II. RULES and PRACTICE

1 Civil Engineering shall hold paramount the safety, health and welfare of the public and shall
strive to comply with the principles of sustainable development in the performance of
their professional duties.

a. Civil Engineers shall recognize that the lives, safety, health and welfare of the general public
are dependent upon engineering judgements, decisions and practices incorporated into
structures, machine, products, processes and devices.

b. Civil Engineers shall approve or seal only those design documents, reviewed or
prepared by them, which are determined to be safe for public health and welfare inconformity
with accepted engineering standards.

c. Civil Engineers whose professional judgement is overruled under circumstances


where the safety, health and welfare of the public are endangered, or the principles of
sustainable development ignored, shall inform their clients or employers of the
possible consequences.

d. Civil Engineers who have knowledge or reason to believe that another person or firm may be
in violation of any of the provisions of Canon 1 shall present such information to
the proper authority in writing and shall cooperate with the proper authority in furnishing such
further information or assistance as may be required.
e. Civil Engineers should seek opportunities to be of constructive service in civic affairs and
work for the advancement of the safety, health and well-being of their
communities, and their protection of the environment through the practice of
sustainable development.

2 Civil Engineers shall perform services only in areas of their competence.

a. Civil Engineers shall undertake to perform engineering assignment only when


qualified by education or experience in the technical field of engineering involved.

b. Civil Engineers may accept an assignment requiring education or experience outside of their
own fields of competence, provided their services are restricted to those phases of the
project in which they are qualified. All other phases of such project shall be performed by
qualified associates, consultants, or employees.

c. Civil Engineers shall not affix their signatures or seals to any civil engineering plan or
document dealing with subject matter in which they lack competence by virtue of education or
experience or to any such plan or document not reviewed or prepared under their supervision
and control.

d. Civil Engineers shall not use The Specialty Engineering Title such as Structure
Engineer, Transportation Engineer, Water Engineer, Geotechnical Engineer, Construction
Engineer, etc. without the PICE Specialist Accreditation.

3 Civil Engineers shall issue public statements only in an objective and truthful manner.

a. Civil Engineers should endeavor to extend the public knowledge of civil engineering and
sustainable development, and shall not participate in the dissemination of untrue, unfair or
exaggerated statements regarding civil engineering.

b. Civil Engineers shall be objective and truthful in professional reports, statements or


testimony. They shall include or relevant and pertinent information in such reports, statements,
or testimony.

c. Civil Engineers, when serving as expert witnesses, shall express civil engineering opinion only
witnesses, shall express civil engineering opinion only when it is founded upon
adequate knowledge of the facts, upon a background of technical competence, and
upon honest conviction.

d. Civil Engineers shall issue no statements, criticisms, or arguments on civil


engineering matters which are inspired or paid for by interested parties, unless they indicate on
whose behalf the statements are made.

e. Civil Engineers shall be dignified and modest in explaining their work and merit, and will
avoid any act tending to promote their own interests at the expense of the
integrity, honor and dignity of the civil engineering profession and/or related
professions.
4 Civil Engineers shall act in professional matters for each employers or clients as faithful agents or
trustees, and shall avoid conflicts of interest.

a. Civil Engineers shall avoid all known or potential conflicts of interest with their employers
or clients and shall promptly inform their employers or clients of any business associations,
interest, or circumstances which could influence their judgement or the quality of their
services.

b. Civil Engineers shall not accept compensation from more than one party for services on the
same project, or for services pertaining to the same project, unless the
circumstances are fully disclosed to and agreed to, by all interested projects.

c. Civil Engineers shall not solicit or accept gratuities, directly or indirectly, from
contractors, their agents, or other parties dealing with their clients or employers in connection
with work for which they are responsible.

d. Civil Engineers in public services as members, advisors or employees of a


governmental body or department shall not participate in consideration or actions with respect
to services solicited or provided by them or their organization in private or public engineering
practice.

e. Civil Engineers shall advise their employers or clients when, as a result of their studies,
they believe a project will not be successful.

f. Civil Engineers shall not use confidential information coming to them in the course of their
assignments as a means of making a personal profit if such action is adverse to the interest of
their clients, employers or the public.

g . Civil Engineers shall not accept professional employment outside of their regular work of
interest without the knowledge of their employers.

5 Civil Engineers shall build their professional reputation on the merit of their services and shall
not compete unfairly with others.

a. Civil Engineers shall not give, solicit or receive either directly or indirectly, any political
contribution, gratuity or unlawful consideration in order to secure work, exclusive of
securing salaried positions through employment agencies.

b. Civil Engineers should negotiate contracts for professional services fairly and on the basis of
demonstrated competence and qualifications for the type of professional service
required.
c. Civil Engineers may request; propose or accept professional commissions on a
contingent basis only under circumstances in which their professional judgements would not
be compromised.

d. Civil Engineers shall not falsify or permit misrepresentation of their academic or


professional qualifications or experience.

e. Civil Engineers shall give proper credit for engineering work to those to whom credit is due,
and shall recognize to proprietary interests of others. Whenever possible, they shall name the
person or persons who may be responsible for design, inventions, writings or other
accomplishments.

f. Civil Engineers may advertise professional services in a way that does not contain misleading
language or is in any other manner derogatory to the dignity of the profession.
Examples of permissible advertising are as follows:

1. Professional cars in recognized, dignified publications, and listings in rosters or


directories published by responsible organizations, provided that the card or
listings are consistent in size and content and are in a section of the publication
regularly devoted to such professional cards.

2. Brochures which factually describe experience, facilities, personnel and capacity to


render service, providing they are not misleading with respect to the engineers
participation in projects described.

3. Display advertising in recognized dignified business and professional


publications, providing it is factual and it is not misleading with respect to the
engineer’s extent or participation in projects described.

4. A statement of the engineers’ names or the name of the firm and statement of the
type of service posted on projects for which they render services.

5. Preparation or authorized of descriptive articles for the lay or technical press, which
are factual and dignified. Such articles shall not imply anything more than direct
participation in the project described.
6. Permission by engineers for their names to be used in commercial advertisements,
such as may be published by contractors, materials suppliers, etc., only by means of a
modest, dignified notation acknowledging the engineers’ participation in the project
described. Such permission shall not include public endorsement or
proprietary products.

g . Civil Engineers shall not maliciously or falsely, directly or indirectly, injure the
professional reputation, prospects, practice or employment of another engineer or in
discriminately criticize another’s work.
h. Civil Engineers shall not use equipment, supplies, laboratory or office facilities of their
employers to carry on outside private practice without the consent of their
employers.

6 Civil Engineers shall act in such a manner as to uphold and enhance the honor, integrity, and
dignity of the civil engineering profession.

a. Civil Engineers shall not knowingly act in a manner which will be derogatory to the honor,
integrity, or dignity of the civil engineering profession or knowingly engage in business or
professional practices of a fraudulent, dishonest or unethical nature.

7 Civil Engineers shall continue their professional development throughout their careers,
and shall provide opportunities for the professional development of those Civil
Engineers under their supervision.

a. Civil Engineers should keep current in their specialty fields by engaging in


professional practice, participating in continuing education courses, reading in the technical
literature, and attending professional meetings and seminars.

b. Civil Engineers should encourage their engineering employees to become registered at the
earliest possible date.

c. Civil Engineers should encourage engineering employees to attend and present paper sat
professional and technical society meetings.

d. Civil Engineers shall uphold the principle of mutually satisfying relationships


between employers and employees with respect to terms of employment including professional
grade descriptions, salary ranges, and fringe benefits.

III. OBLIGATIONS OF THE CIVIL ENGINEER

The Obligations of the Civil Engineer include:

1. The Civil Engineer shall perform Scope of the Services as stated in SECTION 2.

2. The Civil Engineer shall exercise reasonable sill, care and diligence in the performance of his
obligations.

3. The Civil Engineer shall act independent and, as required by the contract, perform with the
necessary skills and professional judgement, when required to certify, decide or
exercise discretion between the Client and a Third party with whom the Client has a contract.

4. The Civil Engineer is authorized to act as the Client’s faithful agent when required but only as
implied in SECTION 2 or implied in the contract adopted for the Project.
5. When aware of any matters which may will change or has changed the scope of the services,
the Civil Engineers shall give written notice to the Client containing particulars of the change.

6. For Specified Staged Services, the Civil Engineer shall not initiate or proceed with any
subsequent stage of the Services without the approval of the Client.

7. When required, the Civil Engineer shall direct and co-operate with all other professionals and
integrate their work where applicable into that being undertaken by the Civil
Engineer and other professionals, but shall not be professionally liable to their work.

8. The Civil Engineer may recommend specialist suppliers and/or contractors to design and
execute certain parts of the Works, in which case the Civil Engineer shall coordinate the design
of such parts or parts with the overall design of the Works but he shall be relieved of all
responsibility for the design, manufacture, installation and performance of any such part or
parts of the Works. The Civil Engineer shall not be liable for acts of negligence, default or
omission by such person or persons.

9. The Civil Engineer shall notify the Client of any interest the Civil Engineer has which may
significantly conflict with the interest of the Client under their Contract.

CODE OF ETHICS FOR EE

FOREWORD

Ethics is a set of moral principles or values to govern the conduct of an individual belonging to a
group or profession on the basis of honesty, fairness, and justice. An Electrical Engineer should observe
a System of moral principles and values, not in passive recognition, but as a set of dynamic standards to
guide his conduct and way of life. It is his duty to practice his profession according to this Code of Ethics.
The keystone of professional conduct is integrity.

I. PROFESSIONAL LIFE

Section 1. An Electrical Engineer should discharge his duties with absolute fidelity to his
clients and employers, and to act at all times, with fairness and impartiality to all, having due
regard to public interest and welfare.

Section 2. An Electrical Engineer should uphold the honor and dignity of his profession and,
therefore, should avoid association with any person or enterprises of known questionable
character.

Section 3. An Electrical Engineer should strive to upgrade his skill and knowledge in electrical
engineering in order to give the best possible service to the public which could be attained
by interchanging information and experiences with other engineers, and by unselfishly
contributing to the mission of engineering societies, institutes, schools and engineering and
scientific media, and other public institutions.

Section 4. An Electrical Engineer should only advertise his work or merit in a simple manner
and avoid any practice that will discredit or do injury to the dignity and honor of his
profession.

Section 5. An Electrical Engineer should endeavor to extend public knowledge of


engineering and shall discourage spreading the untrue, unfair, and exaggerated statements
regarding engineering.

Section 6. An Electrical Engineer, should have due regard at all times for the safety of the life
and health of his employees, other workers, as well as of the general public and for the
protection of property that may be affected by the work this responsibility.

Section 7. An Electrical Engineer should express an opinion on engineering subject, whether


publicly or privately, only when such opinion is called for, his opinion must be founded on
adequate knowledge and information of the relevant issues and facts based upon his honest
convictions.

Section 8. An Electrical Engineer should not issue statements, criticisms, opinions,


arguments or other views on matters except where public interest is affected.

II. RELATION WITH CLIENT AND EMPLOYER

Section 1. An Electrical Engineer should be fair, impartial and reasonable in rendering


professional service to his clients, employers and contractors regarding contracts or other
agreements.

Section 2. An Electrical Engineer should, before undertaking any engagement or entering


into any contracts which calls for his professional service that will require or need the use of
apparatus, other equipment or things in which he has financial interest, have such situation
clarified in the contract or agreement to avoid conflict of interests.

Section 3. An Electrical Engineer should be vigilant in guarding against conditions that may
be dangerous or threatening to life, health, or property on work for which he is responsible,
or otherwise bring such conditions to the attention of those responsible.

Section 4. An Electrical Engineer should present clearly the known possible consequences or
limitations of the work for which he will be responsible.

Section 5. An Electrical Engineer should honestly advise his clients or employer to engage
the services of other experts and specialists, and should cooperate with them in the
interests of his client or employer.
Section 6. An Electrical Engineer should not accept compensation from more than one
interested party for the same professional service pertaining to the same work, without the
consent of all affected parties.

Section 7. An Electrical Engineer should not divulge confidential matters or information


which has come to his knowledge concerning affairs of his client or employers, without their
consent.

Section 8. An Electrical Engineer should not be financially interested in the bids of a


contractor on competitive work for which he has been or expects to be employed as an
engineer, unless he has the consent of his client of employer.

Section 9. An Electrical Engineer should promptly disclose to his client or employer and
interest which he may have in a business that may conflict with or affect his decision
regarding engineering work for which he is employed or which he may be called upon to
perform.

III. RELATIONS WITH FELLOW ENGINEERS

Section 1. An Electrical Engineer should endeavor at all times to protect the engineering
profession collectively and individually against misrepresentation, distortion,
misunderstanding or unfair criticism.

Section 2. An Electrical Engineer should give credit for the engineering work to the person
whom the credit is legally due.

Section 3. An Electrical Engineer should live up to the standards of professional practice for
electrical engineering.

Section 4. An Electrical Engineer should not directly or indirectly injure the professional
reputation, prospects, or practice of his fellow engineers. Whenever he finds an Engineer
violating the rules of unethical or unprofessional practices, he should not hesitate to bring
the matter to the proper forum for disciplinary or for other appropriate action.

Section 5. An Electrical Engineer should not compete with another Engineer on the basis of
compensation for particular work by means of underbidding, after the results of a public
bidding are announced.

IV. PENAL PROVISIONS


Section 1. Violation of any provision of this Code shall constitute unethical, unprofessional
and dishonorable conduct and the violator shall be subjected to disciplinary action by the
Board of Electrical Engineering.

CODE OF ETHICS FOR ME

I. GENERAL PRINCIPLES

Rule 1. The mechanical engineer shall, in the practice of his profession, be governed by
the Golden Rule, the ideals of service to man and his environment, and the indispensability of
unwavering public confidence in his professional competence, integrity and humanity.

Rule 2. The mechanical engineer shall maintain the proper pride for his profession,
observe the standards of professional practice, safeguard the dignity, welfare, and reputation of
his colleagues in the professions, and fulfill his duties and obligations as a citizen of the Republic
of the Philippines.

Rule 3. The mechanical engineer shall update and enhance constantly his professional
knowledge and skills through assiduous research and study, and meaningful participation in
continuing education programs and seminars conducted or authorized by the Philippine Society
of Mechanical Engineers or educational institutions supervised by the State.

Rule 4. The ethical principle governing the mechanical engineer applies equally to
partnerships, firms and entities organized and existing for the practice of mechanical engineering.

II. RELATIONS WITH THE STATE

Rule 5. The mechanical engineer shall honor and respect the supreme authority of the State,
the Rule of Law, the primacy of the general welfare, the fundamental rights of persons, and the
obligations and privileges of citizens recognized and guaranteed by the Constitution of the
Philippines.

Rule 6. He shall cooperate fully with the State in the pursuit of national development plans
and programs, the inviolability of national security, the promotion of peace, and the prevention and/or
prosecution of unjust, criminal or unlawful acts and omissions.

Rule 7. He shall be ready to render the services needed for the adequate and orderly
development of the resources of the country, and to offer his mechanical devices and inventions
essential or necessary for national defense.

Rule 8. In a national emergency, he shall offer his professional knowledge, skill and
experience in the service of the State.

III. RELATIONS WITH THE COMMUNITY

Rule 9. The mechanical engineer shall be well-informed of the latest technological progress in
his own line of work. He shall encourage and require the use, or application of standard mechanical
equipment, machinery, or processes for safety, economy and efficiency.
Rule 10. Whenever he designs a mechanical equipment, machinery or process, or prepares
the layout of a project, he must apply an adequate factor of safety, and provide for the necessary
leeway for proper operating and maintenance conditions.

Rule 11. When he discovers faulty or unsafe devices, equipment, or machinery in any place,
work or plant, he shall without delay, give notice thereof to the proper authority, public or private, for
the immediate and effective correction, regardless of whether or not he is responsible for said place,
work or plant.

IV. RELATIONS WITH LABOR

Rule 12. The mechanical engineer shall recognize labor as one of the major resources of our
country. He must acknowledge that a working man is not a mechanical robot but a human being.

Rule 13. He shall be familiar with the State policies on Labor and Social Justice, as well as
labor and social legislation and shall observe faithfully these policies and laws in his dealings with
labor in general, and with his workmen in particular.

Rule 14. He shall strive to improve the skills of his workmen, pay them a fair living wage, and
instruct them on how to prevent accidents in their place of work.

V. RELATIONS WITH CLIENTS AND EMPLOYERS

Rule 15. The mechanical engineer shall observe punctuality in his appointments, perform
honestly and in good faith his contractual obligation and his duties and obligations to his client or
employer, and observe fair dealing in his relations with his clients and employers.

Rule 16. He shall treat with confidentiality any information obtained by him as to the business
affairs and technical methods or processes of a client or employer.

Rule 17. He shall inform his client or employer of his business connections, interests, or
affiliations which may influence his judgment, or impair the quality or character of his services.

Rule 18. The mechanical engineer is entitled to a just and fair compensation for his services.
In the computation of such compensation, the period of time consumed, his knowledge, skill,
experience, and reputation, and the depreciation of instruments and materials used, shall be
considered and accorded such weight as is just and reasonable.

Rule 19. He shall accept compensation, financial or otherwise, for his services from his client
or employer only. He may agree to, or receive compensation from any other source only with the full
knowledge and consent of all parties concerned.

Rule 20. The mechanical engineer shall be completely above suspicion or reproach in his
relation with his clients or employers, avoiding the remotest reference or relation to any secret or
questionable agreement on commissions or other financial considerations promised by or received
from any person or entity other than his client or employer.

VI. RELATIONS WITH COLLEAGUES AND ASSOCIATES

Rule 21. To thane own self be true and thou cannot be false to any man - expresses the duty
which a mechanical engineer owes to himself and to others.
Rule 22. The mechanical engineer shall use only fair means to gain professional
advancement. In the pursuit thereof he shall not injure the work or employment opportunities of others
or use any improper or questionable method of soliciting employment or clientele.

Rule 23. He shall refrain from association with, or allowing the use of his name by, any
person or entity of questionable reputation.

Rule 24. He shall provide the opportunity and the means to improve and advance the
knowledge, skills, and experience of his colleagues and associates.

Rule 25. He shall define clearly the line of authority and scope of responsibility of his
associates and assistants. Orders, or the recall thereof, shall be issued through proper channels.

Rule 26. He shall be receptive to new ideas and suggestions from others, and ready to
recognize, encourage, and accredit the authors thereof. Suggestions from colleagues and associates
shall be given more careful attention.

Rule 27. He shall use tact and discretion in dealing with his colleagues and associates, but
not at the sacrifice of firmness. He shall work out difficult problems with courage and serenity.

Rule 28. Careful selection of understudies shall be a guiding principle, and preference shall
be given to those with adequate engineering education.

Rule 29. He shall not expect others to face danger that he himself will not face. He shall
observe at all times safety requirements for the protection of all concerned.

Rule 30. The mechanical engineer shall actively support the duly accredited association with
the end in view of enhancing the practice of the profession and discharging his public responsibilities
as professional.
