Module Description:

This Moudle examine various topic in criminal procedure and recording the evidence to
conclude the case in Pakistan. It is designed to explain and critique the legal rules pertaining to
the gathering of evidence , the court process , the admissibility of evidence at trial and post –
conviction sentencing, and other remedies. The module will include all provisions of the
Criminal Procedure Code, 1898

Learning Outcomes:
Upon successful completion of the module, students will be able to:

 Define the different terminology used in the field of administration of criminal justice.
 Discuss the general matters relating to criminal procedure.
 Identify , describe , and analyze specific aspect of criminal procedure through the
preparation of case briefs.
 Describe the law of arrest and its requirements.
 Explain the requirements for an admissible confession.
 Apply knowledge of general philosophy of criminal law and criminal responsibility,
 Describe principles of procedural law, in seminar discussion and written assessment
 Identify problems, causal theories, criminal types, and the implications of crime statistics.
 Understand the procedure and requirements for conducting interrogations.
 Give an overview of the organization and operation of administration of justice agencies..
 Analyze the legal liabilities and other consequences of police, prosecutorial, and judicial
misconduct.
 Differentiate between criminal procedures before, during and after trial.
 Demonstrate proficiency in case law, criminal procedure updates and custodial laws
 Identify right to counsel and trial rights issues
 Communicate effectively
 Recognize problem solving contexts
 Reflect on and explore effective learning strategies
 Critique existing legal rules
 Work with a detailed major statute governing most of the law on a single subject

Indicative Content:

o References and definitions of the words with their expression and meanings used in CrPC.
o Appointments of magistrate and power of criminal courts.
o Study the Power to frame rules for guidance of Benches ,
o Powers exercisable by Bench in absence of special directions ,
o Power to alter divisions and districts
o Powers exercisable by Bench in absence of special directions .
o Classes of criminal courts like Executive Magistrates , Judicial Magistrates Court of
Sessions , Forms of different special courts, anti terrorist court etc.
o How arrest is made?
o Resisting endeavour to arrest ,disclose Resisting endeavour to arrest,

o Power to break open doors and windows for purposes of liberation.


o Search and mode of arresting, When police may arrest without warrant
o Arrest of vagabonds, habitual robbers, etc.,
o Pursuit of offenders into other jurisdictions,
o Person arrested to be taken before Magistrate or officer in charge of police-station,
o Person arrested not to be detained more than twenty-four hours.
o Unlawful assemblies assembly to disperse on command of Magistrate or police officer,
o Use of civil force to disperse,
o Use of military force.
o Study about Public nuisances,
o Conditional order for removal of nuisance,
o Person to whom order is addressed to obey or show cause or claim jury,
o Magistrate may prohibit repetition or continuance of public nuisance.
o Procedure of prevention action by police,
o Prevention of injury to public property, Inspection of weights and measures.
o Information and investigation in to the police and their power of investigation, cognizable
and non- cognizable cases etc, .
o Power to hold investigation or preliminary inquiry,
o Examination of witnesses by police,
o Power to record statements and confessions,
o Release of accused when evidence deficient,
o Report of police-officer
o Charge, Charge to state offence,
o How stated where offence has no specific name,
o What implied in charge,
o Language of charge,
o Court may alter charge, recall of witnesses when charge altered.
o Trial of case by magistrate,
o procedure in cases, when accused shall be discharged ,
o Charge to be framed, conviction on admission of truth of accusation, Procedure when no
such admission is made, acquittal, sentence, withdrawal of complaint, power to stop
proceedings when no complainant.

Delivery:
A variety of teaching approaches are used, including lectures, seminars, case analysis, teamwork
and extensive use of the Internet for guided research.
