REGULATION ORDINANCE NO. 2005-111


AN ORDINANCE CREATING THE OVERSEAS FILIPINO
WORKERS ECONOMIC COUNCIL OF ILOILO CITY

WHEREAS, Section 18, Article II of the Philippine Constitution declares it as the


policy of the State "to protect the rights ofworkers and promote their welfare".

WHEREAS, the Overseas Filipino Workers (OFWs) are considered as today's


modem time heroes because of their economic contribution to the Philippinescomprising
30% of the National Gross Revenue of the government.

WHEREAS, there are now 10,000 Overseas Filipino Workers (OFWs) from Iloilo
'City that is part of over 8 million Overseas Filipino Workers outside of the Philippines.

WHEREAS, a National Fiscal Crisis encourages the desire to seek employment


outside of the Philippines and increases the vulnerability to exploitation ranging from
illegal recruitment, poor working conditions, non-payment of salaries, rape, maltreatment
or even death.

WHEREAS, the Government is duty bound to insure that our toiling expatriates
and their remaining families have adequate protection, personally and economically,
while away from home. -

WHEREAS, the concerns and problems of Overseas Filipino Workers (OFWs) of


Iloilo City may well be addressed and resolved with the active participation and
coordination by local government units such as the City of Iloilo through the formulation
of plans and programs on how the city could be of assistance to the Overseas Filipino
Workers (OFWs).

WHEREAS, Overseas Filipino Workers have regular monthly remittances to their


families in the City of Iloilo.

WHEREAS, these Overseas Filipino Workers of lloilo City (OFWsIC) and their
families have available funds to enter into entrepreneurship activities.

WHEREAS, the City Government of Iloilo recognizes the economic potential of


Overseas Filipino Workers to enter into business and finds it necessary to create a
Council that shall encourage and protect the economic activities of the Overseas Filipino
Workers oflloilo City (OFWsIC) and their families.

NOW, TH EREFORE, be it ordained by the Sangguniang Panlungsod of the City


of Iloilo, in session duly assembled, that:

Section I. - There is hereby created the Overseas Filipino Workers Economic


Council of Iloilo City to serve as Overseas Filipino Workers' relations and assistance
office of Iloilo City.

Section 2. - As used in this ordinance, the following terms shall mean as follows:

Council - refers to the Overseas Filipino Workers Economic Council of Iloilo


City.

OFWsIC-Overseas Filipino Workers oflloilo City

Oveneas or migrant Filipino Worker - refers to any person, eighteen years of


age, who is to be engaged or is engaged or has been engaged in a remunerated activity in
a state of which the worker is not a legal resident

Oveneas Employment refers to employment of a Filipino worker outside of


the Philippines covered by a valid contract.

Section 3. Composition. - The functions and responsibilities shall be exercised,


discharged and administered by the Council composed of a Chairman, the City Mayor of
Iloilo City, Vice Chairman shall be the Chairman, Committee on Labor, Employment,
Manpower Development and Placement and the Members shall be composed of the
following:

Section 4. - Objectives/Purposes. - The Council shall have the following


objectives and purposes:

(a) To protect the interest and promote the welfare of the OFWs oflloilo City and
their families;
(b) To identify OFWs and their families in every barangay in the City oflloilo;
(c) To provide skills training and entrepreneurship to increase employee
capabilities;
(d) Reintegration ofretuming OFWs for economic empowerment and
entrepreneurship;
(e) To identify viable business opportunities for OFWs oflloilo City to invest and
engage in business;
(f) Link OFWs oflloilo City and their families to business schools for investment
opportunities.

Section 5. -Functions and Responsibilities. -To carry out its objectives and
purposes, the council shall have the following functions and responsibilities:

(a) Initiate legislative measures to realize the objective of the council;


(b) Facilitate programs and technical support system in the field of
entrepreneurship, livelihood and financial management for a safe and sound
economic management of funds of the OFWsIC and their families;
(c) Regularly coordinate with participating government agencies on OFWs
economic related matters;
(d) To provide employment opportunities such as conduct of job fairs and host of
accredited agencies for recruitment to increase chances of employment;
(e) Designate/assign personnel who shall act as secretariat, take charge of
receivirig complaints and related matters, the action taken and submit
monthly/quarterly/annual periodic reports, or any other reports needed at the
time relative to the program, to the Council through the Chairman and Vicfr../-._

(f) Facilitate the federation of the OFW Associations and their families in Iloilo
City
(g) Be in charge of the celebration of an OFWsIC week if any;
(h) Disseminate list of licensed recruiting agencies to all barangays in the City of
Iloilo;
(i) Exercise such other function as the need arises.

Section 6. - The Chairman shall undertake the adoption and implementation of all
measures and policies that may be prescribe by law or ordinance and shall undertake the
forging of Memorandum of Agreements among the composition of the Council and
specifying the purpose for which they are joining the Council and assigning the
respective rules and responsibilities.

Section 7. - Regular Meetings. - The Council shall meet regularly every 1st
Thursday of each quarter at 2:30 p.m. at the Mayor's Office, Iloilo City Hall. It may call
a special meeting as deem necessary.

Section 8. If any provision of this ordinance be declared as unconstitutional or


inconsistent with a national law, the remaining parts shall remain valid.

Section 9. Any ordinance or local executive order inconsistent with this ordinance
are repealed or modified accordingly.

Section 10. Copies of this ordinance shall be furnished to the POEA, OWWA,
DFA, the City Mayor's Office, the City Treasurer's Office, the City Budget Office and be
published in locally circulated newspapers.

Section 11. EtTectivity. - This ordinance shall take effect immediately upon
approval.

(f). It shall secure insurance company to cover passenger liability and third party
liability.

Section 4. - Any violation of the any of the requirements stated in the preceding
paragraph shall subject to the following sanctions:

(a). First offense- The tricycle unit shall be impounded.

(b). Second offense - The tricycle unit shall be impounded with a penalty or a fine
of P500.00 payable by the owner/operator of such tricycle unit;

(c). Third offense - Revocation and cancellation of the franchise granted to


owner/operator of such tricycle unit.

Section 5. - No owner/operator of the tricycle granted franchise under this


ordinance shall operate in national highways or outside of the route authorized under
&ection 1 hereof. The owner/operator and driver of any tricycle unit who shall operate in
national highways or outside of the authorized route shall be liable to pay a fine of
P500.00;

Section 6. - The franchise herein granted to owners/operators of tricycle is non-


transferable without the express prior approval by the Sangguniang Panlungsod.

Section 7. - The grantee may request the Sangguniang Panlungsod to substitute


the tricycle unit herein with another provided, that such substitute shall operate within the
same period as granted to the original unit without prejudice to an application for
extension.

Section 8. - This ordinance shall take effect ten (10) days after its approval and
publication in a newspaper of general circulation in the City oflloilo.
