3. Work order No.1 dated 25 Feb 2020 was placed to contractor vide 118 RCC (GREF)
letter No. 947/18/E8 dated 25 Feb 2020 with date of commencement and phase wise completion
of work as under:-
4. The technical specification for construction of 70 m span bridge over Naigarh Nallah at
km 11.05 on Dul-Galhar road as per Contract Agreement are as under:-
5. Contractor has submitted the following site condition vide their letter No SGF/5130 dated
20 May 2021:-
(a) On Galhar side, the subsoil at the location of abutment consists of SMB and during
the process of excavation, lot of rainfall/snowfall occurred and which disturbed and
damaged the ledge. After achieving the founding level of RL 1528.00 mtr, the required
ledge of 3 mtr is not available for complete foundation area and ledge is available only for
2/3 of the length of foundation.
(b) Further, the excavation till founding level for the abutment of Dul side was done
and the dimensions of the foundation were laid out on ground. It was observed that the
minimum ledge of 3 mtr was not available at founding level of Dul side also.
(c) If the ledge of 3 mtr is maintained on Galhar side, the ledge available on Dul side is zero.

(d) Considering the safety of the proposed bridge and to ensure the availability of 3
mtr ledge on founding level for both abutments, the span of the bridge required to be
increased from 70 mtr to 75 mtr with founding level of Galhar side abutment from RL
1528.00 mtr to RL 1527.00 mtr. The parameters of the proposed bridge submitted by the
contractor are as under:-
6. Accordingly the proposal for increasing the span of bridge from 70 mtr to 75 mtr with
downward revision of founding level of Galhar side abutment from RL 1528.00 mtr to RL
1527.00 mtr was submitted for the approval of competent authority.
7. Accordingly, approval for increasing the span of Naigarh bridge from 70 mtr to 75 mtr with
founding level of Galhar side abutment from RL 1528.00 mtr to RL 1527.00 mtr has been
accorded by HQ DGBR vide letter No.40796/Naigarh Bridge/Beacon/DGBR/39/B&T Dte dated
30 Sep 2021.(Flag-B)
8. Contractor has requested to amend the cost of the contract as per Annexure -1 to
Schedule ‘A’ Notes of the subject CA vide their letter No. SGF/5567 dated 08 Dec 2021.
Keeping in view of above changes approved by the competent authority, claim for plus deviation
as requested by the contractor on account of increase in span and height of substructure is
admissible as per Annexure -1 to Schedule ‘A’ Notes of the subject CA.
9. The increase in span and depth of substructure, leads to increase in the cost of contract.
As per Annexure- to Schedule-“A” of tender document on Page No. 92, Increase/decrease of
height of substructure, increase/decrease of bridge length formula are as under:-
= 0.75 x 69500000
6.00 mtr (AI) + 12.50 (A2) +70 Mtr
Therefore net increase in cost due to increase of 1.00 mtr (i.e 1528.00-1527.00) height of
substructure
= 1 x 588983.00
= Rs. 5,88,983.00
Net increase in cost due to increase of 5.00 mtr (i.e 75.00-70.00) span
= 5 x 588983.00
= Rs 29,44,915.00
9. In view of the above, Increase in height of substructure and span of Naigarh bridge at Km
11.05 on D-G road to 1 mtr (RL-1528 M - RL 1527 M) and 5 mtr (70 M – 75 M) respectively is
inevitable as per the ground requirement. The total deviation in cost now comes to
Rs. 35,33,898.00 (+) 5.08% which is well within the deviation limit of + 10% of Chief Engineer in
consultation with IFA as per policy vogue by HQ DGBR letter No. 24228/BRO Policy/2020/07/E8
dated 12 Mar 2020. Hence, it is recommended that the approval of competent authority may be
accorded for proposed plus deviation for the subject contract.

3. SSI & PLT have been carried out a both side i.e. Galhar Side and Dul Side as per FBS
and GAD issued by HQ DGBR and including amendment issued vide letter No. 40796/Naigarh
Br/Beacon/DGBR/39/RBAT Dte dated 30 Sep 2021.
4. The SBC as per PLT carried out on RL 1527.00 on Galhar side is 47.60 T/Sqm, as per
SSI on RL 1528.267 is 45.88 T/Sqm, and at Dul side as per SSI on RL 1534.49 is 80.15 T/Sqm.
As per approved design and drawing SBC recommended at DUl side is 40 T/Sqm and found RL
is 1534.500 m, at Galhar side SBC recommended is 40 T/Sqm and found RL 1527.00 m.
5. Abutment drawing of Dul side and Galhar side has been received duly proof checked by
IIT Bombay, Powai, Mumbai-76 vide KD/BRO/2020/BEACON/NAIGARH/75M/SUB-001 dated 27
Oct 2021 and KD/BRO/2020/BEACON/NAIGARH/75M/SUB-002 dated 27 Oct 2021. The
drawing of abutment also approved by HQ DGBR vide letter No. 40796/Naigarh
Br/Beacon/DGBR/45/RBAT Dte dated 12 Nov 2021.
6. Excavation of foundation for abutment Dul side (A1) RL 1534.500m and Galhar side (A2)
upto 1527.00 m has been completed upto foundation level (PCC leveling course 100 mm thick)
as per drawings. The abutment size at Dul side A1 is 15.300 m x 7.500 m and at Galhar side A2
is 15.300 m x 11.290 m.
8. Inspection note for approval of foundation is placed opposite for necessary endorsement
of Chief Engineer (Accepting Officer).

through execution contract for Rs 781.91 Lakh excluding QCC Charges.

10. It may be seen from above that the L1 quoted rates are 15% to 24% higher when
compared with previously accepted CA by Project Beacon as well as 11.11% lower compared
with Adm Approval rates.
11. Total amount of L1 tenderer is minus 11.11% of AA provision which is within permissible
limit, hence Financial Concurrence from next CFA is not required to accept the lowest tender.
12. TS has been issued vide HQ CE (P) Beacon letter No. 200090/TS/35TF/ 04 /E2 Works
dated 20 Jul 2019 with provision for execution contract for Rs 781.91 Lakh excluding QCC.
13. The fund has been allotted to 35 BRTF against Job No. 248/31(BCN) to the tune of
Rs 40.31 Lakh for financial year 2019-20. Total expenditure against this Job up to Sep 2019 is
Rs 0.00 Lakh against total cost of work Rs 974.90 Lakh.
14. The firm SGF Infra Pvt Ltd is enlisted firm with HQ DGBR in Class-S-68 vide HQ DGBR
letter No. 24149/DGBR/SGF/114/E8 dated 18 Aug 2017.
15. As per condition 26.1 of Special Condition of Contract Agreement, a separate letter to be
issued for deposition of Performance Security Deposit (i.e 5% of total value of contract) to the
tune of Rs 34,75,000.00 (Rupees Thirty Four Lakh Seventy Five Thousand only) within 28
days of receipt of LoA/Acceptance Letter.
16. As brought out above, the rates quoted by L-1 tenderer are found to be competitive,
workable and reasonable.
RECOMMENDATION
17. The case is processed to AO (P) Beacon for their prior concurrence before acceptance of
contract.

1. The L1 rates quoted by M/s SGF Infra Pvt Ltd are found reasonable and competitive as
per analysis carried out as per Para 9 (a) to (j) ante note based on available accepted rates with
in (P) AOR, other (P)s in vicinity and other department’s comparable rates.
2. The L1 rates are higher when compared with recently accepted rates of 60 mtr steel truss
bridge on Galhar-Sansari road by about 15%. This hike in quoted rates, however, is justified due
to following reasons :-
(a) DESIGN ASPECTS :- As per the design calculations the steel truss superstructure
is designed for the bending movements which increase by the square of the increase in
length of the structure, there by increasing per mtr weight of steel of super structure and
on an average the weight of superstructure of a 60 mtr steel truss bridge is @ 2.5 t/m,
where as the weight of 70 mtr steel truss shall be in the range of 3.4 to 3.5 t/m including
the bolts.
In view of this there shall be a net increase of (0.9 X 70= 63) tonne steel for 70 mtr
bridge compared to 60 mtr steel truss bridge. This shall add to cost by about (0.50 X 63) =
Rs 31.5 lakh for a 70 mtr bridge in comparision to 60 mtr bridge.
(b) PECULIARITY OF BRIDGE SITE :- The bridge site of this 70 mtr bridge at Km
11.050 of Dul-Galhar road is peculier when compared with 60 mtr bridge at Km 0.022 on
Galhar-Sansari road due to restricted space for errection of the launching towers on Dul
side of 70 mtr bridge. Also the design discharge in river for this bridge being 146.66
cum/sec when compared with 60 mtr bridge were the discharge is 117 cum/sec. This high
discharge in river for 70 mtr bridge shall be a deterent for putting vertical props in river
bed to support the launching of steel truss, which is considered economical when
compared with all rope support launching of steel truss. This aspect shall certainly add to
the cost of launching of 70 mtr bridge comparison to a 60 mtr bridge at Km 0.022 on
Galhar-Sansari road.
3. In view of above it may be seen that the L1 quoted rates by M/s SGF Infra Pvt Ltd are
justified and competitive and a retender may not result into lower rates given limited bidding for
bridges in this area. It is also pertinent to mention that M/s SGF Infra Pvt Ltd were best suited to
quote, their competitive rates due to the fact that they already have two alloted bridge works in
the vicinity of this bridge, this is also quite evident when we compare the L1 and L2 bids in the
instant tender.

1. Reference observations of ACDA (P) vide note 18 ante, para wise clarifications are as
under :-
2. Para 1 & 2 :- The rates need to be compared with closest configration of span i.e either
wrt 60 mtr or 81 mtr bridge and not with 30 mtr bridge.
3. Para 3 :- The % hike in rate shall increase for larger span bridges compared to a smaller
span bridge i.e if we compare a 30 mtr bridge and a 60 mtr bridge the hike may be less but if we
compare a 70 mtr Br the hike shall be more.
4. Para 4 :- It is not correct to compare per mtr rate of a 30 mtr steel truss bridge with per
mtr rate of a 70 mtr steel truss bridge. It has already been clarified that the bending stresses for
which the steel truss is designed increase as a square of the length of bridge and hence the
quantity of steel does not linearly increase in a steel truss bridge. This point has been made
amply clear in para (a) note 17. It is also prudent to mention that ACDA (P) should then also
compare the rates of 81 mtr steel truss bridge of CVPP in the vinicity of the instant beidge site
(These rates are Rs 12.00 lakh/mtr). The rates for a similar configration bridge of 85 mtr in (P)
Udayak are Rs 13.57 Lakh/mtr. In view of above it may be seen that comparing per mtr rate of
30 mtr steel truss bridge with a 70 mtr steel truss bridge is akin to comparing apples and
oranges.
5. Para 5 :- The bidding for bridges in the AOR of 35 BRTF is limited to 2-3 bidders and
most of these being common, there are no new bidders participating in our successive bids. The
rates quoted by these common bidder are generally very high compared to the L1 bidder.
Following data may please be referred :-

6. Para 6 :- The facts of ACDA (P) wrt the working season on Dul-Galhar road are
wrong as there in no non working season on Dul-Galhar road for the bridge work. Any
delay in acceptance of contract would lead to delay in execution of bridge and hence the cost
escalation it may also be noted that the bridge tender have inbuilt escalation clause for labour,
material and POL and therefore any dealy in work keeps on adding to the cost of work
irrespective of the accepted bid price. It is also pertinent to mention that the L1 bidder already
have two alloted contracts for bridges in the vicinity of the present bridge site and hence he is
best suited to quote most competitive rates due low cost of estibishments and optimum
utilisation of machinery/manpower. This is also evident from the rates quoted by L2 bidder which
are 20.37% higher compared to L1 bidder.
7. In view of above it may be seen that retender shall not brings down the rates. On contrary
the rates may be higher in recall tender due to the price escalation/start of peak working season
in other sectors where prospective bidders may be more inclined to work compared to relatively
tough work site of the instant work.
8. It is also pertinent to menton that there shall always be a price variation in bids to the
extent of 10 to 15% for similar type of work depaending on market factors and we should not
always look out for rates equal to or less than LPP and loose time in acceptance and
commencement of work which ultimatelly results into cost escalation. It is a given fact that once
the reasonability of the price bid is established, the tenders need to be accepted without delay to
cut on cost escalation. In the same reference if the cost of extra steel required in a 70 mtr bridge
compared to a 30 mtr bridge i.e 49 lakh is taken out from the L1 rates, the L1 rates are in the
range of 13% higher compared to a 30 mtr bridge which are easily justified given extra effort to
launch a 70 mtr steel truss compared to a 30 mtr steel truss at a relatively tough site.
9. In view of above, it is recommended to forward case file to ACDA (P) to review and
concur the proposal to avoid delay in acceptance of tender.

rates quoted by the L-1 tenderer and CA already accepted in the AOR of Project Beacon for
Steel Super Structure bridges and as per Adm Approval rates are enclosed at Appendix–‘A”
(ii) 22% higher than the cost of work based on previously accepted CA No.CE
(P) BCN/20/2007-08 with escalation @ 86.22%. (Span of bridge 70 mtr)
(iii) 15% higher than the cost of work based on previously accepted CA No.CE
(P) BCN/12/2019-20 without escalation. (Span of bridge 60 mtr)
(iv) 24% higher than the cost of work based on previously accepted CA No.CE
(P) BCN/11/2019-20 without escalation. (Span of bridge 30 mtr)
(a) 15% lower than the cost of work based on previously accepted CA No.CE
(P) DPK/25/2010-11 with escalation @ 56.76%. (Span of bridge 360 mtr)
(b) 04 % lower than the cost of work based on previously accepted CA No.CE
(P) HMK/15/2019-20 without escalation. (Span of bridge 260 mtr)
(c) 21% lower than the cost of work based on previously accepted CA No.CE
(P) VJK/16/2019-20 without escalation. (Span of bridge 140 mtr)
(d) 27% lower than the cost of work based on previously accepted CA No.CE
(P) Udayak/15/2018-19 with escalation @ 2.92%. (Span of bridge 85 mtr)
(e) 17% lower than the cost of work compared with rate as per CVPP (at
Kishtwar). (Span of bridge 81 mtr)
(f) 25% lower than the cost of work compared with rates as per LAHDC with
escalation @ 2.92%. (Span of bridge 60 mtr)
8. The justification for acceptance of L1 rates has already been amply explained in note 17
and 19 ante.
9. Total amount of L1 tenderer is minus 11.11% of AA provision which is within permissible
limit, hence Financial Concurrence from next CFA is not required to accept the lowest tender.
TS PROVISION AND ALLOTMENT OF FUND
10. TS has been issued vide HQ CE (P) Beacon letter No. 200090/TS/35TF/ 04 /E2 Works
dated 20 Jul 2019 with provision for execution contract for Rs 781.91 Lakh excluding QCC.
11 The fund has been allotted to 35 BRTF against Job No. 248/31(BCN) to the tune of
Rs 40.31 Lakh for financial year 2019-20. Total expenditure against this Job up to Dec 2019 is
Rs 0.00 Lakh against total cost of work Rs 974.90 Lakh.
12. The firm SGF Infra Pvt Ltd is enlisted firm with HQ DGBR in Class-S-68 vide HQ DGBR
letter No. 24149/DGBR/SGF/114/E8 dated 18 Aug 2017.
13. As per condition 26.1 of Special Condition of Contract Agreement, a separate letter to be
issued for deposition of Performance Security Deposit (i.e 5% of total value of contract) to the
tune of Rs 34,75,000.00 (Rupees Thirty Four Lakh Seventy Five Thousand only) within 28
days of receipt of LoA/Acceptance Letter.

accepted CA by Project Vijayak as well as 1% lower compared with Adm Approval rates.
11. Total amount of L1 tenderer is minus 01% of AA provision which is within permissible
limit, hence Financial Concurrence from next CFA is not required to accept the lowest tender.
12. TS has been issued vide HQ CE (P) Beacon letter No. 200090/TS/35TF/ 15 /E2 Works
dated 12 Nov 2018 with provision for execution contract for Rs 242.42 Lakh excluding QCC

13. The fund has not been allotted to 35 BRTF against Job No. 248/26 (BCN) due to subject
Job was sanctioned on 24 Sep 2018 and tendering action is under progress during 2018-19.
Hence, fund is being allotted during the financial year 2019-20. Total expenditure against this
Job up to Jan 2019 is Rs 0.00 Lakh against total cost of work Rs 281.02 Lakh.
14. The firm SGF Infra Pvt Ltd is enlisted firm with HQ DGBR in Class-S-68 vide HQ DGBR
letter No. 24149/DGBR/SGF/114/E8 dated 18 Aug 2017. Accordingly SSD amounting to Rs.
11.00 Lakh has already been deposited by the firm and held with department. Security Deposit

2. Case file received from ACDA (P) Beacon duly concurred (with some conditions on issuance of
TS, Rates etc) as on dated 13 May 2017. It is intimated that as per proposed tendering schedule NIT for
the subject work is to be uploaded on 24 Apr 2017 (already expired). As a result of this, it is not feasible
to publish the NIT document as per the approved tendering schedule.

2. NIT for the subject tender has been issued to all concerned on 09 Jun 2016. As per tendering
schedule approved vide Note 13 dated 06 Jun 2017, tender for this work is to be published on CPP
Portal on 16 Jun 2017.
3. Accordingly, draft tender has been prepared and placed opposite please. A copy of this draft
tender document already e-mailed to HQ 35 BRTF vide Project letter No 800379/14/E8 dated 10 Jun
2017 for their comments if any by 13 Jun 2017 (1100 Hrs).

2. The ‘T’-Bid of the subject tender was downloaded from CPP Portal on 12th Jul 2017 through e-
tendering by the opening Board of Officers. Total two bidders have participated through online. All firms
have submitted the hard copy of mandatory document which was received from tender box by the BOO.

3. The BOO has evaluated the ‘T’-bids as per laid down criteria in the tender and the
recommendation of the BOOs received on 15th Jul 2017 are as under:-
a. M/s Harish Gupta, Recommended to open for 'Q' Bid on receipt of deficient documents
Udhampur wrt balance sheets for the year 2015-16 and 2016-17 as per tender
documents.
b. M/s New Jehlum Recommended to open for 'Q' Bid on receipt of deficient documents
Construction wrt balance sheets for the year 2016-17 and clarification wrt pending
Company, Jammu court cases submitted as NIL as per tender documents.
4. Further scrutiny of the documents submitted by the firms along with Technical Bid has been
carried out (details attached as Appx of this note sheet), the followings deficient are found for bidders :-

5. In view of the above, the present position of firms for opening of BOQ (Q-Bid) is as below:-

(i) Balance sheets. Firm submitted balance sheets for the year 2015-16 & Provisional
trading profit and loss statement for the year 2016-17. However firm already qualified for the value
of available bid capacity based on data of 2014-15, hence firm may be considered as meeting the
subject criteria.
(ii) Documents wrt HMP 45-60 Capacity. Firm again submitted sale deed certificate from M/s
Singla Truck Private Limited, Chandigarh.
(iii) Clarification wrt relation of firm with M/s Sharda Stone Crusher. The firm submitted
clarification on letter head as stated that “Neelam Gupta, is the sole proprietor of the firm
M/s Sharda Stone Crusher, situated at Dudher Nallah, Dhar Road Udhampur”.
Apart from proprietor of my own firm M/s Harish Gupta, Udhampur, I am also the
power of attorney holder of the firm M/s Sharda Stone Crusher, Udhampur. Neelam
Gupta, who is the proprietor of the firm M/s Sharda Stone Crusher, is my mother.
Therefore I can use / utilize the stone crusher / unit / machinery of M/s Sharda Stone
Crusher, Udhampur to the work allotted to my firm M/s Harish Gupta, Udhampur from my
crusher / unit. DIC of M/s Sharda Stone Crusher, is already attached with the affidavit
submitted by Mrs Neelam Gupta.
As per latest performance report received from TFs , the firm have two running works in
hand in our Project and overall performance of the firm is satisfactory. Further, no any adverse
performance against the contractor is known in writing from any source(s).
In view of above, the firm is recommended as qualified for opening of ‘Q’ bid.
(ii) Clarification wrt pending court cases. Firm submitted clarification wrt pending court
cases as “your attention here by invited to Para 06 of the affidavit for performance submitted by
us along with the tender documents which clearly mentioned that :-
I am not a habitual litigant i.e. having more than 3 unsuccessful arbitration / court cases
during last 5 years in which his his views / claims substantially rejected”
However clarification asked from firm as per clause No (v) at page No 08 of tender
documents :-
“Tenderer shall submit information of all arbitration/court cases decided
during last five years including current financial year and also presently in
progress on affidavit as per following format:-
In lieu of above details firm submitted as NIL on original affidavit No BH 853863 dated 04
Jul 2017 submitted as NIL, however a running court case No 320/2017 filed by Proprietor of the
firm against tender action action for tender No CE (P) BCN/13&14/2015-16.
In view of above, clarification submitted by firm not at satisfactory level, but may be
considered due to effect of this statement is non effective.
As per latest performance report received from TFs , the firm have only one running
execution contracts and subject already processed for foreclosed. Further, no any adverse
performance against the contractor is known in writing from any source(s).
In view of above, the firm is recommended as qualified for opening of ‘Q’ bid.

2. ‘Q’ Bid of subject tender will be opened on 10 Aug 2017 (120 0 Hrs). As new policy issued by HQ
DGBR vide their letter No 24228/DGBR/Gen/Policy/Fri/E8 dated 30 Aug 2013, “Market rate analysis for each items in a
tender shall be prepared considering all relevant factors and finalized and signed by Dir (Contract) before opening of ‘Q’ bid of
any road work and supply of material tender, if required rate of materials, effect of lead involved etc shall be ascertained by
