ARTICLES OF AGREEMENT
Made on Dated 13th Feb 2022, between OM SAI ENTERPRISES its office at SHOP NO.14,
VISHWAKARMA NAGAR, 60 FEET ROAD, NEAR IDBI BANK VASAI (WEST), PALGHAR
(hereinafter called “ THE CONTRATOR “)
AND
REGAL APARTMENT CO-OP. HSG SOC LTD Vijay-Vehar complex, Evershine city, Vasai (East) Palghar
Dist. (hereinafter called “THE EMPLOYER”)
Whereas the employer being serious of carrying out its Building Terrace Roof Work and its Rain
Water Lines Connection lines, for REGAL APARTMENT CO-OP. HSG SOC LTD Vijay-Vehar complex,
Evershine city, Vasai (East)
AND WHEREAS the said work, the specification, the schedule of the quantities and rates relating to
the work have been signed by the parties here to WHEREAS THE Contractor has agreed to execute
upon and subject to the conditions set for the herein (hereinafter ) referred to as “ the said
specifications and included in the said work and /or described in the said specification and included
in the said schedule , General and Specials Condition referred to as the said contract Amount and
which sum is estimated to be RS. 4,80,000/- (Four Lakhs and Eighty Thousand Rupees Only) and RS.
70,000/- (Seventy Thousand only) towards the difference in amount for the procurement of the Raw
material from the quotation date and actual work done which was agreed upon by both the parties
and as per the final Terms & conditions appended in the attached ANNEXURE-1, at the next page.
ANNEXURE -1
As per the agreement executed in one set of rs.100 stamp paper and the below enumerated term &
conditions and as per the Quotation issued by the contractor dated 25/02/2021, the final terms &
conditions for the works are as follows: -
I) SCHEDULE OF PAYMENT: -
1. 2,50,000 to be paid with 15days of starting the work
2. 1,00,000 to be paid during the work in full progress.
3. Balance 1,30,000 to be paid for the Raw material (Terrace roofing Sheet) and the final
completion of work.
Kindly Note:
1. RS 70,000/- to be paid to the contractor via P.D.C as a Raw Material cost difference amount.
(Increase in raw material rate from the time of the quotation and actual work done)
2.completion of work Time 30 Days
3. no other additional cost will be charged to the society towards any raw material or other
charges apart from the above mentioned RS.70 ,000/- that society needs to pay the contractor via
P.D.C
v) GENERAL TERMS & CONDITIONS: -
1. THE Contractor will be provided with a space at the society premises for the storage of his
working materials and the overall responsibility will be of the society to take care of the materials.
2. All the charges for water & Electricity charges to be beard by the Society.
3. The society and its each member will have to co-operate till the period contract completes the
work.
NOTE: - THIS AGREEMENT WITNESSETH AND it is hereby agreed by and between the parties
hereto as follows:
1. IN Consideration of the said contract amount to be paid at the time manner set forth in the said
condition and the General and special conditions execute and complete the work shown the said
specification and schedule set out as “ANNEXURE-1”
2. The employer shall pay the contractor by the said contract amount or such other sum as shall
under the conditions become payable at the time and in the manner hereinafter specified in the said
condition.
3. Tender document containing the said conditions and also General and Special conditions, the
specifications, schedule of Rates shall be read and construed as forming part of this Agreement ,and
the parties hereto shall respectively abide by and comply with same and perform the obligation
required to be performed by them under the same.
4. Time shall be the essence of this agreement and the Contractor hereby agree to commence and
to complete the entire work in the period as specified in the Tender Documents. Though the work is
to be carried out expeditiously the workmanship by the contractor shall be of high quality as per
relevant is Specification/Tender specification.
5. This agreement and Contract shall be deemed to have been made in Vasai, Dist. - Palghar and
any question or dispute arising out of or in any way connect with the Agreement and contract shall
be deemed to have arisen in Vasai Palghar and only appropriate court in Vasai and /or Palghar Dist.
