LEGAL NOTICE
Sir,
Under the instructions of our client Sri.Ratan Lal Signodia
S/o Late Nagarmal Signodia Age: about 70 years Occ: Business R/o
Hyderabad and power given in his behalf we issue the following notice to you
U/Sec.138 E of NI Act R/W Sec 420 of IPC as under.
Please take notice of the fact that you are the Authorised Director
of Breeze Promotional Concepts Private Limited who has taken the Flat No 306
on rent with a rental deed from our client at Purni Plaza ,Plot No 6-2-938,Raj
Bhavan Road ,Khairatabad Hyderabad-500004 by paying rent @ Rs 17000/-
per month since Dec 2013 and you (Breeze Promotional Concepts Private
Limited )have been a regular defaulter for paying the rent on time , and since
May 2014 our client has not received any rent till date, so the total amount of
rent due till February to our client from you (Breeze Promotional Concepts
Private Limited) is of 10 months which is totalling to Rs1,70,000/- and even
after many reminders and many request made by our client to you(Breeze
Promotional Concepts Private Limited) to pay the rent amount of Rs 1,70,000/-
for the 10 months you(Breeze Promotional Concepts Private Limited ) have
given a cheque on 01-02-2015 for an amount of Rs 40,000/- of State bank Of
India ,Hyderabad Public School , Ameerpet branch ,Hyderabad bearing No
“821686” and asked us to deposit the cheque and encash the amount ,and
promised to pay the balance Rent amount of Rs 1,30,000/- within a week time,
accordingly our client has presented the said cheque in his Bank account of
Federal Bank Abids Branch Hyderabad on 05-02-2015. Federal Bank Abids
Branch Hyderabad in turn the said cheque was sent to the SBI Bank
Hyderabad Public School ,Ameerpet branch ,Hyderabad for collection , but the
said cheque was bounced and returned unpaid stating that the “Funds
insufficient” and send back the said cheque to the Federal Bank Abids Branch
Hyderabad, and the said Bank in turn has informed to our client the said fact
through a cheque returned memo dated :-07-02-2015 along with the returned
unpaid cheque . So in view of your relation with our client our client has
informed you that the cheque has bounced and also requested to pay the
amounts ,but you have not turned up and not paid any amounts .
That the above facts clearly shows that you have issued a cheque with a
malafide intention to cheat our client knowing well that there is no amount in
your account of SBI Bank Hyderabad Public School ,Ameerpet branch ,
Hyderabad for the realisation of the cheque amount of ( Rs 40,000/- )and also
you have not arranged for the repayment of the cheque amount even inspite of
the sufficient time taken by you so it is clear that intentionally you have issued
the cheque to cheat our client so you are liable for the prosecution and
punishment U/Sec 138 E of NI Act R/W Sec 420 of IPC .
we there call up on you to pay back the cheque amount of Rs.40,000/-

(Rent amount ) to our client within 15 days from the date of receipt of this
Notice , failing which our client is forced to take necessary action in Civil and
Criminal against you in the court of law for the offences U/Sec 138 of NI Act
R/W Sec420 of IPC and also our client will proceed against you for the
recovery of the said amount of Rs 40,000/- with interest @24 % PA in a
competent Court and you will be held responsible for all the costs and
consequences thereof . Hence this notice.

Under the instructions of our client Sri.Ratan Lal Signodia
S/o Late Nagarmal signodia Age: 70 years Occ: Business R/o 2nd floor
Shanker Nivas, beside Purni Plaza , Hyderabad and power given in this behalf
we issue the following notice to you U/Sec.138 E of NI Act R/W Sec 420 of IPC
as under.
Please take notice of the fact that our client is the owner and possessor
of the flat no 306 , in Purni Plaza H.No. 6-2-938 &939 ,Raj Bhavan Road ,
Khairatabad, Hyderabad-500004 and you are the authorised director of the
“Breeze Promotional Concepts Private Limited” and for the purpose of running
business in that name you have taken one flat no 306 in Purni plaza
H.No. 6-2-938 & 939 ,Raj Bhavan Road ,Khairatabad Hyderabad-500004 on
rent from our client by executing a rental deed on 01-12-2013 agreeing to pay
the rent of Rs 17,000/- per month and occupied the premises. .you have paid
the rent only upto April 2014 and then completely stopped the payment of rent
till today keeping the rent for 10 months ,which totally come to Rs1,70,000/-.
All these period our client was going on demanding you for the payment of the
due rent and ultimately you have issued a cheque bearing no “821686” of State
Bank of India Hyderabad Public School Branch ,Ameerpet Hyderabad for Rs
40,000/- on 01-02-2015 in favour of my client and requested our client to
realize the same by presenting the said cheque and promising to pay the
balance of Rs 1,30,000/- within a short time . So our client has presented the
said cheque in his bank account of Federal bank Abids Branch Hyderabad on
05-02-2015 and in turn the said federal Bank has sent the said cheque for
collection to the SBI Hyderabad Public School Branch Ameerpet Hyderabad
,but the said cheque was bounced and returned unpaid stating that “funds
insufficient” and sent back to the said Federal Bank Branch Abids and the said
bank has informed to our client along with a Memo and returned unpaid
Cheque along with a memo stating that the cheque is returned unpaid due to
“funds Insufficient” .So our client has informed you about the returned unpaid
cheque and requested you to pay the amounts but you have not paid the
amounts.
Please take notice of the facts that you have issued a cheque with a
malafide intention to cheat our client knowingly well that there is no amount in
your account of SBI Hyderabad Public School Branch Ameerpet Hyderabad for
the realisation of the cheque amount of RS 40,000/- which is payable by you
legally to our client and also you have not arranged for the payment of the
cheque amount even in spite of the information given to you by our client ,so it
is clear that you have intentionally issued the cheque to our client which is
bounced and unpaid ,so you are liable for the prosecution and punishment of
Section 138(e) of NI Act R/W Sec 420 of IPC .
we there call up on you to pay back the cheque amount of Rs.40,000/-

(Rent amount ) to our client within 15 days from the date of receipt of this
