DECLARATIION OF HEIRSHIP WITH

SPECIAL POWER OF ATTORNEY


KNOW ALL MEN BY THESE PRESENTS:
We, MONICA G. GAUDIEL, widow, MYRNA G. CLAVEL, married,
MARILYN GARRIDO, single, FRANCISO GARRIDO, married, RAYMUND
GARRIDO, married, CATHERINE ARAGON, married, all of legal ages,
Filipinos and residents of barangay Payao, Binalbagan, negros
Occidental, Philippines, FELICIDAD ESCANER, of legal age, Filipino and
a resident of baranya Progreso, Binalbagan, negros Occidental,
Philippines and ROLAND GARRIDO, of legal age, married, Filipino and a
resident of Kiamba, Sarangani Province, Philippines, by these presents,
do hereby DELCARE:
WITNESSETH
That, whereas, a parcel of land (Lot 521) and covered by Original
Certificate of Title No. 14690 located at the Municipality of Binalbagan,
negros Occidental, is registered under the name of Vicente Garido;
That, whereas, said Vicente Garido sold and conveyed the abovementioned parcel of land (Lot 521) to Rufino Garrido in the amount of
Once Thousand Three Hundred Pesos (Php 1,300.00);
That, whereas, Rufino Garrido is now deceased having died intestate
and at the time of hideath he was survived by his children namely,
Monica G. gaudiel, Miguel Garrido, Jose Garrido, Teresita garrido and
Rolando garrido;
I, ________________, widowed, of legal age, Filipino, with residence at
__________________ do hereby declare as follows:
1. That the above-named parties is the legitimate wife and the sole
and compulsory heir of the deceased _______________, who died
on ___________________ at _____________________ located at
________________________;
2. That the decedent died intestate, without leaving any Last Will or
Testament and without leaving any debts or accounts
whatsoever;
3. That the decedent left the following properties 77.35 m2 of the
parcel of land covered by Transfer Certificate of Title No.
__________ (a copy of which title is attached hereto as Annex A),
with technical description as follows:
Lot 19-A of the subd. plan Psd-00-054412, being a portion
of Lot 19, Blk. 125, Psd-1650, LRC Rec. No. 3563, situated
in Brgy. San Antonio (before SFDM), Quezon City, M-Mla.
(before Rizal), Is. of Luzon. Bounded on the NE, along lines
1-2-3 by Road 175 (De Jesus Street); on the SE, along line
3-4 by Lot 20, Blk. 125, both of Psd-1650; on the SW, along
lines 4-5-6 by Lot 19-B of the subd. plan; and on the NW,
along line 6-1 by Lot 18, Blk. 125, Psd-1650. (NOTE: On

the Northwestern portion, a strip of 2.56 m. wide Perpetual


Right of Way is provided). Beginning at a point marked 1
on the plan, being N. 10 deg. 22W., 936.69 m. from BLLM
1, San Francisco Del Monte, SFDM, thence S. 81 deg. 36E.,
2.56 m. to pt. 2; thence S. 81 deg. 36E., 9.70 m. to pt. 3;
thence S. 8 deg. 21W., 14.10 m. to pt. 4; thence N. 81 deg.
07W., 8.86 m. to pt. 5; thence N. 81 deg. 07W., 2.56 m. to
pt. 6; thence N. 8 deg. 43E., 13.99 m. to the point of
beginning; containing an area of ONE HUNDRED SEVENTY
THREE (173) SQ. METERS, more or less;
4. That pursuant to Section 1, Rule 74 of the Revised Rules of Court
of the Philippines, and the parties herein being all of age and full
civil capacity, we have agreed to divide, as we do hereby divide
and adjudicate, the properties above-described, as follows:
a.) The 12,960 shares of stock at A. Soriano Corporation, to be
transferred to and re-issued in the name of Joaquin P.
Pamintuan, for purposes of sale or disposition in our behalf,
the proceeds of such sale or disposition to be equally divided
among all of us siblings;
5. That we hereby affirm that we have executed this instrument out
of our own free will, without force, intimidation or violence upon
our person, and that we have hereby received our just and
proper share and have no more claim or demand against each
other in connection with the adjudication of the above-described
parcel of land.
6. That FURTHER, and for and in consideration of the sum of ONE
MILLION SIX HUNDRED THOUSAND PESOS (P1,600,000.00),
Philippine Currency, receipt of which is herby acknowledged by
us to our full and complete satisfaction, I do hereby SELL,
CONVEY, and TRANSFER by way of ABSOLUTE SALE unto
_____________, (his/her) heirs, assigns and successors-in-interests,
all our rights, interests and participation over the abovedescribed parcel of land;
