JUDICIAL AFFIDAVIT
OF
RICARDO DALISAY

I, RICARDO DALISAY, of legal age, Filipino citizen, married,


Philippine National Police officer with the rank of Master Sergeant, with
office address at PNP Municipal Police Station, Mabini St., Poblacion II,
Santa Cruz, Laguna, Laguna, after having been duly sworn to in accordance
with law, hereby deposes and states.

PREFATORY STATEMENT

The taking of this Judicial Affidavit was administered and supervised


by ATTORNEY LUISA MATALINO and was done at her office located at
Sunstar Complex, P. Guevara Avenue, Poblacion I, Santa Cruz, Laguna and
I am fully aware and cognizant of the questions asked of me by Attorney
Matalino and my answers thereto are under oath being aware that I may

face criminal liability for false testimony or perjury. I likewise requested


that the questions asked of me be in English as well as my answers thereto
are in English which I speak and understand for clarity and that the other
information and/or requirements of Section 3, A.M. 12-8-8-SC as explained
to me by the administering lawyer are contained in my Judicial Affidavit,
the rest which reads, to wit:

This Judicial Affidavit is being offered to prove:

A. That the accused were all apprehended by the Affiant as a law-


enforcement officer.
B. That the affiant in case of re-assignment or in lieu of his future
unavailability to personally testify in court offers this document as
his testimony

Q1 - Do you swear to tell the truth and nothing but the truth?

A1- Yes mam.

Q2 – Please state your name and personal circumstances for the record.
A2 - I am a police officer with a rank of Master Sergeant assigned in Public
Market MPS Sub-Station, located in Poblacion V, Santa Cruz, Laguna.
Q3 – Do you know why you are here?
A3 – Yes mam. To testify as one of the apprehending officers and team
leader of the PNP unit who apprehended the accused Pedro Sacdal y Santos
A.K.A. “Indong Talahib”, Jose Antonio Y Pascual A.K.A. “Huseng Sisiw”
and Rodrigo Cachula Y Tula, A.K.A. “Tukmol” on the night of March 29,
2021 at around 8:00 P.M. in an inhabited place in Villa Adelina, Santisima
Cruz, Santa Cruz, Laguna.
Q4 – What were the incidents on the night of March 29, 2021 with an
approximate hour of 8:00 P.M.
A4- That on March 29, 2021, at around 8:00 P.M. chief of Barangay Tanod
of Santisima Cruz (Umboy), Santa Cruz, Laguna. Mr. Juan Pablo personally
requested assistance with the endorsement of victim Mr. Juan Cruz Dela
Cruz, who is obviously a Ninja Van delivery man, we let him sit and relax

for a while in our PNP police sub-station to recover from his shock, he
looked ashen and unwell during that time. It was Mr. Pablo who briefed me
of what happened to Mr. Dela Cruz, hence I immediately instructed
Corporal Timpi to write on our blotter the incident report.

Q5 – What were your reactions when you saw the victim Mr. Juan Dela
Cruz?

A5 - Upon getting the details from Mr. Juan Pablo and assuring me that
they will have a force multiplier team to accompany our personnel to
conduct a follow up operation in that vicinity, I immediately formed a
squad to conduct a follow up operation.

Q6 – What happened when you arrived at the scene of the robbery?


A6 - That upon PNP Team’s arrival in a grassy area or the allegedly spot
where the crime was committed in purok 6 of Barangay Santisima Cruz,
Santa Cruz, Laguna, we immediately saw Pedro Sacdal y Santos, also
known as “Indong Talahib”, Jose Antonio y Pascual, also known as “Huseng
Sisiw”, Rodrigo Cachula y Tula, also known as “Tukmol”, hunkering in a
make shift hut with a gas lit light (gasera).

Q7 – Did the suspects resisted arrest?


A7 - Upon identifying ourselves as law enforcement officers they
immediately raised their hands and upon invitation to the police station for
questioning, they peacefully came with us bringing to their person some
material possessions which might be things of value to them.
Q8 – What were the proceedings when you arrived at the MPS Sub Station?
A8 - I observed that Mr. Dela Cruz recovered from his shock and he
immediately identified Pedro Sacdal y Santos, also known as “Indong
Talahib”, Jose Antonio y Pascual, also known as “Huseng Sisiw”, Rodrigo
Cachula y Tula, also known as “Tukmol”, as three of the five persons who
accosted him and robbed him of his valuables.
Q9- What did you do when the victim Mr. Juan Del Cruz positively
identified the accused?

A9 - That upon positive identification of the victim, we immediately read


their right in the vernacular and asked if they understood their rights, and
we manifested to them that we are putting them under arrest for robbery in
band.

Q10 – What were the pieces of evidence that convinced you that the
accused were the perpetrators of the robbery?

A10 - That upon inventory of the suspects’ possession, Mr. Juan Dela Cruz
immediately identified his sling bag, Vivo android phone, cash amounting
to five thousand pesos, two (2) fan knives, a bolo and identification cards of
the three (3) suspects Pedro Sacdal y Santos, also known as “Indong
Talahib”, Jose Antonio y Pascual, also known as “Huseng Sisiw”, Rodrigo
Cachula y Tula, also known as “Tukmol.

Q11 – Did your unit followed the PNP procedures to protect your unit and
the rights of the accused?

A11 – I immediately instructed my staff to prepare the necessary recording


and documentation which could be seen on the PNP Blotter, PNP Spot
Report and the PNP Report of inventory of items recovered from the
possession of the three (3) suspects Pedro Sacdal y Santos, also known as
“Indong Talahib”, Jose Antonio y Pascual, also known as “Huseng Sisiw”,
Rodrigo Cachula y Tula, also known as “Tukmol.

ATTESTATION

I hereby state, under oath, that I faithfully recorded the questions I
