Law of agency

The law of agency is an area of commercial law dealing with a set of contractual, quasi-contractual and non-contractual fiduciary relationships that involve a person, called the agent, that is authorized to act on behalf of another (called the principal) to create legal relations with a third party. Succinctly, it may be referred to as the equal relationship between a principal and an agent whereby the principal, expressly or implicitly, authorizes the agent to work under his or her control and on his or her behalf. The agent is, thus, required to negotiate on behalf of the principal or bring him or her and third parties into contractual relationship. In 1986, the European Communities enacted Directive 86/653/EEC on self-employed commercial agents. In the UK, this was implemented into national law in the Commercial Agents Regulations 1993.

Canon law

Canon law is the body of laws and regulations made by ecclesiastical authority (Church leadership), for the government of a Christian organization or church and its members. It is the internal ecclesiastical law governing the Catholic Church (both Latin Church and Eastern Catholic Churches), the Eastern and Oriental Orthodox churches, and the individual national churches within the Anglican Communion. The way that such church law is legislated, interpreted and at times adjudicated varies widely among these three bodies of churches. In all three traditions, a canon was originally a rule adopted by a church council; these canons formed the foundation of canon law.

Etymology

Greek kanon / Ancient Greek: κανών,Arabic Qanun / قانون, Hebrew kaneh / קנה, "straight"; a rule, code, standard, or measure; the root meaning in all these languages is "reed" (cf. the Romance-language ancestors of the English word "cane").

Canons of the Apostles

The Apostolic Canons or Ecclesiastical Canons of the Same Holy Apostles is a collection of ancient ecclesiastical decrees (eighty-five in the Eastern, fifty in the Western Church) concerning the government and discipline of the Early Christian Church, incorporated with the Apostolic Constitutions which are part of the Ante-Nicene Fathers In the fourth century the First Council of Nicaea (325) calls canons the disciplinary measures of the Church: the term canon, κανὠν, means in Greek, a rule. There is a very early distinction between the rules enacted by the Church and the legislative measures taken by the State called leges, Latin for laws.

In addition to the qualifications required to become a practicing lawyer, legal education also encompasses higher degrees, such as doctorates, for more advanced academic study.

In many countries other than the United States, law is an undergraduate degree. Graduates of such a program are eligible to become lawyers by passing the country's equivalent of a bar exam. In such countries, graduate programs in law enable students to embark on academic careers or become specialized in a particular area of law.

Massachusetts 1913 law

Massachusetts General Laws Chapter 207, Section 11, more commonly known as the 1913 law, is a Massachusetts law enacted in 1913 and repealed in 2008 that invalidated the marriage of non-residents if the marriage was invalid in the state where they lived. It originated during a period of heightened antipathy to interracial marriage and went largely unenforced until used between 2004 and 2008 to deny marriage licenses to out-of-state same-sex couples.

Enactment

State Senator Harry Ney Stearns introduced Senate Bill 234 on March 7, 1913. The bill was signed into law three weeks later by Governor Eugene N. Foss. The statute provided that in the Commonwealth of Massachusetts:

No record of the state Senate debate has been found. Historians and legal scholars have said that the original purpose of the legislation was an anti-miscegenation measure. The law did not ban interracial marriage, which had been legal in Massachusetts since 1843, but blocked interracial couples from states that banned interracial marriages from marrying in Massachusetts. The law was enacted at the height of a public scandal over black heavyweight boxer Jack Johnson's interracial marriages. A 1912 conference on uniform state laws recommended the language adopted by Massachusetts because, among other things, it would enforce state prohibitions against the marriage of "a white person and a colored person." At a conference of governors in 1912 during the height of the publicity surrounding Johnson's marriages, Governor Foss of Massachusetts was one of several northern governors who endorsed the enactment of an anti-miscegenation statute. Vermont passed a similar statute about the same time as Massachusetts.

Shipping agency

A shipping agency or shipping agent is the designated person or agency held responsible for handling shipments and cargo, and the general interests of its customers,at ports and harbours worldwide, on behalf of ship owners, managers, and charterers. In some parts of the world, these agents are referred to as port agents or cargo brokers. There are several categories of shipping agents such as: port agents, liner agents and own agencies, each rendering specific services depending on the shipping company they represent.

Shipping agents will usually take care of all the regular routine tasks of a shipping company quickly and efficiently. They ensure that essential supplies, crew transfers, customs documentation, and waste declarations are all arranged with the port authorities without delay. Quite often, they also provide the shipping company with updates and reports on activities at the destination port so that shipping companies have real-time information available to them while goods are in transit.

00 Agent

In Ian Fleming's James Bond novels and the derived films, the 00 Section of MI6 is considered the secret service's elite. A 00 (typically read "Double O" and denoted in Fleming's novels by the letters "OO" rather than the digits "00") agent holds a licence to kill in the field, at his or her discretion, to complete the mission. The novel Moonraker establishes that the section routinely has three agents concurrently; the film series, beginning with Thunderball, establishes the number of 00 agents at a minimum of 9, with the likelihood of more.

Description

In the first novel, Casino Royale, and the 2006 film adaptation, the 00 concept is introduced and, in Bond's words, means "that you've had to kill a chap in cold blood in the course of some assignment." Bond's 00 number (007) was awarded to him because he twice killed in fulfilling assignments. (This differentiates from deadly force used by non-00 agents in the course of self-defence or offensive action; plus, in the original time frame of the novel—the early 1950s—many MI6 agents would have had recent war service.) In the second novel, Live and Let Die, the 00 number designates a past killing; not until the third novel, Moonraker, does the 00 number designate a licence to kill. Thereafter, the novels are ambiguous about whether a 00 agent's licence to kill is limited, with varying accounts in Dr. No, Goldfinger, and The Man with the Golden Gun.

Agent 355

Agent 355 was the code name of a female spy during the American Revolution, part of the Culper Ring. Her real identity is unknown.

Career

The only direct reference to Agent 355 in any of the Culper Ring's missives was from Abraham Woodhull ("Samuel Culper Sr."), to General George Washington in 1778. Little is known for sure about this mysterious lady, but speculation abounds. What is known is that she was located in New York and at some point had contact with Major John Andre and Benedict Arnold. She is thought to have played a major role in exposing Arnold and the arrest of Andre. It is believed that 355 was a member of a prominent Loyalist family and within easy reach of British commanders. When Andre was in New York, the Culpers' information came fast and furious but, when he was in the southern colonies with Henry Clinton, the information slowed considerably. At this point, Washington complained that the Culpers were a waste of money. This leads historians to believe that 355 was one of the flock of females that surrounded Major Andre.
