    AFFIDAVIT OF WITNESS

    I, DANILLO M. BARTOLOME, of legal age, single, residing in Estrada


    Street, Tetuan, Zamboanga City After having been duly sworn to in accordance
    with law do hereby deposed and say;

    1. That on or about 10:00 pm on the 4th of August, 2017 while me and


    my cousins namely, Carlos M. Despacito and the victim Alvin Jhon
    Malate, doing our routine every Friday night to get together and eat
    ballot at Ante Marlyns balotan, an unusual and heart-breaking
    incident happened.
    2. While eating and enjoying each others company like the usual, we
    noticed that ITONG, a Kagawad of in our barangay, keeps on
    roaming around the street with his motorcycle but we did not mind it
    because we are thinking that maybe he was just checking our place
    and securing our safety and just doing his job. Although, we noticed
    that he seems to be drunk because we can smell him every time he
    passed by behind us. (kinda questionable to. Not accurate given the
    distance ng road sa sidewalk and the speed when riding a motorcycle
    hehe)
    3. Suddenly, I heard a gunshot twice and my cousin Alvin Jhon who was
    seated beside me suddenly collapsed on the ground with blood from
    his back and from his head near his ears. (not needed given the
    circumstance. Madilim and mabilis ang pangyayari)
    4. Consequently, a commotion happened and the people nearby started
    running away but I tried to help my cousin Alvin by carrying him to
    save him;
    5. Before I could reach Alvin, ITONG approached and threatened me by
    pointing his gun toward my direction;
    6. Out of fear, I ran but hid in a nearby bakery across the road and saw
    what Itong did to my cousin;
    7. From where I hid, I saw Itong pointing his gun at the people around
    him, shouting curses and warnings for them not to get anywhere near
    him and my cousin;
    8. While doing this, I saw him produce a gallon of water carrier which
    was tucked on his motorcycle and poured its contents over Alvin;
    9. I heard him shout (para di questionable hahaha) LINTIK LANG
    WALANG GANTI SA TATAY MONG MAYABANG!
    TANGINA NIYO! BARBEQUE KA NGAYON!

    10.He then took a lighter from him pocket and threw it to the body of my
    cousin;
    11.A fire ensued immediately and consumed the body of my cousin;
    12.Itong remained standing near the burning body of my cousin, all the
    while pointing his gun at the people around in his attempt to stop any
    of us from approaching them;
    13.Scared to be shot by Itong, I remained frozen on my spot while I
    watched helplessly as the fire consumed by cousins body;
    14.Itong stayed there for a good amount of minutes before the police
    officers arrived at the scene;
    15.I saw how Itong tried to ran away and went to his motorcycle but the
    police officers were able to apprehend him before he could escape;
    16.That we are executing this affidavit to attest to the truth of the above
    facts, as well as for any legal purpose this may serve.

    I, CARLOS M. DESPACITO, 15 years old, residing in Estrada Street,


    Tetuan, Zamboanga City After having been duly sworn to in accordance with law
    do hereby deposed and say;

    That on or about 10:00 pm on the 4th of August, 2017 while me and my


    cousins namely, Danillo M. Bartolome and the victim Alvin Jhon Malate, while
    having our get together and eating ballot session every Friday night at Ante
    Marlyns ballotan, a tragedy happened. While eating and having conversation with
    each other, we noticed that the Brgy. Kagawad of Tetuan keep on roaming around
    the street with his motorcycle but we did not mind it, because we are thinking that
    maybe he was just just doing his job by patrolling. Even if, we noticed that he
    seems to be drunk because we can smell him every time he passed by behind us.

    Unexpectedly, I heard a gun shot twice and I saw my cousin Alvin Jhon who
    was seated beside Danillo fell on the ground with blood from his back and head.
    Consequently, commotion happened and people started running. Out of fear, I also
    immediately run as fast as I could. While running, I heard someone who was
    shouting and threatening that if someone will help the victim will also be shot. I
    tried to check if who is it and I recognized that it is our Brgy. Kagawad who is
    roaming around earlier. I wanted to help my cousin but I am really scared that I
    will also be killed. Hence, I immediately proceeded to the nearest police station
    situated near ICAS Elementary School and asked for help. The police officers
    accompanied me going back to my cousin. When we arrived, I saw my cousin
    Alvin Jhon laying on the ground and burning.
    IN WITNESS WHEREOF I hereby set our hand this 11th day of August,
    2017 at Zamboanga City, Philippines.

    I, GASTIO R. VEGAS, 25 years old, single, , residing in Natividad Street,


    Tetuan, Zamboanga City, After having been duly sworn to in accordance with law
    do hereby deposed and say;
    That on or about 9:00 pm on the 4th of August, 2017, while on duty as a
    gasoline boy in C-Oil, Tetuan, Zamboanga City. Our Brgy. Kagawad went to our
    gasoline station and bought a gasoline and asked that it will just be put in the bottle
    of San Miguel Beer Grande. He seems to be drunk because he smelled alcohol.
    Thus, I jokingly said to him Kagawad, nuay ya tu sen compra beer, gas ya lang
    pwede? He responded, Chene io kere man sunog, Noy kay manada ya abusado
    aqui di aton brgy. At first, I took it as a joke also. But, while walking on my way
    home around 10:00 pm, I heard gunshot twice. I was in front of Perfect Pure Water
    Refilling Station in Estrada Street, I saw people running towards my direction and
    shouting may namamaril doon sa unahan, si Kagawad chene kere dispatya, si
    Kagawad may binabaril at nagbabanta pang bumaril kung may tutulong sa
    biktima and other similar words. Out of fear, I also run and took different
    direction going home. Afterwards, I heard that a certain Brgy. Kagawad killed and
    burned a minor. And, it was that time that I remembered that a few hours ago, a
    Brgy. Kagawad also bought gas from C-Oil.

    IN WITNESS WHEREOF I hereby set our hand this 11th day of August,
    2017 at Zamboanga City, Philippines.
