AN ACT RESPECTFULLY REQUESTING ALL PUBLIC AND PRIVATE


EDUCATIONAL INSTITUTIONS WITHIN THE TERRITORIAL JURISDICTION OF
THE PROVINCE OF LA UNION TO CONDUCT MONTHLY PSYCHOSOCIAL
EVALUATION AND ASSESMENT TO STUDENTS AND TO FACILITATE
ADOLESCENT MENTAL HEALTH PROGRAMS.

EXPLANATORY NOTE

Mental health care is among the prevalent problem among the youth nowadays. It poses a
serious threat considering the fact that majority of the people suffering from mental health issues
often leads to anxiety, loss of productivity and depression. Depression is of the most prevalent
effects caused by mental health issues or problems which the young adults experience.
According to the World Health Organization (WHO) 80% of the total population of young adults
suffer from depression, which is very alarming because majority of the people suffering from
depression leads to suicide.

Generally , young adults spend most of their time in Schools, Colleges and Universities,
therefore, educational institutions play a vital role in the development of their mental health. In
hindsight, educational institutions must not only focus on academic and scholarly progress of
students but also their emotional and mental health. Through a systematic approach, Educational
institutions may foster the growth and development of students that may address the problem on
growing mental health problems among the youth.

The legal basis for the implementation of this legislative measure is Article II, Section
15 declares that “The State shall protect and promote the right to health of the people and instill
health consciousness among them. Also, Republic Act 11036 or the Mental Health Act of 2017
specifically Section 3 (f) “Integrate strategies promoting mental health in educational
institutions, the workplace, and in communities”. Moreover, Section 16. General Welfare Clause
of the Local Government Code of 1991 which expressly states that “Every local government unit
shall exercise the powers expressly granted, those necessarily implied therefrom, as well as
powers necessary, appropriate, or incidental for its efficient and effective governance, and those
which are essential to the promotion of the general welfare. Within their respective territorial
jurisdictions, local government units shall ensure and support, among other things, the
preservation and enrichment of culture, promote health and safety, enhance the right of the
people to a balanced ecology, encourage and support the development of appropriate and self-
reliant scientific and technological capabilities, improve public morals, enhance economic
prosperity and social justice, promote full employment among their residents, maintain peace and
order, and preserve the comfort and convenience of their inhabitants”.

Be it enacted by the Sangguniang Panlalalwigan in session duly assembled:

SECTION 1. TITLE. This ordinance shall be known as AN ACT RESPECTFULLY


REQUESTING ALL PUBLIC AND PRIVATE EDUCATIONAL INSTITUTIONS WITHIN
THE TERRITORIAL JURISDICTION OF THE PROVINCE OF LA UNION TO CONDUCT
MONTHLY PSYCHO-SOCIAL EVALUATION AND ASSESMENT TO STUDENTS AND
TO FACILITATE ADOLESCENT HEALTH PROGRAMS.
SECTION 2. DECLARATION OF POLICY. It is hereby the declared policy of the
Provincial Government of La Union to promote and protect the health and well-being of the
people of the Province of La Union.

SECTION 3. SEPARABILITY CLAUSE. If any provision of this ordinance is declared


unconstitutional, the other provisions not affected shall remain in full force and effect.

SECTION 4. REPEALING CLAUSE. Any ordinance, rule and regulation which are
inconsistent with this ordinance are hereby deemed amended, modified or repealed accordingly.

SECTION 5. EFFECTIVITY CLAUSE. This ordinance shall take effect in accordance


with law.
