DEED OF WILL
I, TASMIYA ABDUL GANI KAPDE a.k.a TASMIYA ASIF MODAK, presently

residing at 101, SHANTI KUNJ, PLOT NO. 58A, SECTOR -23, NERUL (EAST),
NAVI MUMBAI, make this last WILL and Testament this ___ Day of June, 2017, out of
my free will, volition and without any coercion or undue influence whatsoever and state
that this is my last will and that I hereby revoke all my previous Wills and Codicils, if any,
made by me at any time heretofore.
Whereas I am possessed of considerable moveable and immoveable properties acquired by

me without any outside help or contribution and having absolute powers of disposition over
the same;
And whereas I am desirous of making suitable arrangements in respect of the enjoyment of

such properties after my life time, so that unnecessary misunderstanding, disputes or
consequential fruitless litigations between the members of my family are avoided.
Whereas my personal family consist of my husband named Asif Amirruddin Modak, and
minor son Aarish Asif Modak respectively.
Now, therefore, I am making this last will and testament of mine of my own free volition
and declare as follows:
1. All my previous Wills and Codicils made by me shall stand revoked;

2. In case I should die before the said minor son Aarish Asif Modak attains majority,
I appoint SOFIA ABDUL GANI KAPDE and Mr. TAUSIF ABDUL GANI
KAPDE, as the joint Trustee/s and executor/s or executrix/s under this will, who
shall realize all my outstanding and administer the estate left by me for the benefit
of Aarish Asif Modak, of the said legatee after defraying all expenses of such
administration. When the said Aarish Asif Modak attains majority, the said SOFIA
ABDUL GANI KAPDE and Mr. TAUSIF ABDUL GANI KAPDE shall
handover all the estate then in existence unto the said Aarish Asif Modak. During
the minority of the said Aarish Asif Modak, the executors shall act as guardian/s of
the said Aarish Asif Modak and shall look after his education and training in a
befitting and useful manner so as to earn a decent living as a member of some noble
profession. However, if the said Aarish Asif Modak attains majority during my
life-time and survives me, this provision relating to appointment of the executor
shall not be operative and the said Aarish Asif Modak shall be entitled to receive
and appropriate as owner all and every part of the estate left
3. I declare, that the expression “My Trustee” shall mean and include the trustee or
trustees of this Will, whether original or substitute.
4. I state that recently I met with an Major Accident due to which a steel rod plate is
inserted in my leg and I cannot comfortably walk now-a-days, and remain in bed-
most of the time due to my accident ; and do not want/wish that there should
be any dispute in future regarding distribution and enjoyment of my properties
after my death, amongst my husband and Minor Son.
5. I am declaring, hereby bequeathing voluntarily and affectionately in my complete

vital senses all my properties and belongings, movable and immovable,
belonging to me or which may belong to me and remain indisposed of during my
life-time unto Aarish Asif Modak, my son; to commence from the date of my
untimely death, with specific arrangements/provisions enunciated herein-below to
be observed strictly and absolutely as under in favour of my minor son in the
following manner :-
A. I hereby devise/bequeath Flat No. 103, on 1st Floor, admeasuring carpet area
282 Sq. Ft., in Building known as “SAI PRINCE”, GES PLOT No. 203,
SECTOR No. 17 at ULWE VILLAGE, UNDER 12.5% (Gaothan
Expansion Scheme), Tal – Panvel, Dist. Raigad., in favour of my son Aarish
Asif Modak, my title, interests, and all other rights which I have as owner of
the premises/property situated at Tal – Panvel, Dist. Raigad, described in the
Schedule of this Will, and I hereby state that he shall be entitled to use and
enjoy the said property at his own will after my death.
B. I hereby devise/ bequeath after my death, Bank Locker bearing no. 55 in Bank
of India, _____ Branch and all bank balance lying in my name at Savings /
Current Bank Account Nos Listed below:

2. C.S.B A/c Bearing No. 034002951444190001, ______Branch.

3. State Bank of India A/c Bearing No. 54021006552_______, Branch.

And Whereas other amounts receivable , all other residuary
property/properties, assets and other rights, all my ornaments and
jewellery/s and other valuables belonging to me, cash balance lying with me
at the time of my death shall be inherited by my son Aarish Asif Modak.
6. I hereby devise/bequeath after my death, my various Life Insurance Policies
listed below to my son Aarish Asif Modak.

7. I hereby devise/bequeath after my death, my various National Saving

Certificate/s, listed below to my son Aarish Asif Modak.
1. 10 – Years National Saving Certificate Bearing No. 03NA 179119, at S.P.M.

Saitwade – 415 613.
6. I direct that before handing over my assets in accordance with this will, all my
debts, liabilities and monetary obligations including all testamentary expenses,
costs, charges, expenses in respect of probate and other legal charges at the time
of my death be met out of my assets.
7. I hereby exclude my husband ASIF AMIRRUDDIN MODAK, from succeeding

and/ or inheriting my-self acquired properties, since my husband has always evade
8. I have hereby deliberately excluded my husband ASIF AMIRRUDDIN MODAK,

from this my Will and it is my intention that the said ASIF AMIRRUDDIN
MODAK should receive NO PART OF MY ESTATE since he has always evaded
from the responsibility of the Husband and Father by not supporting the basic
necessities of the family.
I further state and declare that the executor shall have all the powers as may be
necessary to execute this will in accordance with the provisions herein
contained.

understanding its contents, and its provisions being read over and explained to me in
