    AGREEMENT ON ENCROACHMENT

    KNOW ALL MEN BY THESE PRESENTS:

    This AGREEMENT, made and executed this _____________________ by and between:

    hereinafter referred to as the "FIRST PARTY" and are both represented by their
    Attorney-in-fact, ____________, likewise of legal age, and a resident of _____ per

    WHEREAS, the FIRST PARTY conducted a survey on the subject parcel of land and

    NOW, THEREFORE, BOTH PARTIES agree that the encroached portion which is ____

    That the FIRST PARTY shall execute a Deed of Sale on the portion which was encroached

    That the SECOND PARTY agrees that they will spend for all the expenses to be incurred in
    the transfer of title such as the Capital Gain tax, and other BIR taxes, as well as other expenses
    incidental to the transfer except for the expenses of subdividing the lot which each party shall pay
    corresponding to their respective lots;

    THIS AGREEMENT shall bind the PARTIES and their successors and assigns who shall
    faithfully comply with the terms of this AGREEMENT.
