Barangay Executive Order No. 08 Series of 2021

AN ORDER CREATING THE BARANGAY DEVOLUTION TRANSITION


COMMITTEE (BDTC) OF BARANGAY SAN CARLOS, CITY OF VALENCIA,
BUKDINON AND FOR OTHER PURPOSES.
WHEREAS, Section 6, Article X of the Constitution provides that local government
units (LGUs) shall have a just share, as determined by law, in the national taxes which shall be
automatically released to them;

WHEREAS, in Mandanas et al. v. Executive Secretary, the Supreme Court held that all
collections of national taxes, except those accruing to special purpose funds and special
allotments for the utilization and development of the national wealth, should be included in the
computation of the base of the just share of LGUs;

WHEREAS, pursuant to the aforesaid Mandanas Ruling, the President of the Philippines
issued Executive Order No. 138 s. 2021 implementing the full devolution of certain functions of
the executive branch to the local governments and mandating the creation of a committee on
devolution;

WHEREAS, the implementation of the Mandanas Ruling will bring in a significant


amount of additional financial resource to the city starting Fiscal Year 2022 that will provide for
a substantial amount to fund for the provision of basic services and facilities to the city’s
constituents;

WHEREAS, cities and municipalities shall guide and support their component barangays
in the assumption of their new roles and responsibilities including the development and
implementation of their DTPs and capacity development requirements;

WHEREAS, there is a need to create the Barangay Devolution Transition Committee


(BDTP) to carry on the mandate given by the President for a smooth transition and
implementation of the Mandanas Ruling within the Barangays;

NOW THEREFORE, I, MARIZA T. LABE, Punong Barangay of Barangay San Carlos, by


virtue of the powers vested in me by law, do hereby order to create Barangay Devolution
Transition Committee (BDTC) of Barangay San Carlos, defining its composition, roles and
responsibilities, as follows:

SECTION 1. COMPOSITION. The Barangay Devolution Transition Committee (BDTC) of


Barangay San Carlos is hereby created to be composed of the following:
Chairperson : Mariza T. Labe Punong Barangay
Members: Lanel Jane E. Quintanes Sangguniang Barangay Member
Willard O. Devila Sangguniang Barangay Member
Ronel R. Malunes Barangay Secretary
Marian S. Gencianos Barangay Treasurer
Imelda A. Labitad San Carlos Unified Farmers Association
(SACUFA) President -Registered CSO
Ceasar Ayan A. Sibog Active Youth Organization of San Carlos
(AYOSCA President -Registered CSO

SECTION 2. DUTIES AND FUNCTIONS. The Barangay Devolution Transition Committee


(BDTC) shall perform the following duties and functions:

1. Prepare the Barangay Devolution Transition Plan (BDTP) based on Presidential


Executive Order No. 138 s. 2021 and its Implementing Rules and Regulations (IRR);
2. Evaluate the status of the implementation of administrative and fiscal decentralization
within the Barangay that is consistent with the goals of Executive Order No. 138 s.
2021;
3. Resolve issues and concerns that may arise in the implementation of the Executive
Order No. 138 s. 2021 in the Barangay, without prejudice to the respective mandates
of the affected National Government Agencies (NGAs) in individually resolving the
same;
4. Develop a strong information, education and communication campaign and pursue
strategies to effectively inform the public, as well as other stakeholders, on the
delineation of the function between the NGAs and Barangay Government, and their
respective accountabilities;
5. Adopt mechanisms to ensure continued delivery of public services by the affected
NGAs and the City itself during the transition period to full devolution;
6. Recommend rules, regulations and guidelines for the effective devolution transition to
be issued by the Punong Barangay as may be appropriate;
7. Submit to the Punong Barangay a quarterly status report on the progress of the
devolution transition which shall include assessment and recommendation to
accelerate the assimilation of the devolved functions;
8. Develop a strong communication plan and pursue strategies to effectively inform the
public, as well as other stakeholders on the delineation of the functions between
NGAs and their respective accountabilities;
9. Submit the Barangay Devolution Transition Plan.

SECTION 3. SECRETARIAT. A Secretariat of the BDTP is hereby created to be composed of


the Barangay Secretary and Treasurer:

Barangay Secretary: RONEL R. MALUNES

Barangay Treasurer: MARIAN S. GENCIANOS

SECTION 4. DUTIES AND RESPONSIBILITIES OF THE SECRETARIAT. The


Secretariat shall perform the following duties and responsibilities:
1. Act as secretariat to the BDTC;
2. Formulate the draft of the Barangay Devolution Transition Plan (BDTP) and submit it to
the BDTC for assessment and improvements;
3. Coordinate and gather the cooperation of the concerned NGAs on the importance of the
Barangay Devolution Transition Plan;
4. Gather data on the role of the Barangay relative to its mandate as outlined in Section 17
(Basic Services and Facilities) of Republic Act 7160;
5. Finalize the BDTP with endorsement by the BDTC for approval by the Sangguniang
Barangay.
6. Update and revise the BDTP as may be advised by the BDTC.
SECTION 5. FUNDING. The Barangay will allocate necessary financial resources to fund the
activities relative to the formulation of the BDTP.

SECTION 6. EFFECTIVITY CLAUSE. This Executive Order shall take effect immediately
upon the date hereof and shall remain in effect until rescinded.
