AFFIDAVIT

I, Terfuliano Solpot Tejada, 53 years of age, married , resident of Zamora, Bilar, Bohol
Philippines after having duly sworn to in accordance with law do hereby depose and say:

That I am a regular member of the Philippine National Police with the rank of Police
Inspector presently assigned at Antequera Police Station, Antequera, Bohol designated as Chief
of Police;

That on February 20, 2011 at more or less 11:30 o’clock in the evening, together with my
men responded request for police assistance at Sitio Aghuban, Tabuan, Antequera, Bohol
particularly at the Store with Videoke of Cabrina Barbarona due to report that there was a man
with a gun and fired it two times that causes them to panic;

That I conducted investigation with the owner of the said store and found out that a
certain Rolly Mag-aso, of legal age, single and a resident of Sitio Saksakan, Tabuan, Antequera,
Bohol arrived the area riding with his motorcycle and have a drinking spree and showed violent
actions towards other customers who were known to be native from adjacent Barangay Abilihan
town of San Isidro, Bohol by displaying or showing to them a gun which was tacked on his
waistline;

That information gathered further stated that the suspect fired his gun two times and left
the place leaving behind his motorcycle;

That in the course of investigation I have recovered from the scene one (1) empty
shell/cartridge of Cal. 45 pistol and one (1) unit Honda XRM motorcycle color red with plate
number 3215-GM which was believed be the empty shell of gun being fired by the suspect and
the motorcycle which he was riding on when he arrived the place;

That the following day February 21, 2011a follow-up investigation was conducted and
recovered from the scene a slug believed to be from the gun which was being fired by Rolly
Mag-aso on the night of February 20, 2011;

That the empty shell of a 45 Caliber Pistol and a slug of believed to be from a Cal. 45
pistol was submitted to the Crime Laboratory, Bohol PNP Command for ballistic examination;

That I executed this affidavit to attest the truth of the foregoing facts.

INCIDENT/EVENTS: REFERENCE ENTRY NO.1119 (REPORT ON ILLEGAL
POSSESSION/DISCHARGED OF FIREARMS

That OOA 201115H February 2011, a certain Rolly Mag-aso, of legal age, single and a
resident of Sitio Saksakan, Tabuan, Antequera, Bohol fired his calibre 45 pistol twice near the
residence and videoke store of one Cabrina Barbarona, 31 years old, single, situated at Sitio
Aghuban, Tabuan, Antequera, Bohol. Investigation conducted by Police Inspector Terfuliano S.
Tejada, the Chief of Police of this station revealed that the suspect together with one Michael
Ramos of the same place arrived at the videoke store of Cabrina Barbarona at more or less 10:30
in the evening of the same day (February 20, 2011) and ordered a half galloon of tuba, have a
drinking session and showed an intreguing violent reaction with other customers from Abehilan,
San Isidro, Bohol who were also drinking and singing at said videoke store by viewing his
caliber 45 pistol which was inserted on his waistline, 30 minutes after, the suspect walked 10
meters away from said store and a burst of gun fire in the air was heard twice. After the incident
the suspect left the area leaving behind his motorcycle. Recovered from the scene a one (1) unit
MC XRM color red with plate number 3215-GM and a one (1) piece empty shell (cartridge) of
caliber 45 pistol and was brought to this Police Office for evidentiary purpose and custody
respectively. Furthermore, info gathered by the Chief of Police that the suspect was involved in
the Petron Gasoline Station robbery at Calape, Bohol. PNP elements of this unit still conducting
hot pursuit operation for the arrest of the suspect. Investigation still going on.

I, Andy Panimdim y Baluca, 34 years old, married and a resident of Sitio Aghuban,
Tabuan, Antequera, Bohol, Philippines after having duly sworn to in accordance with law, do
hereby depose and say;

That we are living together in the house of Cabrina Barbarona, my sister in-law that has
a store, billiard table and a videoke machine;

That on February 20, 2011 at 10:30 o’clock in the evening more or less, while I am
sitting outside the house watching billiard games, I noticed that a certain Rolly Mag-aso arrived
the place riding a motorcycle HONDA XRM 125 color red with plate number 3215 GM and he
ordered a tuba;

That at around 11:00 o’clock in the evening, I saw Rolly Mag-aso walked towards the
entrance/exit way about more or less ten meters away from me and drew his handgun and fired it
two times and then he vanished to the darkness leaving his motorcycle;

That after the incident my sister in-law Cabrina Barbarona immediately called for police
assistance;

That few minutes after, the police authorities of Antequera Police Station led by Police
Inspector Terfuliano Tejada arrived in our place;

That I executed this affidavit to attest the truth of the foregoing facts;

That affiant have nothing more to say.
