The State of Punjab has filed affidavit dated 27.3.2019 of the

Director, Health & Family Welfare, Punjab. Similarly, the State of Haryana

has filed affidavit dated 27.3.2019 of the Deputy Director, Forensic Science

Laboratory, Haryana. Alongwith the same, letter dated 26.3.2019, issued by

the Director General Health Services, Haryana, has also been filed. On

behalf of the UT, Chandigarh, affidavit dated 26.3.2019 of the Director,

Health & Family Welfare, has been filed. The affidavits are taken on record.

A perusal of the aforementioned affidavits show that the

budgetary allocations for the year 2019 have been released by both the

States and UT, Chandigarh, and it has also been undertaken on their behalf

that their respective shares shall be released every year without fail. In case,

there is a requirement of increased funding, the NICSI may intimate the

stake holders by 1st October of the previous year.

It is thus, directed that both the States and UT, Chandigarh,

shall release the budgetary allocation in their respective shares by 1st January

of every calendar year to the NICSI. On its part, the said agency i.e. NICSI

shall intimate the requirement of the funds by 1st October of the previous

year and in case there is a requirement of increased funding the stake holders

shall ensure that the enhanced amount is made available.

Two other issues have arisen in this petition, i.e. facility of

video conferencing in all the testing centers so that the subject experts are

not required to attend Court for proving their reports and the success of the

scheme of bar coding developed by the NICSI for reducing the delay in

preparation of reports.

Specific affidavits addressing the aforementioned issues be

filed on the next date of hearing. Reference be also made to the earlier

orders passed in this regard while furnishing the said affidavits.
