Booking Agreement

BOOKING AGREEMENT
This agreement is entered between Ms. Cathy Co with address at

________________________, hereinafter referred to as the CLIENT(s) and the FIRST
PARTY; and MISMO with office address at UNIT MO5 CitiHomes, San Francisco St.
Bgy. Plainview Mandaluyong City herein represented by Kearny Baldeviso, referred to
as the SECOND PARTY; Wherein the AGENT agrees to provide the CLIENT with the
musical service of the band MISMO to perform for a non-ticket selling event at the
Forest Hills Golf and Country Club on June 13, 2014 with the following terms and
conditions.
1. OBLIGATIONS OF CLIENT
1.1. Pay the talent fee of SEVENTY THOUSAND PESOS (Php70,000.00 ) inclusive of
VAT, NET of all withholding tax and commissions. The said amount will be payable in
the following manner:
50% down payment or THIRTY-FIVE THOUSAND PESOS (Php35,000.00) in
cash upon signing of contract.
50% balance or THIRTY-FIVE THOUSAND PESOS (Php35,000.00) due on the
Day of the show prior to the performance of the band in the form of cash.
1.3. Provide duty meals and non alcoholic beverages for artists and production staff
(11 pax) for the sound check, performance and after performance;
1.4. Provide rest and dress areas with washing facilities and proper ventilation at the
venue of the performance for the exclusive use of the band.
1.5. Provide reserved and paid parking at the venue on the evening of the performance
for a total of ELEVEN (11) cars. To be distributed to the following:
-For the sound system: (maximum of two (2) vehicles)
-For the band: (maximum of NINE (9) vehicles)
2.0 OBLIGATIONS OF AGENT

2.1 Provide musical services of the band MISMO
a.. To perform either ____ set with minimum duration of ______ or _____ sets with
minimum duration of _____ minutes per set. Show time starts at 5:30pm.
b. To be appropriately attired for the event.
2.2. Provide complete and professional sound system (with mobile sound system and
DJs), band set-up and stage lighting. Provide sufficient power supply for the use of the
lights and sound system in the form of a generator with at least 150 KVA. In the event
this requirement is not accomplished and the SECOND PARTY is unable to perform
due to insufficient or no power supply, the FIRST PARTY forfeits the entire package
price in favor of the SECOND PARTY;
3.0 GENERAL PROVISONS

3.1 Rescheduling a performance In case a performance is rescheduled due to
fortuitous event or any other reasonable cause beyond the control of the parties, the
parties shall mutually agree on the new schedule provided it does not exceed 30 days
from the original date.
3.2 In the event the ARTIST has to cancel the performance for reasons other than those
stated in the above paragraph, and without fault on the part of the CLIENT, ARTIST
agrees to return the deposit of 50% of the contract price. In addition, the ARTIST can
assist securing a suitable replacement that will be subject to the approval of the LIENT.
3.3 In the event the CLIENT has to cancel the performance for reasons other than
stated in 3.1, and without fault on the part of the ARTIST, CLIENT forfeits deposit made
plus the additional balance of the agreed contract price as damages.
3.4 If the performance shall take place in an open air venue, the CLIENT is responsible
in making the necessary provisions for alternative arrangements in the event of rain.
Otherwise, the artist should be entitled to full compensation even if they are unable to
proceed with their performance;
3.5 Non-waiver The failure of either party to insist upon strict performance of any
terms
and conditions hereof shall not be deemed as waiver of any rights or remedy that either
party may have. In case minor violations of the provisions of this contract by either party
of this contract by either party, earnest efforts shall be made to settle the dispute
amicably. If after due notice to the party at fault, he fails to remedy a substantial breach
committed, then the aggrieved party may enforce its rights under the
contract.
3.6 Amendments Both parties agree that no changes and/or amendments to this
agreement shall take effect unless such amendments are in writing and signed by
herein signatories.
