This image is used on the website listed, which lists all of its contents as subject to copyright. Unless evidence is presented otherwise, doesn't that, by default, make it a copyrighted image? Qwyrxian (talk) 14:48, 3 August 2013 (UTC)[reply]

This is an Election symbol as allotted by Election Commission of India to many Political parties in many different elections. It's use is governed by The Election Symbols (Reservation and Allotment) Order, 1968, as in following references, [1], [2], [3]. The same symbol is also used in website of Naitik Party, another Indian Political Party. Tall.kanna (talk) 20:40, 3 August 2013 (UTC)[reply]
  • Comment This is without doubt a messy situation. I'm really not good when it comes to the arcane aspects of copyright & I've noticed today that there is something called the "threshold of originality" which, like many things copyright-related, seems to be rather subjective in law. What is certain is that this image is a cut from one shown on a copyrighted website and that the various links provided by Tall.kanna do not in fact address the concern. Some predate the image and are full of references to other laws/regulations that will require legal expertise ... and none seem to show the image itself.

    Who actually created this image? I did suggest on the en-WP talk page for the political party in question that the most likely simple solution to this is to attempt to get from the party some form of OTRS permission for re-use. For reasons that I'm not going to bother explaining, I would be surprised if this was not given, assuming that they do have the authority to give it. It was because of this optimism that I did not nominate for deletion myself - I was hoping that those who clearly have an affinity with the party might be able to resolve it via OTRS in a very timely manner. - Sitush (talk) 00:24, 4 August 2013 (UTC)[reply]

  • Strong Keep : This is a political party symbol not a website oriented and Wikipedia has allowed the use of party symbol in their WP article on so many instances,pls check BJP and INC and Loksatta party WP Article.[4]
  • Comment: Qwyrxian, have you never come across a situation where copyrights are claimed by non-owner parties? For example, this image is used by a news report of Deccan Herald and their footnote says "COPYRIGHT © 2013 DECCAN CHRONICLE. ALL RIGHTS RESERVED. FOR REPRINT RIGHTS: DECCAN CHRONICLE SERVICE" §§Dharmadhyaksha§§ {T/C} 04:02, 6 August 2013 (UTC)[reply]

Deleted: Whether this was created by the government or by the political party, it is not exempt from copyright -- the Indian exemption for government works is very limited.
