COUNTER- AFFIDAVIT
I, MARLON STOCKINGER, of legal age, Filipino, married, and a resident
of Phase 5, Block 6, Lot 7, Tensuan Site, Poblacion, Lungsod ng Muntinlupa,
having been duly sworn in accordance with law, hereby depose and state that:
1. I am the respondent in the case for violation of RA 9262, otherwise
known as “Violence Against Women and their Children Act of 2004”
filed by PIA WURTZBACH - STOCKINGER at the Muntinlupa City
Prosecutor’s Office;
2. I am executing this affidavit to vehemently deny all the accusations of PIA
WURTZBACH – STOCKINGER in her complaint. She is deliberately
misleading this Honorable Office as there was no substantial and
fundamental proof of said allegations;
3. The truth of the matter is that we met sometime in 1999, when she was
16 years old and I was 20. She was working in a night club as a dancer
and a guest relations officer;
4. We were able to get to know each other as I frequently got her to
accompany me in my table. I enjoyed her skills then for the price of P500.
I soon found out that she has been with a lot of men and a sex addict. She
just can’t help herself but be with different men;
5. Despite of that fact, we still fell in love and decided to live-in. I loved her
and accepted her for who she was. She left her work in the night club
because she got pregnant. So we decided to get married and to build our
own family. She promised me that she will change and be a good mother
and a faithful wife;
6. At first, everything worked out well between us. Of which our marriage
begot us five (5) daughters namely: Ma. Venus, Shamcey, Janine Mari,
Ariella and Maxine, all of whom are minors;
7. However, our relationship became sour when I learned that she is hooking
out again with different men. I will work at daytime and when I come
home, there is no food on the table, my wife is not around. When I asked
my children to where their mother is, they would tell me that they don’t
know about her whereabouts;
8. I would wait for her even if it would take until past midnight. She often
comes home wasted. We have talked about her actions and behavior
several times but she never changed, I was the one being betrayed;
9. Her allegation that I physically harmed her is because when I discovered
that our bank account has zero balance and that she sold most of our
appliances leaving only TV and refrigerator. She asked for my forgiveness
for using our money to satisfy her desire for other men. Out of anger, I
punched her once. However, I deny the allegation that I burned her using
flat iron because it would be impossible for me to do that since she
already sold our flat iron. To where she got that scar, I have no idea
because I am working at daytime and we only see each other at night when
most of the time she is drunk and wasted. Had I known about the scar, I
have assisted her with the medical assistance she need;
10. Her allegations that I have said derogatory words against her were because
she was telling other different names of men in different times of our
sexual intercourse. It is hurtful and hard for me as a man, knowing that I
am declaring my love for him as my wife, yet he would tell another name
and have another person in mind;
11. I went to Riyadh, Saudi Arabia to work as an OFW. I wanted to give a
better future to my family especially to my children. We agreed that while
I was away, Pia and my daughters would stay with my mother;
12. There is no truth that I am not sending any financial support. I am
sending money monthly to my mother for I was not comfortable with Pia
handling the money and I do not want to repeat the same incident again,
copy of money remittances are attached here as Annex “A” and copy of
receipts are attached here as Annex “B”. I don’t want all my hardships and
the feeling of a father being away from his daughters be put into waste;
13. The truth behind the loss of communication is because sometime in
November 2016, I was reassigned to a different boss where he
implemented a policy that all cellphones must be surrendered to him,
since there is a 7-hour difference between Riyadh and Philippine Time,
whenever Pia is calling my cellphone is not with me. A copy of the policy
is attached hereto as Annex “C”;
14. Moreover, I have received a text message from my mother that Pia got all
my daughters to come with her and they stayed at Purok 1, Block 2, Lot
3, Southville 4 Muntinlupa City. My mother told me that she and Pia got
into a disagreement when Pia was asking for the bank account where I was
sending the money but my mother refused to give it to her. It was Pia who
hurt my mother that caused some slight physical injuries as attached here
as Annex “D ”
15. Thus, when we had the chance to talk over the phone, I was asking her
how our daughters are and I was begging her to come home in my
mother’s house but she do not want to and told me that she and our
children need money. She told me that I should send it directly to her
because she will never go back to my mother’s house. I got angry with her
and hang up the phone. Nevertheless since my daughters are all with her, I
decided to send money every month, copy of money remittances are
attached here as Annex “E”’;
16. My contract in Riyadh is for one year. So in May 16, 2017, I texted her
that I will be back in the Philippines by June but the truth is I’ll be home
by May 22, 2017. I did not tell her the truth because I wanted to surprise
them but to my dismay, I learned of what happened to my daughters,
little did I know that they are suffering from hunger and stopped from
studying. It was heartbreaking for me to learned about that fact;
17. I went to Pia’s address and saw her with another man. Of which, I learned
from her neighborhood that there has been a lot of different men going in
and out of Pia’s house. I demanded that I will get all my daughters under
my custody but she told me that I cannot get my daughters from her and I
was the reason why these all happened to them. She told me that she has
all the rights as the mother of my children and will just see me in court.

18. And also there is no truth to the allegation that I am living with another
woman, Mary Jean is one of the boarders of my mother and my second
cousin. A copy of the rental payments and affidavit of Mary Jean are
hereto attached as Annex “G” and Annex “H” respectively;
19. It should also be noted by the Honorable Office that all the allegations in
the complaint are self-serving.
IN WITNESS THEREOF, I have hereunto set my hand this 8th day of
