The Termination of Endo
Introduction Endo it is a form of contractualization which involves companies’ worker temporary employment it has been the most problematic schemes concerning labor relation in the Philippines sonce the wonder is deprived certain rights and security. The agents involved in the prevelance of contractual work or subcontracting are the private forms of Human Resource Department. The contracting agency and contractual employees themselves. There is widening gap between the workers in the formal and informal sectors in the Philippines. On the other hand, the contractual worker is part of the informal sector when they do not have a security of tenture, are not qualified to be given benefits; and are not allowed for representation in their lives of work. The termination of “endo” (End of contract) as a campaign promise of president Rodrigo Duterte will create varies repercussions to the Philippine Economy. The labor force sees as a tool of the capitalist to manipulate and exploit of the labors. The laborers is an prolonged unemployed and uncompetitive. While endo has deprived many laborers, would rather accept a below employment with full benefits enjoyed by a worker that have no paid employment. Since the initial drafts of the Philippine Labor Code up until today, there has been no drastic action on contractualization. This topic on Endo has been the subject of many debates ranging through various presidencies each promising to end this exploitative labor practice with each president contribution being a minute change to the Philippine Labor Code. Cancellation of endo would be most likely post requirements for the employees before new regular employees may be hired. People tells that you cannot make anyone or force anyone especially the employers to give what they do not have. To escape from the responsibility of carrying the load and additional of hiring regular manpower, firms would rather their current roster of employees work in lieu of hiring regular employees. With the current date on unemployment which stands at 5-8 percent, that the incoming administration under the leadership of president duterte that stands to inherit around 3.48 million people who are unemployed. The growth component was focused on consumer- driven fueled primarily by election spending to be in the high of 10-20 billion pesos. This amount of fund injection created temporary employment opportunities that to an income that contributed to the quarter rate. This, however is an short term “economic bliss” also known as bliss point is a quantity of consumption where any further increase would make the consumer less satisfied, that will go back to its previous dilemma of exclusive growth. That countless growth have been experienced but the people who considered themselves poor remain silent, the number of unemployed are remain at more than at 3 million. Graft corruption remain unmoved, putting in the most corrupt country in the world. According to Senator Marcos that he is also have given the provisions and grounds for the contractualization of workers of course in the Philippines. That he stated to allowed hire people under the contract of 6 months. That these 6 months are used on trial period of the employee. If the employee allowed to work after he time period of 6 months, he or she will be considered as a regular employee in reasonable and accordance made known by the employer to the employee at the time of engagement. If the employee unable to show or have the talent to keep his or her job, he or she will be terminated from employment immediately. According to Corazon Aquino "In cases of regular employment, the employer shall not terminate the services of an employee except for a just cause or when authorized by this Title. An Employee who is unjustly dismissed from work shall be entitled to reinstatement without loss of seniority rights and other privileges and to his full backwages, inclusive of allowances, and to his other benefits or their monetary equivalent computed from the time his compensation was withheld from him up to the time of his actual reinstatement." That failed to recognize the current situation of those employed to those probationary statuses. Employees could have not their services be terminated in just a cause, but in order in a probationary employee to attain regular status. That he or she will work more just than 6 months.] According to Current President of the Philippines Rodrigo Roa Duterte that he stands against the endo, promising to sign an executive order against it. However, the marawi crisis ends postponing the signing. As of 2018, no executive order has been signed by our president regarding the complete abolishment6 of contractualization. That on March 15, 2018 in protest against the president delay of the EO. Eventually on May , President duterte signs the EO that would put to end to contractualization, although Labor groups would criticize the presidents for his action since the one signed was not the draft agreed upon with them. There is no denying that the endo is a means for companies to get people when they totally need it to dispose of them when they see fit. This has been become an accepted to reality for the most partr that some companies have built their business. Of course there are positive things that businesses had gain when endo been eradicated. By giving benefits, business can be assurd of a more productive workforce. A person who has job security will be more precise to success than someone who dread the day the contract ends. Incentives can also be used to productivity and motivation, bringing forth a more active work. At the pace that the president is handling its project, we can sure to hear more news about this. But hopefully we can all look forward to a brighter future for our work and our businesses.
