When Homophobia becomes a Violation of Human Rights

At a time when Africa is supposed to be moving forward, anti-gay laws have


halted its progress. News that made headlines about a week ago was the
Ugandan government had made homosexuality illegal and its punishment as
cruel as life imprisonment. This is the harshest punishment yet. While, other
African countries have also banned homosexuality, the latest ruling was the
biggest highlight of how due to these laws; human rights of homosexuals in those
countries were being violated.

Being homosexual is a choice
That is what the Ugandan president said when he passed the ruling. I completely
disagree with that. I think that sexuality is a very complex thing that cannot be
determined simply by ones desire or will. I honestly dont think that one wakes
up one morning and decides to be gay, bisexual or lesbian. The general norm
that a man can only be with a woman and visa versa is fueling this hatred and
prejudice.

South Africa tried to lead by example
South Africa is one of only approximately 16 African nations to make
homosexuality legal and South Africa is the only country to make same-sex
marriage legal. This move made me proud to be South African because it showed
that we were moving with the rest of the world and not letting our lacking of
understanding hinder our progress. The move should have seen the rest of the
countries follow suit, but instead seemed as though many African countries
moved in the opposite direction and banned homosexuality.

Innocent until Proven Guilty
See, what I find interesting is how are they going to prove that you are gay? Is
there a cut and dry formula that they have that will prove that the accused are
guilty? I find it ridiculous that these governments are probably using money that
can be used for development or education, to remove homosexuality. I dont
think anyone will consider coming out with the risk of life imprisonment hanging
over his or her heads. These governments are dictating whom these people can
love and who they can be. In Nigeria, the punishment for homosexually is more
than that of rape. That is basically saying that being homosexual is worse than
raping a woman or a child. In two African countries homosexuality is actually
punished by death. Translation: being a murderer is better than being gay.


I honestly find this embarrassing for our continent. Yes, I understand why most
people do not and will not accept homosexuality but the moment we let our own
personal views and opinions have the power to murder a person then we cross
the line into cruelty and dictatorship. I have friends who are homosexual, and
their sexuality has no barring on the person they are. The effects that these laws
have are no different than oppressing one based on the colour of their skin.
Society always encourages to be ourselves, but then who do you be when who
you are can get you murdered or in jail? Who are we play God in judging these
people?
