THIS IS A SOLICITATION FOR LEGAL COUNSEL SERVICES (EXTERNAL) ON AN AS NEEDED BASIS ONLY DEFINITION To perform a variety of professional duties involved in providing a full range of legal services related to the Deer Springs Fire Protection District (DSFPD) operations; to conduct legal research and prepare ordinances, memoranda, administrative rules and regulations and other legal documents; and to advise District Board of Directors and Fire Chief. EXAMPLES OF IMPORTANT AND ESSENTIAL DUTIES Important and essential duties may include, but are not limited to, the following: Advise DSFPD Board of Directors and Fire Chief on legal matters. Draft, review or revise various legal documents including ordinances, resolutions, contracts, leases, permits, briefs, memoranda and motions. 3. Render legal advice and opinions to the DSFPD Board of Directors and Fire Chief as required; conduct ongoing legal research in connection with legal issues pertaining to the DSFPD. 4. Review, refer and monitor civil claims and potential litigation; act as liaison with defense attorney, county attorney, and California Attorney General's Office. 5. Discuss, draft and revise district policies; review policies for legal content; and respond to questions regarding district policy. 6. Provide advice on personnel matters and represent district during personnel investigations. 7. Appear before courts and administrative proceedings to represent the district's interest as required. 8. Attend and litigate at depositions, administrative hearings and court as necessary. 9. Analyze and review contracts which bind or obligate the district; provide legal opinions and recommendations to ensure the Board of Directors is properly and effectively represented in such matters. 10. 11. Review, respond, and draft correspondence necessary for daily operations. 12. Act as liaison with outside attorneys on legal matters. 13. Attend Board of Directors meetings; stay abreast of new trends and innovations in the fields of fire protection and emergency services. Operational characteristics, services and activities of fire and emergency services programs. Organization, duties, powers, limitations, and authority of the district and Board of Directors. Fundamentals of litigation and alternative dispute resolution procedures including litigation in trial court and appellate court. Evaluate the likely practical consequences of given legal strategies. Apply the skills and concepts involved in factual investigation including determining the need for factual investigation, planning a factual investigation, implementing the investigative strategy, organizing and memorializing information in an accessible form, deciding whether to conclude the process of fact gathering, and evaluating the information that has been gathered. Apply the skills and concepts involved in negotiation including preparing for negotiation, conducting a negotiation session, counseling the department about the terms obtained from the other side in the negotiation, and implementing the department's decision. Recognize and resolve ethical dilemmas including the nature and sources of ethical standards, the means by which ethical standards are enforced, and the processes for recognizing and resolving ethical dilemmas. EXPERIENCE AND TRAINING GUIDELINES: Any combination equivalent to experience and training that would provide the required knowledge, skills, and abilities would be qualifying. A typical way to obtain the knowledge, skills, and abilities would be: Experience: o Five to six years of responsible professional legal experience in municipal law, fire law, employment law, government law, or a combination thereof.
LICENSES, CERTIFICATES OR REGISTRATIONS: Must be current or obtained within a specified time frame as defined upon employment. o o Licensed to practice law in the State of California Membership in the California State Bar
