UTC)
- That a photographer is not named or that a photo is from a photo studio does not necessarily mean that it is a collective work. That is a rare status in French IP law, as explained in more detail in the other DR which I linked. And again, per Commons:URAA-restored copyrights, URAA can be the sole reason for deletion. --Rosenzweig τ 11:29, 22 July 2024 (UTC)

Austin American-Statesman has an all rights reserved license, which can be found in the footer of the website, and Getty Images is a supplier of stock images, editorial photography, video, and music, but this does not imply that what they provide immediately becomes public domain once purchased, as the authors of the work retain copyright. As a result, in order to keep this file in Commons, the author (Paras Griffin) must grant permission for the image to be posted under a valid license. - This climber, Moritz Welt, has released videos on youtube with "Creative Commons Attribution license (reuse allowed)" such as here (which I have also uploaded to WikiCommons with File:Moritz Welt Joe Blau 8c+ Oliana Spain.png). This video was also marked as "Creative Commons Attribution license (reuse allowed)" when I uploaded its image to WikiCommons, so I am not sure where that leaves it. Factual accuracy disputed, fails COM:EDUSE. The presence of the Tren de Aragua gang in the United States has been debunked by investigations such as [6] and [7]. NoonIcarus (talk) 17:08, 21 June 2024 (UTC)
- Oppose: The map provides useful information on where Tren de Aragua is active in the United States according to reliable sources. NoonIcarus is using outdated sources (Insight: April 2024, Chicago Sun Times: November 2023) that do not show the more recent impact of the gang in the United States. CNN ([8] - June 2024, the OCCRP ([9] - June 2024), El Comercio of Peru ([10] - June 2024), NBC Chicago ([11] - June 2024) and NBC News ([12] - June 2024) all detail the growing presence of the gang in the United States alongside comments from US authorities and show which states the gang is present in.--WMrapids (talk) 17:32, 21 June 2024 (UTC) Note: WMrapids is the uploader of the file --NoonIcarus (talk) 17:51, 21 June 2024 (UTC)
- Comment That's also without mentioning how misleading the map is: the purpoted presence is reported in cities such as Chicago or El Paso, not statewide. The map seems to promote the hoax by Donald Trump relating Venezuelan migrants to crime on 9 June and repeatedly debunked as recently as last week:[13]. --NoonIcarus (talk) 17:59, 21 June 2024 (UTC)
- Sources like CNN and others mention the states the gang is present in, so I don’t know how that can be interpreted as misleading.
- Also, the map only shows where the gang is present and nothing more. The map says nothing about Venezuelan migrants nor anything about crime related to them. Linking this map to rhetoric from Donald Trump is based on an interpretation and not on anything factual. WMrapids (talk) 19:30, 21 June 2024 (UTC)
- The articles report on unconfirmed police reports (something that the articles themselves emphasize, writing suspected). There haven't been convictions or even indictments on the matter, since there aren't any state of federal court documents that mention the gang. This map is based on speculation. --NoonIcarus (talk) 12:55, 22 June 2024 (UTC)
- The OCCRP writes:
- "According to CNN en Español, the presence of the Tren de Aragua has been detected or investigated in six U.S. states: Florida, Georgia, New York, Illinois, Texas, and Louisiana."
- This is in addition to the other sources provided.
- Also, one can look at MS-13's Presence section (Map here: File:MaraSalvatruchaLocation.png) and see that such maps, using state boundaries, have already been used in similar articles. WMrapids (talk) 22:02, 22 June 2024 (UTC)

- Is this really the reason for deletion? The portrait I painted of Chimalxochitl, Aztec princess and Queen of Cuautitlan, is LITERALLY based on a part of the account of her life at Annals of Cuauhtitlan. It’s a depiction of how she was found by the King of Cuautitlan while she was being prepared in a ritual bath just before her execution (or human sacrifice, as Europeans would call it). This, because she was captured at the Battle of Chapultepec, where her family (her father the Aztec King and her sister) were paraded nude by the Allied military forces of Azcapotzalco, Colhuacan and Xaltocan. Xaltocan took Chimalxochitl back to their capital. And this scene is just how she was found during her rescue, a pivotal moment in her life (since she was rescued from certain death) but also for the Kingdom of Cuauhtitlan (because she became a beloved Queen consort of the Cuautitlancalque).
- The problem I’ve seen in Wikimedia and Wikipedia is that all non-European or non-White artistic depictions are treated as below those depictions of European mythology or history. Furthermore, there is a lack of imagery of Mesoamerican historical figures in Wikimedia.
- If being “inappropriate” is the reason for its deletion, then Wikimedia should delete ALL nude or partial nudes which show cultural or historical scenes (i.e. Ancient Greek imagery). This depiction of Chimalxochitl is an attempt to provide an image of her life.
- But none of this was considered, especially because this deletion was put forward by an account creates 6 hours ago!
- Finally, putting to Wikiusers consideration, is that the image IS BEING USED. Which means Wikipedia articles in many languages use it. Miguel Angel Omaña Rojas (talk) 02:50, 22 June 2024 (UTC)
