Brendan Myers Miller (born 1983) is a Canadian lawyer.

Career

Miller is a Calgary based litigator and appellate lawyer who is Special Counsel at FosterLLP, where he practices regulatory, public, constitutional, administrative, civil, commercial, criminal and international law.[1] His notable clients have included the Blood Tribe first nation.[2], former professional hockey player Theron Fleury, Ric McIvor, and former Minister of Justice Jonathan Denis.

In 2013, he was Pro Bono Volunteer in Profile (VIP) of Pro Bono Law Alberta. [3] In that same year, Miller successfully argued the United Nations Convention on the Rights of Persons with Disabilities, keeping his client who is blind from a custodial sentence for a major sexual assault [4] In 2015, Miller provided pro bono legal services to the family of Lethbridge family who sought to keep their daughter on life support.[5]

In 2022, Miller represented Freedom Corp., a not-for-profit that represented some of the Canada convoy protestors at the Public Order Emergency Commission in 2022.[6] During the comission, Miller succeeded in forcing the government of Canada to resubmit unredacted copies of 20 documents to the inquiry.[7] His cross-examinations and motion at the commission to call a person claimed to be carrying a Nazi flag at the protest and was a Liberal party of Canada agent provocateur prompted Politico to label Miller as the Biggest Firebrand of 2022.[8] Justice Paul Rouleau who ran the comission described the claim as having “little foundation in evidence” despite an affidavit from a person identifying the person with the Nazi flag and pictures of the person with the Nazi flag being before him [9] Miller was also removed from the comission after repeatedly talking over Justice Rouleau when Rouleau refused to hear an oral application to compel the Minister of Public Safety’s staffer, Andrew Cohen, as a witness, or rule on the motions already filed by Miller in writing [10][11] He was let back into the Commission that day however.

Public relations company Enterprise Canada launched a legal claim for damages to Ontario Superior Court of Justice on December 20, 2022, stating that Miller claims that their employee took the Nazi flag to the protest were false.[6][12] Enterprise Canada previously served a defamation notice on Miller in November 2022.[13]

Miller has taught at Mount Royal University and University of Calgary Law School.[14] He is currently an instructor of Canadian Constitutional Law at Wilfrid Laurier University in their joint BA/LLB program with University of Sussex.

Personal life

Miller was aged 39 in 2022.[15] He is married with a daughter.[15]
