Scenario:

Hello good day everyone, and also good to our professor/ police
investigator Chiffer Ventura.
I am the team leader of Group 5, and were here to present our legal forms
regarding the theft incident happened at Atty. Marquez boarding house,
room E-7 located at Green-Field St. Brgy., Conception Uno, Marikina City.
First, in our scenario the victim named Sherlin Liezel Pena, 23 years old,
working as a pawnshop clerk, single, native of Bicol and presently residing
at the above-mentioned residence and occurrences. The victim personally
appeared to the station of Pcp-7 and she requested to put on record the
theft incident in her location which is Atty. Marquez boarding house, room
E-7 located at Green-Field St. Brgy., Conception Uno, Marikina City.
The crime happened because he entrusted her room and her valuable item
specifically her jewelry box that contains of precious jewelries to her newly
board mate named, Kristine Baltazar Rodriguez alias “Gee”, 24 years of
age, service crew, single, native of Bicol, presently residing at Atty.
Marquez boarding house, room E-8 located at Green-Field St. Brgy.,
Conception Uno, Marikina City.
In this scenario, before victim reported the incident, her close friend as a
witnessed of this case named, Rosalle Terana Dela Cruz, 24 years of age,
care taker of Atty. Marquez boarding house, single, native of Bacoor,
presently residing No. 93 Jade St. McDonald Ave, Brgy., Conception Uno,
Marikina City at about 9:20 AM of September 11, 2020 while the victim is
working and on-duty as pawnshop clerk through cellphone call.
Since the witnessed is on-duty as care taker of the said establishment and
after checking the other rented rooms, she decided to inspect the lightings
and alarm system of rented of the said victim, while inspecting she
suddenly heard a loud noise inside the rented room of the victim which is
the room E-7. In her curiosity, she took a sneak peek in-front window of
the said room of victim, she noticed and identified the woman inside the
room was Kristine Baltazar Rodriguez, she noticed that Kristine appeared to
be anxious and she’s carrying a jewelry box. She identified the type of
clothing of the said suspect wearing trouser pants and black t-shirt with
markings “Classy and Savage”. At around 9:30 a.m. on the same day, the
witness foresaw the incident in which the suspect anticipated the possibility
of obtaining personal information without the owner's knowledge or
consent. "What exactly is going on? Allow me to get inside!" the witness
exclaimed non-verbatim as he knocked on the door. The witness used the
master key to gain access to the leased room. Unfortunately, the suspect
escaped through the leased room's back door.
At about 9:50 AM of the same date, the victim immediately returned to her
rented room, where she discovered that her jewelry box with markings
“Fancy Sherlin” was missing and contained the following: two (2) Clover
Bracelet 18k Yellow Gold a total value of ₱8,000.00, two (2) Rose & White
Gold Glamira PH a total value of ₱12,000.00 and one (1) pair of White/Gold
diamond Glamira PH earrings worth ₱10,000.00. According to initial
investigation and based on the CCTV footage of Atty. Marquez boarding
house, at about 9:40 AM of September 11, 2020 the suspect used the rear
rented room of the victim to escaped in the incident and wearing trouser
pants and blue t-shirt with markings “Classy and Savage”. The suspect had
started to leave the place of the incident by moving quickly with short
steps taking general direction to the north. At about 10:30 AM of
September 11, 2020, the Marikina City Police Station Pcp-7 flashed the
report and message regarding the alleged theft incident happened at Atty.
Marquez boarding house located Green-Field St. Brgy., Conception Uno,
Marikina City and alarm to all units of PNP Marikina City with the order to
apprehend the suspect carrying a jewelry box with markings “Fancy
Sherlin”, and wearing trouser pants and blue t-shirt with markings “Classy
and Savage” ordered by PSMS. Adrian G. Villanueva. One of the units of
the PNP Marikina City reached by the alarm was its TMRU unit of
Conception Uno Police Sub-Station and at about 10:35 AM of September
11, 2020, the two (2) members of TMRU unit, then they boarded their
motorcycle mobiles and roamed and patrolled along Green-Field St. Brgy
Conception Uno, Marikina City. The responding police officers named, PCpl.
Eduardo G. Marquez (Plate No. TE-1113) and PSSg. Juanito G. Cruz (Plate
No. TE-1114). The two (2) police officer of TMRU unit spotted the suspect
about 4 meters away from their pathway, carrying a jewelry box and
wearing trouser pants and blue t-shirt with markings “Classy and Savage”,
they switched on the siren and strobe light and drove out to intercept the
suspect.
As the suspect was running away, they cut into the path of the suspect
forcing it to stop. At about 10:36 AM of September 11, 2020 as the senior
officer, PSSg. Juanito G. Cruz calls the radio operator named, PSMS. Mike
D. Enroque to verify the veracity of the theft incident and the suspect that
wearing trouser pants and blue t-shirt with markings “Classy and Savage”
and requested for immediate back-up and police mobile. PCpl. Eduardo G.
Marquez spotted the jewelry box with markings “Fancy Sherlin” that
contains the above-mentioned stolen items and it will serve as evidence,
and told the suspect about the alleged theft incident happened at Atty.
Marquez boarding house located at Green-Field St. Brgy., Conception Uno,
Marikina City. She surrenders freely and admits to the crime she
committed. Thereafter, at about 10:39 of September 11, 2020 they
properly secure and used handcuffs for protection.
The suspect identified herself as Kristine Baltazar Rodriguez alias “Gee”, 24
years of age, service crew, single, native of Bicol, presently residing at
Atty. Marquez boarding house, room E-8 located at Green-Field St. Brgy.,
Conception Uno, Marikina City. Thereafter, at about 10:50 AM of
September 11, 2020 the police mobile arrived in the place where the
suspect arrested with (Plate No. TE-1012), and about 11:00 AM of
September 11, 2020 they bring the arrested suspect to the nearest police
station located at 66 Lilac St. Conception Uno, Marikina City Pcp-7 for
further investigation and disposition.
Summary of Blotter Report:
The Entry number of our Blotter report is E-000784477 dated on
September 11, 2020 at about 10:20 AM. The victim personally appeared in
station of Pcp-7 at located at Conception Uno, Marikina City and she
requested to put on record on the alleged theft incident at her present
residing at Atty. Marquez boarding house, room E-7 located at Green Field
St. Brgy., Conception Uno Marikina City.
In this blotter report she indicates the general information of the said
suspect named Kristine Baltazar Rodriguez alias “Gee”, 24 years of age,
service crew, single, native of Bicol, presently residing at Atty. Marquez
boarding house, room E-8 located at Green-Field St. Brgy., Conception
Uno, Marikina City.
The victim entrusted the valuable item, namely the jewelry box inside the
victim's white cabinet, to her newly board mate by asking her newly board
mate to secure her rented room as much as possible while she was on-
duty as Pawnshop clerk.
At about 9:20 AM of September 11, 2020 while the victim is working and
on-duty as pawnshop clerk she received a cellphone call coming from her
close friend as witnessed named, Rosalle Terana Dela Cruz, 24 years of
age, care taker of Atty. Marquez boarding house, single, native of Bacoor,
presently residing No. 93 Jade St. McDonald Ave, Brgy., Conception Uno,
Marikina City. According to witnessed, while she was on duty as caretaker
at Atty. Marquez boarding house, she’s inspecting and supervising the
building including the lighting and alarm systems of every rented room.
When the witnessed start to inspect the rented room of Sherlin Liezel Pena,
she suddenly heard a loud noise inside the rented room. At that moment,
she took a sneak peek at in-front window of rented room and she saw a
woman that wearing trouser pants and blue t-shirt with markings “Classy
and Savage” and she identified it as Kristine Baltazar Rodriguez. Therefore,
Kristine Baltazar Rodriguez appeared to be sweating with anxious energy
throughout her observation carrying the jewelry box of victim. The rented
room is scattered of belongings of victim, and all drawer boxes of white
drawer is widely opened.
The jewelry box with markings “Fancy Sherlin” was missing and
contained the following: two (2) Clover Bracelet 18k Yellow Gold a
total value of ₱8,000.00, two (2) Rose & White Gold Glamira PH a
total value of ₱12,000.00 and one (1) pair of White/Gold diamond
Glamira PH earrings worth ₱10,000.00.
The witness foreseen the incident that the suspect has anticipated
the potential for personal gained without the knowledge and consent of the
owner.
Thereafter, at about 10:50 AM of September 11, 2020 the police
mobile arrived in the place where the suspect arrested with (Plate No. TE-
1012), and about 11:00 AM of September 11, 2020 they bring the arrested
suspect to the nearest police station located at 66 Lilac St. Conception Uno,
Marikina City Pcp-7 for further investigation and disposition.

Summary of Spot Report:
According to this Spot Report this pertains about the Alleged theft incident
happened at Atty. Marquez boarding house, room E-7 at Green-Field St.

000784477 dated September 11, 2020.
The witnessed reported and requested to put on record the alleged theft
incident in her residing residence at about 10:20 AM of September 11,
2020.
The victim named Sherlin Liezel Pena, 23 years of age, Pawnshop clerk,
single, native of Bicol, presently residing at Atty. Marquez boarding house,
room E-7 located at Green-Field St. Brgy., Conception Uno, Marikina City.
And the witnessed named Rosalle Terana Dela Cruz, 24 years of age, care
taker of Atty. Marquez boarding house, single, native of Bacoor, presently
residing No. 93 Jade St. McDonald Ave, Brgy., Conception Uno, Marikina
City.
Initial investigation disclosed that on the said TDPO, witnessed named,
Rosalle Terana Dela Cruz, 24 years of age, care taker of Atty. Marquez
boarding house, single, native of Bacoor, presently residing No. 93 Jade St.
McDonald Ave, Brgy., Conception Uno, Marikina City. According to
witnessed, while she was on duty as caretaker at Atty. Marquez boarding
house, she’s inspecting and supervising the building including the lighting
and alarm systems of every rented room. When the witnessed start to
inspect the rented room of Sherlin Liezel Pena at room E-7, she suddenly
heard a loud noise inside the rented room. At that moment, she took a
sneak peek at in-front window of rented room and she saw a woman that
wearing trouser pants and black t shirt with markings “Classy and Savage”
and she identified it as Kristine Baltazar Rodriguez. Therefore, Kristine
Baltazar Rodriguez.
The witness foreseen the incident that the suspect has anticipated the
potential for personal gained without the knowledge and consent of the
owner. The victim immediately returned to her rented room, where she
discovered that her jewelry box with markings “Fancy Sherlin” was missing
and contained the following: two (2) Clover Bracelet 18k Yellow Gold a
total value of ₱8,000.00, two (2) Rose & White Gold Glamira PH a total
value ₱12,000.00 and one (1) pair of White/Gold diamond Glamira PH
earrings worth ₱10,000.00.
Based on the CCTV footage of Atty. Marquez boarding house, at about
9:40 AM of September 11, 2020 the suspect used the rear rented room of
the victim to escaped in the incident and wearing trouser pants and blue t-
shirt with markings “Classy and Savage”. The suspect had started to leave
the place of the incident taking general direction to the north.
At about 10:30 AM of September 11, 2020, the Marikina City Police Station
Pcp-7 flashed the report and message regarding the alleged theft incident
happened at Atty. Marquez boarding house located Green-Field St. Brgy.,
Conception Uno, Marikina City and alarm to all units of PNP Marikina City
with the order to apprehend the above-mentioned suspect.
The responding police officers named, PCpl. Eduardo G. Marquez (Plate No.
TE-1113) and PSSgt. Juanito G. Cruz (Plate No. TE-1114). The above-
mentioned suspect was apprehended based on the report of victim the
message alert of Pcp-7, and the above-mentioned stolen items were
properly secure and would be returned to the victim.

Progress Report In the first part of our progress report it indicates the
reference, in our reference it pertains the blotter entry no. 000784477
dated September 11, 2020 and it is based on our spot report which is
alleged theft incident happened. In our Matters Investigated, it indicates
here the incident happened in the boarding house of Atty. Marquez at E-7
at Green-field st, Brgy. Concepcion Uno, Marikina City and it Investigate
here the person which is the victim and suspect and also the time of the
incident happened and how was the incident happened.
In our facts of the case On or about 9:00 AM of September 11, 2020 The
victim Sherlin Liezel Peña having a work at that day that's why she ask a
favor to her board mate to secure their rented room and then her board
mate Kristine Baltazar Rodriguez Alias Gee which is the suspect agree that
she stay at their rented room to secure it.
At about 9:20 AM of September 11, 2020 the victim is at her work then she
receives a call from her close friend which is Rosalle Terana Dela Cruz the
witnessed and the caretaker of the boarding house of Atty. Marquez. The
witnessed is the one who inspecting and supervising every room of the
boarding house and suddenly the witnessed hear a load noise at the
victim’s room and she took a sneak peak in front of the window and she
saw the board mate of the victim which is Kristine Baltazar Rodriguez. At
about 9:30 AM the suspect did her personal interest which is to gained the
personal belongings of the without the knowledge and the consent of the
victim. And at about 9;40 alam of September 11, 2020 the suspect saw at
the cctv of the boarding house and she used the rear door of the rented
room to escaped.
The victim returned to her rented room and she notice that her personal
belongings is gone which is the clover bracket yellow gold total value of 8
thousand and two rose and white gold glamira oh total value of 12
thousand and 1 pair of white gold glamira total value of 10 thousand. And
at about 10:30 of September 11, 2020 the Marikina City Police Station PCP
7 flashed the report regarding to the alleged theft incident happened. And
the two members of TMRU which is PCpl. Eduardo G. Marquez and PSSg.
Juanito G. Cruz conduct roaming and patrolled at the green-field street,
Brgy. Concepcion Uno, Marikina city.
Those two police officers apprehend the suspect and the stolen property
were properly secure and returned to the victim. PCpl. Eduardo G. Marquez
and PSSg. Juanito G. Cruz given their sworn statement at Concepcion Uno,
Marikina City, PCP 7 at 12:10 PM of September 11, 2020 and the Witness
Rosalle Terana Dela Cruz given her sworn statement at Concepcion Uno,
Marikina City, PCP 7 regarding in the alleged theft incident happened. And
the victim Sherlin Liezel Peña given her sworn statement 12:20 PM of
September 11, 2020.
IV. DISCUSSION
17. The case of theft in paragraph 1 of Article. 308 of the Revised Penal
Code (Theft) and being prepared by this station for inquest before the
office of the City Prosecutor.
V. DISPOSITION/ RECOMMENDATION
18. Further development of this case will be sent to the office as soon as
obtained.

Summary of Affidavit of Complaint:
In the Affidavit of Complaint, first she stated her name Ms Sherlin Liezel
Peña, her age, and other informations about her. Then, after being sworn
in conformity with the law, she declares that she filed a complaint against
Ms. Kristine Baltazar Rodriguez alias "Gee" because on September 11,
2020, the accused did then and there willfully, unlawfully, feloniously, and
by means of taking of personal property, committed THEFT.
According to the complainant, about 9:00 am on September 11, 2020, she
left her rented room to her new board mate or the accused person to
secure her rented room while she was on-duty. Around 9:20 am of the
same date, she received a call from her friend and also the caretaker of the
boarding house named ROSALLE TERANA DELA CRUZ.
She called because she was startled when she heard a loud noise inside
and she looked through the front window of the leased room and
recognized Kristine Baltazar Rodriguez. The witness saw the accused
holding the jewelry box. The stuffs of the complainant are scattered over
the rented room, and all of the white drawer boxes are wide open. Using
the master key, the witness entered the rented room. Unfortunately, the
suspect was able to flee through the rented room's back door. The
complainant stated the contents of the jewelry box. A two (2) Clover
Bracelet 18k Yellow Gold a total value of ₱8,000.00, two (2) Rose & White
Gold Glamira PH a total value of ₱12,000.00 and one (1) pair of White/Gold
diamond Glamira PH earrings worth ₱10,000.00.
That the complainant performs this affidavit to attest to the truth of the
aforementioned statements, and to charge KRISTINE BALTAZAR
RODRIGUEZ alias "Gee" with the crime of THEFT under Article 308 of the
Revised Penal Code.

Summary of Affidavit of Arrest:

AFFIDAVIT OF ARREST This affidavit of arrest is based on our cased
scenario in the above mentioned. At about 10:30 AM of Sept 11 2020 the
Marikina City Police Station Pcp-7 flashed the report and message
regarding the alleged theft incident happened at Atty. Marquez boarding
house located Green-Field St. Brgy., Conception Uno, Marikina City and
alarm to all units of PNP Marikina City with the order to apprehend the
suspect carrying a jewellery box with markings “Fancy Sherlin”, and
wearing trouser pants and blue t-shirt with markings “Classy and Savage”
ordered by PSMS. Adrian G. Villanueva.
We Pcpl. Eduardo G. Marquez together with my partner PSSg. Juanito G.
Cruz received a radio call to PSMS Adrian Villanueva and after that we
immediately drove our motorcycle mobile to patrol to the said vicinity. After
they got the markings of the said suspect, when they are patrolling the
area, they spotted a woman carrying a jewellery box and wearing trouser
pants and blue t-shirt with markings “Classy and Savage”, and then
immediately intercept the suspect. The suspect didn’t know what to do so
she ran away but the TMRU officers cut in her path to stop.
After that they call the radio operator to verify the veracity of the said theft
incident and when they confirmed it, they immediately call for back up and
police mobile. The suspect named as Kristine Baltazar Rodriguez alias
“Gee”, 24 years of age, service crew, single, native of Bicol, presently
residing at Atty. Marquez boarding house, room E-8 located at Green-Field
St. Brgy., Conception Uno, Marikina City. Admitted the crime she
committed.
After that they informed the offense and also her Constitutional Rights as
stated in Miranda Doctrine to the language known to her. PSSg. Juanito G.
Cruz properly secured and used handcuffs to the suspect for their
protection. At about 10:50 AM of September 11 2020 the police mobile
arrived in the place where the suspect was arrested and they bring it to the
nearest police station located at 66 Lilac St. Conception Uno, Marikina City
Pcp-7 for further investigation and disposition.

Summary of Affidavit of Witnessed:

AFFIDAVIT OF WITNESS Rosalle Terana Dela Cruz, 24 years of age, care
taker of Atty. Marquez boarding house, single, native of Bacoor, presently
residing No. 93 Jade St. McDonald Ave, Brgy., Conception Uno, Marikina
City., after having sworn in accordance with law, do hereby depose and
state:
1. That she present and personally saw that the accused, Kristine Baltazar
Rodriguez alias “Gee” committed the crime of Theft against the victim
Sherlin Liezel Pena.
2. She on duty as caretaker at Atty. Marquez boarding house, inspecting
and supervising the building including the lighting and alarm systems of
every rented room.
3. She suddenly heard a loud noise inside the rented room of Sherlin
Liezel Pena.
4. She took a sneak peek at in-front window of rented room and she saw a
woman that wearing trouser pants and blue t shirt with markings “Classy
and Savage” and she identified it as Kristine Baltazar Rodriguez.
5. She was the one who personally saw the alleged theft incident and she
saw Kristine Baltazar Rodriguez carrying a jewelry box with markings
“Fancy Sherlin” before and after she escaped from the rented room.
6. She identified it as a person wearing trouser pants and blue t shirt with
markings “Classy and Savage”. She executed this affidavit to attest the
truthfulness of the foregoing facts and to support the filing of Criminal
Case against Kristine Baltazar y Rodriguez alias “Gee” for the violation of
Article 308, paragraph 1 (Theft) of the Revised Penal Code.
AFFIANTS SAYETH NAUGHT. IN WITNESS WHEREOF, I hereunto affixed

The victim was identified as sherlin liezel peña and later upon the
investigation she has a room-mate who is identified as kristine baltazar
rodriguez alias gee, she is the new room-mate of the victim that she laterly
trust to look after her belongings like the jewelry box in the cabinet. at
9:2o am the victim receive a call from the witness identified as rosalle
terana dela cruz 24 years old a care taker of the atty marquez boarding
house and according to the witness she was supervising and inspecting the
boarding room of the victim she heard a loud noise inside the room and
she took a peek in the windom and found out that there was a woman
wearing trouser pants and blue-shirt with markings classy and savage that
was identified as the victimes board mate kristine baltazar rodriguez. and
without hesitation knock the door of the room but there was no response
without hesitation she laterly took the master key and open the door but
she found out that the suspect escape using the rear door of the room.
It also states the time the crime occurred which is on or about 9:30 AM at
the same time and date that the witness was present. and on or about
10:30 AM september 11, 2020 also reported the crime that occurred in the
said area, and Based on the CCTV footage of Atty.
Marquez boarding house, at about 9:40 AM of September 11, 2020 where
the suspect was seen in the victim’s room and its direction to escape the
crime committed The witness foreseen the incident that the suspect has
anticipated the potential for personal gained and also mentioned here the
items lost to the victim two (2) Clover Bracelet 18k Yellow Gold a total
value of ₱ 8,000.00, two (2) Rose & White Gold Glamira PH a total value ₱
12,000.00 and one (1) pair of White/Gold diamond Glamira PH earrings
worth ₱ 10,000.00. The above-named suspect was apprehended based on
the report of victim Pcp-7, and the above-mentioned stolen items were
properly secure and would be returned to the victim. The responding police
officers named, PCpl Eduardo G. Marquez and PSSg Juanito G. Cruz. PCpl
Eduardo G. Marquez (Plate No. TE-1113) and PSSg Juanito G. Cruz are the
responding police officers.
They boarded their motorcycle mobiles and roamed and patrolled along
Green-Field St. Brgy Conception Uno, Marikina City The above-named
suspect was apprehended based on the victim's report and the message
alert of Pcp-7. PCpl. Eduardo G. Marquez and PSSg. Juanito G. Cruz, has
given their sworn statements at the Conception Uno, Marikina City Police
Station. Kristine Baltazar Rodriguez alias "Gee" was inquest before the
Marikina City Prosecutors Office on September 11, 2020 and docketed
under NPS docket no. XX-69-TNT-0987 by inquest prosecutor Agatha
Zapanta De Jesus. The cases of paragraph 1 of Article 308 of the Revised
Penal Code (Theft) were filed against her Wherefore, in view of the
foregoing, the undersigned respectfully recommends that this case be
referred to Office of the Marikina City Prosecutors Office for final
disposition
