Affidavit/ Undertaking is to be submitted by all the tractor manufacturers for the tractors
to be provided on subsidy under the departmental scheme

The following affidavit/ undertaking on Rs. 100/- Non- Judicial Stamp Paper

the empanelment as a manufacturer of tractor in Haryana State and declare & undertake as
under:
1. That we intend to supply tractor (above 35 P.T.O. HP) manufactured by our firm in
Department of Agriculture & Farmers Welfare subsidy scheme. The model/variant wise
minimum supply rates is enclosed herewith. Validity of rates is upto 31.03.2023
2. That we will supply tractors on uniform rates in the State and in case of any deviation
lowest billed amount (anywhere in the State) will apply on the all the tractors supplied
under the scheme and we are bound to refund the balance amount to the concerned.
3. That our firm will ensure issuing of bills having details of transactions made through
NEFT/RTGS/DD etc. (copy of bank statement) by the beneficiary depositing farmer share
and provide the copy of insurance, temporary Number along with proof of depositing
registration fees for issuance of RC.
4. That our firm has not been blacklisted by any Government Department/Organization.
5. That we will provide standard warranty minimum for 24 months.
6. That we will replace/repair faulty parts free of cost during warranty period.
7. That we will be sole-responsible for dealer network appointed by our firm.
8. That we will supply user manual in local language known by the farmer and aware
regarding the operation and maintenance of the tractors supplied by us.
9. That we will provide detailed sales report of each and every tractor at District level and
HQ level and any other information required by Department for tractor supplied to farmer
under the scheme.
10. That, we are well aware that Department at any point of time can stop sale/ blacklist our
firm without any prior notice, if found violating departmental terms and conditions.
11. That we will provide full support to the department for implementation of E-voucher
initiative as and when required.
12. That we will abide by the Government rules and regulations, terms & conditions and
instructions issued by department time to time and Bank Guarantee of Rs. 5 lakh submitted
by our firm and we are ready to increase the same to the 5% of the business in the State
(maximum Rs. 50 lakhs).
13. In case of any dispute, decision of the Director, A&FW will be final.

Pursuant to the department instructions nos. 6513 dated:- 13.12.2022
The aforementioned firm undertook to deliver the following: -
We the undersigned (name of the bank and address)………………………… having our

the guarantee for the fulfillment of the empanelment order obligations, in accordance
with the stipulated with the terms and conditions of the department entered into by and
between you as BUYER and M/s…..……………………………………. SELLER to
the amount of Rs. Five lakh and we irrevocably undertake to pay you upon your first
demand, without any demur and without referring to any other source, the above sum
or part thereof provided you advise us that M/s…………………………………...........
have failed to fulfill the terms and condition of empanelment order including the
delivery obligations stipulated therein. We also declare that any such demand made on
us by you shall be conclusive and binding on us, notwithstanding any difference or
dispute between yourself and the seller.
The BUYER shall have the fullest Liberty without affecting, in any way the
liability of the bank under this guarantee, from time to time, to extend the time of
performance by the SELLER. The bank shall not be released from its liabilities under
these presents by any exercise of the BUYER of the Liberty with reference to the matter
aforesaid.
The BUYER shall have the fullest liberty, without affecting this guarantee to
postpone from time to time the exercise of any powers vested in them or of any right
which they might have against the seller and to exercise the same at any time in any
manner, and either to enforce or to forbear to enforce any covenants contained or
implied in the empanelment order between the BUYER and the SELLER or any other
course of remedy for security available to the BUYER and the bank shall not be released
of its obligations/liabilities under these presents by any exercise by the BUYER of his
liberty with reference to the matters aforesaid or any of them or by reasons of any other
act or forbearance or other acts of omission or commission on the part of BUYER or
any other indulgence shown by the BUYER or any other matter or thing whatsoever
which under law would, but for this provision have the effect of relieving the bank
guarantee. The bank further undertakes not to revoke this guarantee during its currency
without the previous consent of the BUYER.
The BUYER shall have the fullest liberty to lodge their claim for encashment of
the guaranteed sum in full or in part, in the manner suitable to them. However payment
made for a sum lesser than the guaranteed amount shall not relieve or discharge the bank
from their obligation guaranteed hereunder till the empanelment order obligations are
fully performed by the SELLER or the bank guarantee is discharged by the BUYER as
the case may be and the bank guarantee shall continue to be in force till such time.
The bank further agrees that the decision of the BUYER as to the failure on the
part of the SELLER to fulfill their obligations and/or as to the amount payable by the
bank to the BUYER hereunder shall be final, conclusive and binding on the the bank.
The Bank also agree that the BUYER shall be entitled at his option to enforce
this guarantee against the bank as a principal debtor, in the first instance not
withstanding any other security or guarantee that it may have, relating to the
SELLER’S liabilities.
This guarantee will not be discharged due to the change in the constitution of the
bank, or the SELLER’S.
In accordance with the stipulation of instructions in the empanelment order, this
guarantee will become invalid after completion of supplies or as soon as this letter of
guarantee has been returned to us, at the latest, however on ………….. (here mention
the period or due date) unless a claim has been lodged against us under our guarantee
until that date. This guarantee shall be extended from time to time for such period as
may be desired by M/s……………………………………. on whose behalf this
guarantee has been given.
In case our liability under this guarantee of performance does not exceed
Rs………………… This guarantee deed must be returned to us upon expiration of the
period of guarantee.
