
Thankfully i'm alright, got checked out at the nearest hospital and such, I was way more pissed off than truamatized.
Unfortunately this time of year brings out the worst in drivers , everyone's in a hurry, including the dick driving through a red light and sending me spinning, yes he was barreling down the highway fast enough to flip and slide his truck several feet away, i'm currently getting all my documents in order for insurance and we'll see if my baby is salvagable or has to be written off.

I would point out that it is actually quite common for truck drivers to live in their vehicles. numerous go on very long trips for which it ain't possible to go home and costs of sleeping at motels tend to add up real quick. So for many their truck doubles as workplace and as home away from home. some large models even having ample space in the cabin for that reason.

First off, glad to know you are alright. Second, based on the level of damage to the front end, it will most likely be declared a loss, as a new vehicle will be seen as the cheaper option by insurance. If that's a personal truck, them not having insurance is gonna suck for getting repair/replacement costs. But if its a company vehicle you should be set. Hope everything goes well with the documentation and vehicle restoration/replacement.

The bulk of the car is untouched, but the way that wheels inward, the compression and crumple going on; I'd suspect chassis damage atop a fecked engine n the like. Insurance company will likely try pushing for replacement rather than repair.

Ime people with expired insurance tend to drive MORE recklessly because courts will often turn down any sort of payout to both ends unless a vehicle involved or nearby had dashcam footage they could surrender :x especially in states where traffic cameras are illegal (Alaska, Kansas, Connecticut, etc)

Keep an eye on yourself for trauma responses, I was in a 7-car pileup as a kid, came out with only whiplash on the physical side but much worse on the mental end. Hopefully you can get everything sorted easily <3

That's something I've always wondered about. ( since, in truth, I do not own my own car "yet" ) but what DOES happen if someone causes an accident and THEY either don't have, or possess expired insurance? how does the injured opposite party
( for the cost of damage to the car, or medical bills ect ) get any compensation? does it fall to the state, who then turn around and put the one at fault through the wringer?

This depends a lot on exactly where you live and what the laws around insurance are there. In general, in the United States:
1 - Most insurance plans include an add-on for "uninsured motorist coverage". This provides special protection in case an uninsured driver hits you, and the insurance company will cover your car and your passengers to the normal limits of your plan.
2 - If you do not have uninsured motorist coverage, you can sue the uninsured driver, who may or may not be able to pay, and may or may not even have any assets worth taking. The court can help to the extent allowed by law (which again varies by jurisdiction), but this is usually pretty limited. Broadly speaking you can ruin someone's savings but you probably can't ruin their life (i.e. can't take their primary vehicle, house, retirement savings, etc).
If you can't get enough out of (2), you'll ruin the other person's credit, but other than that you're on your own.
Some states (very few) have varying no-fault provisions, where your insurance covers you first and foremost, and then sues the other insurance company to recover their costs. That’s terrifying, I’m so sorry that happened to you. I’ve never gotten over when I had a crash, it really changes you. I’m glad that you’re okay, be sure to take some time to unwind, crashes like that have a tendency to surge you with adrenaline and you don’t get enough time to really process how hurt you are.

Sadly looks like your car is totaled. That much front end damage, and its a unibody, so its bent all the hell where you can't see it. Thats part of the problem with most newer cars.
On the other hand, glad you made it out allright, and start the lawsuit now, cause the ininsured idiot is going to do his best not to pay out.

Glad your ok! Had a similar hit myself once, big ole truck vs my little hyundai, hit me in the rear on the driver side and ripped open my truck like a soda can. Could have gotten me right in the driver door. From my experience the car is a loss, that much damage to the frame and engine would cost more then the car to repair.

First glad ur ok. Second I work in the towing industry sadly I'd say ur car is toast. I doubt they will salvage it. If the tow company gives you any issues feel free to dm me I work with insurance companies all the time and there sadly are a lot of shady tow companies out there.
ah those holiday drivers. if only people would just idk plan things ahead, get shit done beforehand or even just do things calmly instead of risking life, limb and multiple vehicles for something that probably wasnt all that important, driving wouldnt be such an ordeal during seasons like this.

Glad you are okay, but I can tell from the photos, your car is going to be written off that damage to the front engine bay is going to be looked over along with the axles and such. The best thing about the idiot writing off your car would be their insurance payout from them, along with their premiums going up on them. Also, you have dash cam and was there CCTV from other places
Take a couple days off! Your body is going to go through a stress reaction from tensing up and taking the impact, and you're probably going to have a really sore neck (and other parts, and not in the fun ways) for a while. It's important to rest and let yourself recover gently so you don't develop any long-term complications.

And judging from the damage to the engine, the radiator section, and how twisted and mangled the frame itself is, I expect the car to be totaled. There's no way any bodyshop can fix that without cutting and welding a new front on which would ruin the safety aspect.

So my guesses are: is ex insurance will pay for the damage and your health at first, but will try to get the money back from him, later? with little chance of success. so they'll sue him, and he'll end up in jail or something?

I posted a little summary to another person who asked the same question! It varies a lot from state to state; think of it less like one unified system and more like 50 separate-but-vaguely-related little systems in a trench coat.

I am not really an expert about cars and can be wrong. However, when cars are compressed and bent like this, it is usually a sign that the car is beyond repair, even if fixed it wont run the same. This is because the car's engine compartment acts as an impact absorber.
