Emancipated Minor
After you are 16 years old you can be emancipated

(no longer under the control and supervision of a parent) by one of the following:

Having court order from Juvenile Court Judge Entering into a valid marriage Reaching 18 years of age Being on active duty in the military Same rights as an adult

Minors Rights
Right to an attorney or parent present while being

questioned by police Do not have to talk to police without a lawyer or parent present Do not have to allow a police officer to search your car or home unless he has probable cause or a search warrant

Overview of Driving Laws


4 or more points in 12 months

Caught with drugs and adjudicated delinquent


Possession of alcohol Found to commit a delinquent or unruly offense Drops out or accumulated 10 or more UNEXCUSED

absences Driving without a license= $500 &48 hours in RYDC Honorable Judge Carden will not give provisional licenses unless it is an emergency situation, which is up to her if it counts as an emergency

Age of Consent and Statutory Rape


Age of Consent-16 years old

Sexual contact: any type of sexual activity, including

but not limited to: touching of the other persons breasts, sexual organs, butt, oral sex or sexual intercourse. Statutory rape is sexual intercourse by having one or more minor under the age of consent. (consent to sexual intercourse is irrelevant because one or more were not at the age of consent)

Felony: 1 to 20 years in prison

Rape
A male forces a female to have sex against her will

Force does not require a weapon or physical injury

Fear and intimidation may be all that is needed

If a female is intoxicated (under the law incapable of

giving consent), Force and Against her will are already proven. Report a rape immediately-do NOT bathe or wash your clothes, go to the hospital or an urgent care facility

Ages 13-16 will be charged as an adult Felony: life without parole or a minimum of 25 years without parole

Aggravated Sodomy
Person forces another person against their will to

engage in Sodomy (oral or anal sex)


Gender nuetral Sodomy with a person under 10 is automatically aggravated 13-16 year olds will be charged as an adult Felony: minimum of 25 years in prison with out parole to life in prison

Sexual Battery & Aggravated Sexual Battery


Person touches the genital area, groin, inner thighs,

butt or female breasts without the other persons consent (even over clothes) Aggravated sexual battery: person inserts anything other than a penis into the vagina or anus of another person without their consent (includes fingers)

Gender nuetral 13-16 years will be charged as an adult Felony: minimum of 25 years with out parole to life in prison

Sexual Assault Against Student by School Officials


Custodian or a supervisor of a student has sexual

conduct with a student for sexual gratification

Felony: minimum 10-30 years in prison without parole

Report immediately to a supervisor, parent or any

other person you trust with the information
