Special Power of Attorney
1. To do any or all of the following acts with respect to a parcel of land with improvements
located in ________________________________with an area of
approximately______________________ square meters (“Property”) and is covered by
Transfer Certificate of Title No. _________________ (“TCT”) issued by the Registry of
Deeds for ___________________ in the name of______________: sell, transfer, assign,
convey, donate, rent, lease, enter into a usufructuary agreement, and/or to mortgage,
pledge, encumber or use the Property as collateral in order to secure the loan obligation
of any person or party; provided however, that the Corporation will act only as an
accommodation party and shall not in any way or manner become or be liable as a debtor,
borrower, co-borrower, guarantor or surety to any such loan obligation; and provided
finally, that the Corporation’s liability, if any, shall not extend beyond the above-described
Property;
2. To facilitate, process, and register the transfer of title pertaining to the Property;
3. To pay or cause the payment of the capital gains tax, withholding tax, donor’s,
documentary stamp tax, transfer tax, registration fee, real property tax, association dues,
and such other taxes, fees and charges which may be assessed or become necessary as a
condition for or in connection with the sale, encumbrance or disposition of the Property
and transfer of the title;
4. To transact and negotiate with the Bureau of Internal Revenue, Assessor’s Office,
Treasurer’s Office, Registry of Deeds and such other related agencies or instrumentalities
of the local and national government, including private natural or juridical persons such
as but not limited to the developer, homeowner’s association and the like;
5. To secure from any of the above-named persons, agencies or instrumentalities of the local
and national governments copies or certified true copies of titles, tax declarations, maps,
tax clearance, statement of account, notices, certifications, and other relevant
documents; and
6. To execute, sign, receive, and deliver letters, documents, instruments and other papers
which may be needed, required or become beneficial in the performance of the foregoing
authorities.
7. To demand and receive payments, which if in the form of a check could be issued in the
name of ___________________ and credit such payments to his own account.
HEREBY GIVING AND GRANTING unto our above-named attorney-in-fact full power and
authority to do and perform all and every acts and things whatsoever requisite or necessary to
be done in and about the premises, with power or authority of substitution hereby given, and
hereby ratifying and confirming all that my said attorney-in-factor its substitute shall lawfully do
or cause to be done by virtue of this Special Power of Attorney. This power of attorney is one
with interest and cannot be revoked without the express consent of the attorney-in-fact.
