Article 28, New Civil Code. Article 28.

Unfair competition in agricultural, commercial or industrial enterpr ises or in labor through the use of force, intimidation, deceit, machination or any other unjust, oppressive or highhanded method shall give rise to a right of action by the person who thereby suffers damage. What do you mean by this provision? Our country is democratic and it would be a mockery of democracy if the governme nt would allow any person to unjustly deprive other people the opportunity to en gage in business and earn a living. Likewise, this provision prohibits the employment of deception or any other mean s contary to good faith by which persons will pas off the goods manufactured by him. This concept of Unfair Competition is punishable under the Article 189 of the Re vised Penal Code which penalizes fraud or deception in manufacturing goods so as to appear that a product originates from another manufacturer or dealer.
