 Rajasthan Special Backward Classes (Reservation of Seats in Educational Institutions in the State and of
Appointments and Posts in Services under the State) Act, 2015 passed bringing 5 castes in OBC
-Banjara/Baldiya/Labana, Gadiya Lohar/Gadoliya, Gujar/Gurjar, Raika/Rebari/Debasi and
Gadariya/Gadri/Gayari under Special Backward class and 5% quota was granted to them under SBC category.

 This increase of 5% quota brought the existing 49% reservation to 54%. The Hon’ble Rajasthan High Court vide
its judgement dated 09.12.2016 was pleased to strike down the Rajasthan Special Backward Classes
(Reservation of Seats in Educational Institutions in the State and of Appointments and Posts in Services under
the State) Act, 2015 (‘the Rajasthan Act’), and that the judgment is the subject of challenge before this Hon’ble
Court in State of Rajasthan & ors Vs Captain Gurvinder Singh & Ors [SLP (C) No. 3042-3044 of 2017] wherein
this Hon’ble Court vide order dated 3.2.2017 held :

Permission to file special leave petition is granted.


Leave granted.

An enactment of the State of Rajasthan providing for reservations in favour of certain backward classes has
been struck down by the High Court by the Judgment under appeal.

We are informed by learned Attorney General that pursuant to the impugned enactment, the benefits of the
reservation in the matter of admission to educational institutions and employment under the State are
already given by making certain appointments.

We deem it appropriate to direct the appellant(s) to maintain status quo obtaining as on today.

The admissions so made to the educational institutions and appointments so made by the State shall not
be disturbed pending final hearing of the matter. We also make it clear that no fresh admissions and
appointment shall be made pursuant to this interim order.
 Moreover in Rajasthan matter this Hon’ble Court by the order dated 09.05.2017 has permitted appointments of
1252 candidates belonging to special backward class who were successful in selection process but till High
Judgement were not given appointments. This Hon’ble has permited temporary superannumery appointments
of those candidates, subject to the outcome of Appeals. This Hon’ble Court has observed as follows:
4. The applicants in these applications claim that they are identically situated as those candidates falling
under the category of “special backward classes” who have been appointed prior to the judgment of the
High Court. In view of the interim order dated 3.2.2017, candidates, who had been appointed, are
continuing in service. Their continuance is made subject to the final orders in the appeals. There is no
justification for not appointing these applicants who also belong to the same class and who have been
declared successful in the selection process for appointment of various posts.

Subsequently the Rajasthan Assembly on 26.10.2017 passed the The Rajasthan Backward Classes (Reservation of
Seats in Educational Institutions in the State and of Appointment and Posts in Services under the State) Bill, 2017
which raises reservation for Banjara/Baldiya/Labana, Gadiya Lohar/Gadoliya, Gujar/Gurjar, Raika/Rebari/Debasi
and Gadariya/Gadri/Gayari in Rajasthan from 21% to 26% that were earlier grouped as special backward classes
(SBCs). The government thereby aimed at achieving the quota earlier termed as SBC struck down by the Hon’ble
Court by including it on the existing category of OBC.
