    On December 11, 2012 this Court requested that Defendants file a report by January 15, 2013 describing the status of the petition for a writ certiorari (Petition) Defendants filed with the United States Supreme Court on July 2, 2012. Dkt. 67. Because it appears that no report has yet been filed, Plaintiffs respectfully submit this report to assist the Court. Defendants Petition was originally distributed for consideration at the Supreme Courts September 24, 2012 conference. The Supreme Court subsequently deferred the Petition for consideration until December 7, 2012, so that the Petition could be reviewed with others raising constitutional challenges to (i) Californias exclusion of same-sex couples from civil marriage or to (ii) Section 3 of the federal Defense of Marriage Act. Hollingsworth v. Perry, No. 12-144 (filed July 30, 2012); Bipartisan Legal Advisory Group of the House of Representatives v. Gill, No. 12-13 (filed June 29, 2012); Office of Personnel Management v. Golinski, No. 12-16, (filed July 3, 2012); Windsor v. United States, No. 12-63 (filed July 16, 2012); Pedersen v. Office of Personnel Management, No. 12-302 (filed Aug. 21, 2012). On December 7, 2012, the Supreme Court granted certiorari in Hollingsworth and Windsor, but took no action on the Petition in this case. Hollingsworth, cert. granted, 81 U.S.L.W. 3324 (U.S. Dec. 7, 2012) (No. 12-144); Windsor, cert. granted, 81 U.S.L.W. 3324 (U.S. Dec. 7, 2012) (No. 12-307). The Petition in this case is therefore still pending before the U.S. Supreme Court and the Supreme Court is not anticipated to take further action on the Petition in this matter until decisions are issued in Hollingsworth and Windsor, which are expected to be issued by the end of the Supreme Courts term in June of 2013. /// /// /// /// /// ///
