    COMPLAINT-AFFIDAVIT

    That I, ROMEO D. ESPIRITU, of legal age, married, Filipino and a


    resident of B11 L54Lapulapu St., City Homes, Molino 4, Bacoor City,
    Cavite, after having been duly sworn to in according to law hereby depose
    and say:

    1. That I am the owner of a tricycle franchise in UMCH TODA of Brgy.


    Molino 4, Bacoor City, Cavite;

    2. I am filing a formal complaint for Estafa (other deceit) against


    respondents Noel Gaelon, Jennyville Primavera and Mylene
    Quirona and they may be served with notices at UMCH TODA
    Office located at 1st Avenue Cor. 5th Avenue Phase 2A City Homes
    Brgy. Molino 4 Bacoor City, Cavite;

    3. On March 14, 2019, Complainant together with Cristito Ysic brought


    One Hundred Twenty Thousand Pesos (Php120,000.00) at UMCH
    TODA Office;

    4. The twenty thousand pesos (Php20,000.00) is for the payment of the


    transfer of rights of the tricycle franchise of Complainant Espiritu and
    the One Hundred Thousand Pesos (Php100,000.00) is for the money
    of UMCH TODA allegedly misappropriated by Mr. Espiritu as
    alleged by the Respondent Mr. Gaelon;

    5. One week after March 14, 2019, Mr. Cristito Ysic turned over the said
    money to Respondent Jennyville Primavera upon the instruction of
    Respondents Gaelon and Quirona;

    6. Respondents misrepresented to Complainant Espiritu that the One


    Hundred Thousand Pesos (Php100.000.00) collected from the latter
    will be turned over to UMCH TODA as payment for the money
    misappropriated by the Complainant when he was the treasurer of the
    UMCH TODA;

    7. Upon learning the intention of the Respondents to deprive him of his


    money through misrepresentation and without legal justification,
    Complainant seeks help from Brgy. Molino 4 for the return of his
    money;

    8. During the series of meetings in Brgy. Molino 4, Respondents denied


    having received any amount of money from the Complainant. Thus,
    the complainant made a request from the Brgy. Lupon for the issuance
    of the Certificate to File Action;

    9. The unlawful acts by Respondents caused damage and prejudice to the


    Complainant and has tarnished his respectable refutation in the
    community;

    10.Complainant spent Php15,000.00 for attorney’s fees for filing the


    complaint affidavit;

    11.That I am executing this affidavit to file a formal complaint of Estafa


    (other deceit) against Noel Gaelon, Jennyville Primavera and Mylene
    Quirona.
