The Plantif South Caolina Deaet of Healt and Environmetal Contol

("SCDHEC" or the "Depament"), complainng of and aganst Defendat Salvatore Arillo
would respectflly show tis Honorable Court that:
1. Plantif SCDHEC is an agecy of the State of Sout Caolina vested wit all te
powes, fnctions, and dutes ganted to it, its ofcers, ad agets by statute. The Deaent is
charged with impleentaton of the Sout Carolina Polluton Contol Act, S. C. Code P &
48-1-110 et . (2008), te Wate Polluton Contol Peits, 24 S.C. Code P a Regs.
61.9.122.26 (2011) and NPDES Geneal Permit for Stor Wate Discharges.
2. Tis is a civil acton pursuat to S.C. Code P 48-1-110 of te South Caolina
Pollution Contol Act for the enforceent of a Consent Order.
3. Defendant Salvatore Arzillo is an individual responsible for lad-disturbing
acvities locate at Tax Map. No. 029-43-04-003 in Jasper County, South Caolina; theefore,
ts Cou has jusdicion over tis action ad veue is proper in tis Cou.

4. On Ocobe 29, 2009, the Deartent issued NPDES Pet SCR10L286 to
Defedant Azillo, authorizing stor water dischages fom the Site to wates of te State in
accordace wit the efuent limitations, monitoring requremets and oter conditions as set
fort in the peit.
5. The Dearent conducted inspections of te Site on March 3 and March 31,
2010, noting numeous violatons of Defedant's perit on bot occasions. (See Attachment
A).
6. Following numerous attempts to bring the Site into compliace ad resolve te
violatons, te Deaent and Defedat Arzillo eteed into Consent Order 12-03 7-W on
Octobe 4, 2012.
7. Defendat Azillo kowingly ad voluntarily ageed to perfor the following
activities in Consent Orde 12-037-W:
a. Within thirty (30) days fom the execution date of this Orde,
respond to staf commets i the Depaent letter dated May 19,
2010. Provide inforaton as necessary to complete te peit
application ad obtan pet coveage for the aea desigated in
te NOI submitted on AprilS, 2010;
b. Witin tirty (30) days fom te execution date of tis Orde,
peanently stabilize all aeas of te Site, outside of ay curently
peitte aea, excluding ay delineate wetlands.
c. Within sixty (60) days of te issuance of the NPDES Peit,
submit to te Dearent a report, compleed ad staped by te
S.C. Regstere Professional Engneer that develope te SWPPP,
certifing tat all stor wate and seiment contol devices ae
installed ad fnctioning propery as specife i te Site's
approved SWPPP.
d. Witn trty (30) days fom the executon date of tis Orde,
submit a Notice of Intent to the Deartent, for the puose of
obtaining coveage for the Site unde the NPDES Geneal Peit

for Stor Wate Discharges Associated with Industal Activities
SCROOOOOO.
e. Pay to te Dearet a civil penalty in the amount of four
thousad dollas ($4,000.00) in accordace wit te following
schedule. Te penalty shall be paid in eleven (11) equal paymets
of tree hundred t-tree dollas ad thirty-three cents
($333.33) begn ing on Octobe 15, 2012 (subseuet payets
being due on te ffeet (15

payet of tree hundred t-tree dollars ad thirty-seven
cents ($333.37) being due on Septembe 15, 2013.
8. Defendat Arzillo siged a Promissory Note ageeing to te payet scheule as
set forth above (Attachment B). Defendant has submitted te inital paymet of tee hundre
t-tree dollars and ty-tree cets ($333.33), but has not submitted te reaining
paymets according to the schedule detale in te Promissor Note.
9. Defedant Aillo kowingy, voluntaily and without coecion ageed to te
reureents of Consent Order 12-037-W, as well as to te payet scheule outined in te
Promissory Note.

WHEREFORE, having flly set fort its Complaint, the Dearent prays for a order
requiring Defendat Aillo to immediately comply with Consent Orde 12-037-W; and gating
such other and fhe relief d tis Court may de appropriate.
