    I, Avunoori Satyanarayana S/o. Rajesham, aged 64 years, Occ: Business &


    Agriculture R/o. H.No. 3-3-109, Shankargunj of Peddapally village and Mandal, do
    hereby state on oath as follows:

    1. I am the Petitioner herein, Plaintiff in the main suit and acquainted with
    the facts of the suit.

    2. I filed the main suit against the Respondent on the basis of mortgage of the
    suit schedule property. This Honble Court passed preliminary decree in the main suit on
    22-12-2006 and grant 3 months time to pay the decretal amount, costs and other
    expenses.

    3. That the time granted by this Honble Court expired on 23-3-2007. But
    the respondent did not care to deposit the decretal amount before this Honble Court.
    Hence in the interest of justice and necessary to get the suit schedule property sold. It is
    therefore prayed that this Honble Court may be pleased to pass a final decree directing
    the sale of suit schedule property or otherwise I will suffer great loss.

    For the reasons mentioned in the affidavit, the Petitioner prayed that this
    Honble Court may kindly allow the petition and to pass a final decree in O.S.No. 102/06
    in terms of preliminary decree directing that the suit schedule mortgaged property be sold
    in acquisition and to pass such other order that this Honble Court deems fit and proper in
    the circumstances of petition, for which act of justice the Petitioner shall ever pray.
