Letter To The Barangay

However, the residents clarify that the directive only applies to highways and main roads, not streets inside subdivisions. Dear Kap. Nato:

Greetings!

This correspondence pertains to the Letter from your good office dated 9
October 2019 on the sidewalk-clearing operation undertaken by the City Government
of Imus in compliance with the directive of the Department of Interior and Local
Government (DILG) per Region IV-A Memorandum Circular No. 017-19.

The undersigned, as residents of 25 Kalantiaw St. cor. Jacinto St., wish to


clarify that the Memorandum Circular affects highways and public roads – in the
words of Mayor Emmanuel L. Maliksi, “mga highway at pangunahing kalsada.” Streets
inside subdivisions are, as a rule, not included within the coverage of “public roads.”

Consequently, unless proof is presented that Kalantiaw and Jacinto Sts. Have
been converted into public roads, these remain outside the coverage of the Circular,
and necessarily, the sidewalk-clearing operations of the local government.

While the intention to faithfully follow the issuance, and necessarily, the
directive of President Rodrigo Roa Duterte to clear public roads, is commendable, the
exercise of due discretion is equally important so that the local government would
not end up infringing on the rights of private, law-abiding individuals.
