Name of Work – Engagement of external agency for Carrying, Forwarding and Selling of Packaged
Drinking Water named “Pran Dhara” manufactured by Government of West Bengal at DARIAPUR
Water Treatment Plant Complex under PHE Dte. in the district of Malda through their capacity
and capabilities.
Sealed bids are hereby invited by the Executive Engineer, Malda Mechanical Division, PHE Dte. on
behalf of the Governor of West Bengal, from bonafied bidders for Auction sale of Packaged Drinking
Water named “Pran Dhara” manufactured by Government of West Bengal through their capacity
and capabilities from Packaged Drinking Water Bottling Plant located at Dariapur Water Treatment
Plant Complex under PHE Dte. in the district of Malda.
All concerned are requested to access the website http://eauction.gov. in for this auction.
1. The intending bidders should possess valid PAN, GSTIN No. Registration certificate/Provisional
Registration Certificate, acknowledgement receipt of payment of P.TAX, Current Trade Licenses and
permits etc. (2016-17 or 2017-18) with up to date payment certificate valid till date of submission of
bid and upload online self- attested scanned copies of all the documents as indicated in the web site,
otherwise no approval will be given. The original documents with a photocopy of each will have to
be submitted to the office of the Executive Engineer, Malda Mechanical Division, P.H.E Dte. from
14.12.2017 to 30.12.2017 within the working hours before the ‘APPROVAL START DATE’, otherwise
the online bids will not be accepted by this office.
2. ‘STARTING PRICE’ as indicated in the e-auction notification published, will be considered as the
‘RESERVE PRICE’ for each item derived by the department.
3. For uploading the e-bid, please contact with the National Informatics Centre (NIC), Kolkata.
4. Earnest Money: Rupees 3,61,440.00 (THREE LAKH SIXTY ONE THOUSAND FOUR HUNDRED FORTY
only) for total work, in the form of Bank Draft from any nationalized bank, drawn in favour of the
"Executive Engineer, Malda Mechanical Division, P.H.E Dte.”, against the work, scanned copy of
which has to be uploaded online at the time of ‘DOCUMENT SUBMISSION/ PAYMENT START DATE’.
After opening of the bids, earnest money of all intending bidders will be refunded within 07 working
days after the opening date, except the highest bidder (H1) and the second highest bidder (H2).
After acceptance of work order by H1, earnest money of H2 will also be refunded. This clause is
applicable for all categories of applicants, except those who are exempted as per Government Order
no. 1110-F, dated 10/02/2006 of Special Secretary Finance Department, Govt. of West Bengal.
Scanned copies of the Bank Draft will have to be uploaded on line at the time of bidding. No bid will

be accepted without the earnest money. The original bank drafts will have to be submitted at the
office of the Executive Engineer, Malda Mechanical Division, PHE Dte. from 14.12.2017 to
30.12.2017 within the working hours before the ‘APPROVAL START DATE’, otherwise the online bids
will not be accepted by this office.
5. Additional Rs.-16,38,560.00 ( Sixteen lakh Thirty Eight Thousand Five Hundred Sixty) only amount
will have to be deposited by the agency/firm as security deposit before physical collection of goods
and within 7 (seven) days of the issue of letter of acceptance, failing which earnest money shall
stand forfeited to the Government.
6. The Maximum Retail Price (MRP) of one litre bottle would be Rs.18/- (Rupees Eighteen) per bottle
and Rs.10/- (Rupees Ten) per bottle for 500 ml] bottles. For supply to Railways only, the MRP of 1
litre bottle would be Rs. 15/- (Rupees Fifteen) per bottle. The Reserve Price of shrink wrapped
cartoon of one litre bottle would be Rs. 96 (Ninety Six rupees only) and Rs 156 (One hundred fifty six
rupees only) for 500 ml bottles.
7. The intending bidders must provide every detail as desired above including his name, address and
Mobile no. and office land line no. if available, clearly in the space provided for the same - on line.
Incomplete information may lead to rejection.
8. Auction materials to be collected from mentioned site at the purchaser’s own arrangement (viz.
vehicles and manpower for loading). No expenses in any form towards disposal will be borne by the
office.
9. The purchaser should withdraw minimum 3500 shrink wrapped cartoon of capacity 500 ml and
10000 shrink wrapped cartoon of capacity 1000 ml per month from the plant with Loading unloading
as required, transportation from plant to their final destinations/sub point, Selection of
dealers/distributors / stockiest/sub agent/as may be required for selling purpose, monthly reporting
to the department for the status of product selling. Suggestive proposal for improvement of sell of
the product get up or any others, if any for further customer satisfaction etc., All other related and
allied activities as required time to time for effective selling of the product. The agency has to
engage minimum one supervisor and two labours for loading of shrink wrapped cartoon in container
in individual plant. The agency shall engage extra labours as per demand and season of operation
where loading of not more than six no of cartoons vertically in a row is permitted.
10. Road challan for disposal will be provided by the concern Sub-Assistant Engineer, and Assistant
Engineer. However all other permits/permissions required for transportation and disposal will have
to be arranged by the purchaser. Disposal of the materials have to be arrange as per relevant traffic
rules of the area. All such type of incidental cost have to be considered by the bidders while the
quoting their bid/offer.
11. The successful bidder at his own cost has to adopt all safety/prevention/precautionary measures
following relevant rules of the Government for safe disposal of all items. Permission from
appropriate authority if needed for such process has to be procured from the end of the bidder at
his own cost failing which the earnest money of the bidder will be forfeited.
12. In general the highest bid will be accepted. However, the bid inviting authority shall not be
bound to accept the highest bid and can go for subsequent calls if the highest bid in the opinion of
the undersigned does not appear to be satisfactory, the undersigned reserves the right for holding
fresh bids and so on. The bid inviting authority at his sole discretion can accept the highest rate and
issue lifting order to the successful bidders whose rates stand highest for total materials.

13. Shrink wrapped packaged drinking water is available at the stacking shed of Dariapur water
treatment plant site which will be allowed to be lifted during 12.00 Hrs to 17.00 Hrs on official
working day with the permission of the Assistant Engineer -I, Malda Mechanical Division, P.H.E Dte.
14. Bids placed by the agency (H1) will be accepted as per terms and conditions laid down vide Govt.
of West Bengal, Finance department order no. 4068-F(Y) Dt. 25-05-15.
15. If the machinery is required for loading of cartoon in the truck, all precautionary measures will
be taken by the auctioneer so that no damage to any government property or personnel takes
places. Under no circumstances, withdrawal of products can cause a fire hazard will be permitted.
Any damage or loss of Government/public/private property or life during the disposal process will be
the sole responsibility of the successful bidder and the successful bidder has to replenish the cost of
such damage at his own cost as per estimate prepared by this office, failing which the earnest
money of the bidder will be forfeited.
16. The dates and times published on line are final and no request for any change will be entertained
under any circumstances. Moreover, no objection in any form shall be entertained after completion
of on line scrutiny of documents.
17. After the final acceptance of the bids, successful bidder shall have to execute an agreement
provided by the office of the Executive Engineer, Malda Mechanical Division, P.H.E Dte. under Terms
& Conditions as specified in the Notice after the ‘AUCTION END DATE’.
18. The order would be treated as valid for 90 (Ninety) days from the date of opening of the on line
bid and the lifting order (hard copy) may be issued on any day after deposition of additional security
amount. The successful bidder has to complete the work in all respects within next 365 (Three
hundred sixty five) days from the date of issuance of such lifting order.
19. All auctioned materials have to be lifted from the site for a period of 365 (Three hundred sixty
five) days from the date of issuance of lifting orders, failing which the earnest money will be
forfeited without issuing any further notice.
20. A work completion certificate indicating, “The works have been completed in all respects and
the area has been cleared properly and no damage to any Government property has occurred
during such process” must be obtained from the concern Sub-Assistant Engineer, and the Assistant
Engineer –I, Malda Mechanical Division and produced before the Executive Engineer, Malda
Mechanical Division, PHE, for release of the earnest money by the successful bidder and which will
be refunded without any interest irrespective of time required for completion of work.
21. Permission will be given to any applicant to participate in one auction only. Any individual
possessing more than one firm/agency by the same proprietorship can participate in one auction
only.
22. It shall be deemed that all bidders have thoroughly read and under stood the terms and
conditions of sale before bidding. It will also be deemed that all the bidders have inspected the
properties prior to auction and have satisfied themselves with the full particulars of the same. No
objection or claim of any nature whatever shall be entertained at the conclusion of the auction. The
on line bids to be submitted accordingly.
23. From the date of issuance of the lifting order by the Executive Engineer for removing the
property sold to the purchaser to the last day of removal of the property by the purchaser, the
property at the site will remain at the sole responsibility and entire risk of the purchaser. If required

the bidder will position security guards to address any untoward incident. No complaints regarding
pilferage or loss of any sort will be accepted by the undersigned.
24. The purchaser shall assume all liability for, and keep the Executive Engineer saved, harmless and
indemnified against all actions or suits, claims, costs, damages, charges and expenses arising out of
or in connection with the fulfilment of the terms and conditions of the sale, whether such actions,
suits, or claims are brought by members of the public or workmen employed, provided, however,
that he will not have to indemnify the Executive Engineer for any action that may be brought by a
claimant and who may question the legal right of Govt. to dispose of the property.
25. If the materials are not removed entirely from the site within the stipulated time, the material
will become the property of the Government and the entire bid money deposited by the purchaser
including the earnest money shall be forfeited to the Government.
26. Failure on the part of any bidder to observe and abide by any or all the above noted terms &
conditions will disqualify himself to become eligible bidder and his earnest money or part thereof as
necessary may stand forfeited to the Government.
27. The auction inviting authority reserves the right to accept or reject any or all of the bids without
assigning any reason thereof.
28. All legal issues if any arising out of the above auction will be limited to Malda Jurisdiction only.

V. Memorandum of Articles, duly authenticated by R.O.C. for Company and the Deed of Partnership
along with Registration Certificate of the Farm for partnership farms.
VI. Power of Attorney (For Partnership Firm/ Private Limited Company, if any)
VII. Tax Audit Report in 3 CD Form along with Balance Sheet & Profit & Loss A/c for the last Three
years (year just preceding the current Financial Year will be considered as year – I) or Declaration in
non-judicial Stamp paper of appropriate value, duly notarized and 3 Years Balance Sheet and Profit &
Loss A/c duly signed by competent Chartered Accountant, as mentioned for last three financial year.
VIII. Details of the experience and past performance of the applicant for at least one no any sort of
work or services related to works in Water/ beverage Industry in Government department/
Autonomous body/ Government undertaking or having experience in supply & delivery of drinking
water/ beverage related equipment within in last five years in Government department/
Autonomous body/ Government undertaking etc. having a magnitude as mentioned above, during
the last 5(five) years prior to the date of issue of this NIA of value not less than 60 lack in single
contract / value not less than 50.00 lack in 2(two) nos. of contract / 70% or more completed running
work same value single contract within last 5 years for the work listed
IX. Declaration as per format given in this notice Affidavit’, duly notarized in non-judicial stamp
paper of appropriate value.
XI. Bank Solvency Certificate of amount equal to 30% of the auctioned amount.
Note:-(a) All the copy of documents must be self-attested. Failure of submission of any of the
above mentioned documents will render the participation in this auction to be summarily
rejected.
(b) No extra document/(s) should be uploaded in this regard and uploading extra documents other
than those specified above in the Sl No. 29. will summarily be rejected and approval for
participation in this Auction will not be granted.
(c) The Employer (bid accepting authority) reserves the right to accept or reject any Bid and to
cancel the Bidding processes and reject all Bids at any time without thereby incurring any liability
to the affected Bidder or Bidders or any obligation to inform the affected Bidder or Bidders of the
ground for Employer’s (bid accepting authority) action.
