THE CONSTITUTION

PREAMBLE

We, the undergraduate students of UNIVERSITY OF SOUTHEASTERN


PHILIPPINES, imploring the aid of the Divine Providence, believing in the need
for a better organized student government and the development of the youth as future
leaders of the nation, forming a unified student organization that shall embody the
ideals and principles of democracy, in collective efforts to serve, promote and
protect the rights, welfare, and endeavor of all students, the academic standards of
our university, and foster a close relationship among the students and the other
sectors of the society in order to instill national consciousness for the advancement
of the Filipino people, do hereby promulgate and adapt this Constitution that will
promote, implement, and maintain the University’s goals and aspirations.

ARTICLE I
GENERAL PROVISION
SECTION 1: This Constitution shall be known as the University of Southeastern Philippines –
University Student Government Constitution.

SECTION 2: This constitution shall govern the University of Southeastern Philippines –


University Student Government (USeP - USG).

SECTION 3: This student government shall be known as University of Southeastern Philippines


– University Student Government (USeP – USG), which shall be known as the highest student
government body of the University.

SECTION 4: The USeP – University Student Government shall govern the respective Student
Councils, Local Councils, Council of Clubs and Organizations, League of Class Mayors, and Class
Government of each unit of the University.

ARTICLE II
NAME, DOMICILE AND SEAL
SECTION 1: The entity shall be officially known as the University of Southeastern Philippines –
University Student Government herein referred to as USeP-USG.

SECTION 2: The seal of USeP-University Student Government shall have the following symbols:

2.1 The Four Rays of the Sun signify the four (4) campus/units,
namely: Mabini,Mintal, Obrero, and Tagum.

2.2 The Balance Scale signifies the continuous effort of the


four (4) campus/unitstudent governments to uphold equality, justice, and
balance.

2.3 The Book signifies knowledge and wisdom and the


capacity of each studentleader to think beyond the frontiers of
expectation.

2.4 The Transcending Eagle signifies the eagerness of the USeP-


USG to serve thestudent body.

2.5 The Stars signify the four (4) core values of the University:
Unity, Stewardship,Excellence, and Professionalism.

2.6 The Laurel Leaves signify the freedom of expression of the


students, especiallythe campus/unit student government.

ARTICLE III
DECLARATION OF PRINCIPLES
SECTION 1: The USeP-University Student Government is a democratic and the highest student
governing body and sovereignty resides in the students and student government authority emanates
from them.

SECTION 2: The primary duty of the USeP-University Student Government is to serve, promote,
and protect the rights, welfare, and endeavors of the student body.

SECTION 3: To embody the ideals and principles of democracy, in collective efforts to serve,
promote and protect the rights, welfare, and endeavors of the student body.

SECTION 4: To promote unity and foster close relationships among students and other sectors of
the society in order to instill national consciousness for the advancement of the Filipino people.

SECTION 5: To serve as an active voice of the students to help bring up their grievances to proper
authorities and to further realize their collective interests and ensure that all decisions and acts
shall always be reflective and beneficial to all students.

ARTICLE IV
MEMBERSHIP

SECTION 1: All bona fide undergraduate students of the University, who are members of the
USeP-University Student Government, shall be held accountable at all times.

SECTION 2: No payment of students' membership of the USeP-University Student Government


shall be collected except for the recognized student clubs and organizations with a properly
recognized membership.

SECTION 3: Membership shall be renewed every semester and shall be terminated automatically
upon legal separation from the University.

ARTICLE V
STUDENT RIGHTS
SECTION 1: All rights indicated in the latest edition of the University Student Handbook and
other legal documents supporting students' rights apply to all USeP-USG members.

ARTICLE VI
DUTIES AND OBLIGATIONS OF MEMBERS
SECTION 1: Every member of the USeP-University Student Government must abide, uphold and
defend the USeP-University Student Government Constitution at all times.

SECTION 2: Every member of the USeP-University Student Government has the responsibility
to observe and be knowledgeable of the rules, regulations, memoranda, resolutions, and ordinances
of the University at all times.

SECTION 3: Every member of the USeP-University Student Government must be responsive to


any form of injustices, inefficiencies, and misbehaviors made by any student and/or any University
authorities, which hinder the dignity and legal rights of the students.

SECTION 4: Every member of the USeP-University Student Government is highly encouraged


to participate in all activities conducted and organized by the USeP-University Student
Government and strive for academic excellence.

SECTION 5: Every member of the USeP-University Student Government must respect and
observe decorum to the duly constituted University authorities and student leaders considering the
organizational structure.

SECTION 6: Every member must prepare themselves to assume responsibilities whenever


deemed necessary for the mutual interest of the University and the USeP-University Student
Government.

SECTION 7: Every member of the USeP-University Student Government must exercise their
rights responsibly.

ARTICLE VII
DEFINITION OF TERMS
SECTION 1: For purposes of this Constitution, unless the context indicates otherwise:
(A) “University” - signifies the University of Southeastern Philippines.
(B) “University of Southeastern Philippines” or “USeP” - includes all campuses or units of
the University, namely: Mabini, Mintal, Obrero, and Tagum.
(C) “USeP- University Student Government” or “USeP-USG” - refers to the highest student
governing body of the University.
(D) “VP” - abbreviation for the “Vice President”
(E) “USeP- Student Council” or “USeP - SC” - refers to the highest governing body of any
distinguished campus or unit in the University of Southeastern Philippines.
(F) “USeP-Local Council” or “USeP-LC” - refers to the duly constituted central student

government of a college that offers at least a bachelor’s degree or diploma program.


(G) “University Authorities” - signifies the duly constituted authorities/officials of the
University of Southeastern Philippines.
(H) “USeP-Student Council Legislators” - refers to all legislative members as distinguished
from the USeP-SC.
(I) “USeP-LC Governors” - refers to the highest designation or position distinguished from
all the USeP-LC.
(J) “USeP-League of Class Mayors” or “USeP-LCM” - refers to an organization of class
mayors distinguished from a college that offers at least a bachelor’s degree and diploma
program.
(K) “Mayors” - refers to all USeP-LCM members as distinguished from all USeP-LCM in the
college.
(L) “USeP – Council of Clubs and Organizations” or “USeP-CCO” - refers to an
organization of all undergraduate clubs and organizations of its respective University
Campus or Unit.
(M) “Permanent vacancy” - exists when the office of an officer in any distinguished
designation has been vacated by virtue of resignation/leave of absence, impeachment,
mental and/or physical incapacity, expulsion from the University, or death, by which
discredits the officer to perform their duties and responsibilities of their office herein.
(N) “Basic Parliamentary Rules and Procedures Knowledge”- pertains to the level of
knowledge on Parliamentary Rules and Procedures as certified by seminars attended by
individuals.
(O) “Intermediate Parliamentary Rules and Procedures Knowledge” - pertains to the level
of knowledge on Parliamentary Rules and Procedures as certified by seminars, workshops
and drills attended by individuals. This can also be certified when the aspirant had direct
experience in participating and/or presiding in any legislative departments of the student
councils.
(P) “Plebiscite” - refers to the process of gathering the signatures of the majority (50% +1) of
the total population of the University.

ARTICLE IX
USeP – UNIVERSITY STUDENT GOVERNMENT EXECUTIVEDEPARTMENT

SECTION 1: The Executive power shall be vested in the executive department.

SECTION 2: The USeP-USG Executive Department shall be composed of officers duly elected
by a majority vote of the members of the USeP-USG, provided a quorum is achieved during the
meeting called for that purpose, and shall be composed of the following:
(A) The USeP – USG President;
(B) The USeP – USG Vice President for Internal and External Affairs;
(C) The USeP – USG Vice President for Business Correspondence and Records;
(D) The USeP – USG Vice President for Finance;
(E) The USeP – USG Vice President for Audit and Logistics; and
(F) The USeP – USG Vice President for Publication and Information.

SECTION 3: The USeP-USG Executive Department shall perform the following duties
and responsibilities:
(A) to enforce this USeP-USG Constitution and all other regulations that may be
promulgated;

(B) to coordinate with the Office of the President and all other offices that might
be involvedon matters concerning their constituents;
(C) to sign all financial statements, official minutes, resolutions,
correspondences, and otherofficial papers of the USeP-USG;
(D) to recommend additional measures to the USeP-USG Congress;

(E) to be held accountable for all USeP-USG activities;

(F) to carry out such other functions as may be deemed necessary for a matter of
direct representation and direct responsibility determined by a law or act from
the USeP-USG Congress for the welfare of the student body;

(G) to properly turn-over their administration to the succeeding set of newly elected
USeP-USGofficers;
(H) to spearhead the presentation of the Accomplishment Report of the USeP-USG
and the different USeP- Student Councils during the Year-end Convention; and
(I) to conduct and facilitate training, seminars, and workshops to strengthen the
leadership skills of all the USeP student leaders.

SECTION 4: The duties and functions of the Executive Officers:

(A) The USeP – USG President


I. shall be the official representative of the students to the USeP-Board of
Regents and shall be the official representative of the student government
when deemed necessary;
II. shall be the Chief of the Executive Department of USeP-USG and Executive
Committee of respective Student Councils;
III. must preside over all meetings and/or may designate another officer to
preside fora specific meeting;
IV. may establish Ad Hoc Committees and appoint the Chairperson when
deemednecessary;
V. shall submit and address the overview of the Executive Department’s
programs of the academic year to the USeP-USG Congress every first
regular session;
VI. shall issue executive orders for faithful and appropriate implementation of
USePUSG programs, resolutions and ordinances;
VII. shall endorse resolutions and acts approved by the USeP-USG Congress to
the USeP Board of Regents;
VIII. shall call for conventions, congresses, seminars, or any gatherings as the
USeP-USG may deem necessary;
IX. shall assume office for a term of one (1) academic year, which commences
aftertheir oath of office;
X. shall have a voting power in the Executive Department in accordance with
thequalifications set herein;
XI. shall be vested with veto power to act upon legislations passed by the USeP-
USGCongress, however;
a. Failure of the USeP-USG President to communicate his veto to any
legislation being presented within fifteen (15) days upon receipt of
document thereof shall automatically signify its approval;
b. The USeP-USG President’s veto can be overridden by a two-thirds
(2/3) vote of the entire USeP-USG Congress, after which the legislation

isthereby approved.
XII. shall present the Annual Procurement Plan (APP) during the Year-End
Convention and Annual Action Plan (AAP) during Pre-Leadership
Seminar.

(B) The USeP-USG Vice President for Internal and External Affairs
I. shall administer both Internal and External affairs of the USeP-USG and
assist the USeP-USG President in all matters when deemed necessary;
II. shall be the head of the USeP-USG Internal and External Affairs Committee
andconceptualize programs, projects, and plans of activities;
III. shall design community development and environment-related programs
that the USeP-USG will spearhead;
IV. shall be the head of all Internal and External Vice-Presidents of the USeP-
StudentCouncils and establish rapport and camaraderie within and among
these organizations
V. shall assume office for a term of one (1) academic year, which commences
after their oath of office;
VI. shall have a voting power in the Executive Department;
VII. shall take over the function of the President in cases of the latter’s absences
and disabilities, but only limited to the following:
a. Call and preside over meetings/sessions;
b. Approve memorandums and documents; and
c. Represent the University Student Government in all affairs.
VIII. In cases of permanent vacancy of the USeP-USG Presidential seat, they
shall assume its duties and functions in accordance with the guidelines
stipulated in thisConstitution.
IX. shall be ready to perform such other duties as the USeP-USG President
may direct provided that it is in accordance with the USeP-USG’s
objectives and/or by virtue of an Executive Order.

(C) The USeP-USG Vice President for Business Correspondence


I. shall secure all pertinent documents and issue notices of all USeP-USG
activities prior to the Student Council’s scheduled meeting;
II. shall submit all necessary documents and accomplishment reports after the
proclamation of the new set of USeP-USG officers;
III. shall be the head of the archiving committee set by the USeP-USG, and
shall be responsible in making the Implementing Rules and Regulations,
concerning the disposal and retention of records of the USeP-USG;

IV. shall assume office for a term of one (1) academic year, which commences
after their oath of office;
V. shall be ready to perform such other duties as the USeP-USG President may
direct, provided that it is in accordance with the USeP-USGs objectives
and/or by virtueof an Executive Order; and
VI. shall have a voting power in the Executive Department;

(D) The USeP–USG Vice President for Finance


I. shall be the Chairperson of the USeP-USG budget and finance committee;
II. shall disburse money as authorized by the USeP-USG in accordance
with theapproved resolutions and other pertinent documents such as
Annual Action Plan;
III. shall exercise proper management of funds, secure receipts, and shall
respond tofinancial inquiries from the USeP-USG;
IV. shall report their respective Financial Statement to the USeP-USG
during theYearend Convention;
V. shall be the head of all USeP-SC General Auditors for Annual
ProcurementPlanning and re-alignment when deemed necessary;
VI. shall check the procurement process and status based on the Annual
ProcurementPlan of different campuses;
VII. shall assume office for a term of one (1) academic year which
commences aftertheir oath of office;
VIII. shall have a voting power in the Executive Department; and
IX. shall be ready to perform such other duties as the USeP-USG President may
direct, provided that it is in accordance with the USeP-USG’s objectives
and/or by virtue of an Executive Order.

(E) The USeP–USG Vice President for Audit and Logistics


I. shall conduct auditing of funds and inventory of all USeP-USG properties
every end of the semester;
II. shall investigate any discrepancy in the financial records of the USeP-SC in
coordination with the USeP-Commission on Audit;
III. shall coordinate with the USeP-USG Vice President for Finance during the
conduct auditing or inventory and must submit Audit Reports to the USeP-
USG Vice President for Business Correspondence for records-keeping;
IV. shall impose the official Implementing Rules and Regulations in proper
auditing of Financial Statements;
V. shall assume office for a term of one (1) academic year which commences
aftertheir oath of office;

VI. shall have a voting power in the Executive Department;


VII. shall be the property custodian of the USeP USG;
VIII. shall be the person-in-charge with regards to the canvassing and extracting
of the annual procurement plan and annual appropriations plan; and
IX. shall be ready to perform such other duties as the USeP-USG President may
direct, provided that it is in accordance with the USeP-USG’s objectives
and/or by virtueof an Executive Order.

(F) The USeP–USG Vice President for Publication and Information


I. shall be the official spokesperson of the President and USeP-USG and shall
also take charge with the dissemination of information relating to the
university and USeP-USG and all its activities;
II. shall be the chairperson of USeP-USG Logistics committee. They shall also
be the Liaison Officer of the USeP-USG;
III. shall assume office for a term of one (1) academic year which commences
after their oath of office;
IV. shall have a voting power in the Executive Department;
V. shall be in-charge all official social media platforms and websites of the
USeP-USG;
VI. shall be ready to perform such other duties as the USeP-USG President may
direct, providedthat it is in accordance with the USeP-USG’s objectives and/or
by virtueof an Executive Order.

ARTICLE X
USeP – UNIVERSITY STUDENT GOVERNMENT CONGRESS

SECTION 1: The Legislative power shall be vested to the USeP-USG Congress;

SECTION 2: The USeP-USG Congress shall be composed of:


(A) USeP-USG Chairperson
(B) USeP-USG Deputy House Speaker
(C) USeP-USG Legislators
(D) Secretary-General
(E) Congress Staff

SECTION 3: The duties and functions of the USG Congress Members


(A) The USeP–USG Chairperson - the official Presiding Officer of the USeP-USG Congress.
Mandated to maintain order in the plenary, manages its proceedings by pursuing the
objectives of this Constitution, and the Rules of the Congress.

I. He/she/they shall also be the second (2nd) successor of the USeP-USG President
in case that the USeP-USG Vice President for Internal and External Affairs is
unable to hold office by virtue of resignation/leave of absence, mental/physical
incapacity, expulsion from the University, or death;
II. They shall also relinquish their duties as the Presiding Officer of the House
provided that they want to exercise their voting power; and
III. They may exercise their voting power during official sessions provided that they
will relinquish their duties as the Presiding Officer of the House during the session.

(B) The USeP –USG Deputy Speaker of the House – shall automatically be the Presiding
Officer in case of the Chairperson’s absence on account of relinquishment, disqualification,
and all the pertinent provisions enlisted in this Constitution; and shall assume all duties and
obligations of the Chairperson.
I. They shall also relinquish their voting power when acting as the Presiding Officer
of the House; and
II. They shall exercise and uphold the duties and responsibilities of a legislator outside
session proper.

(C) The USeP–USG Legislators – shall be in charge of all legislative works, including, but
not limited to:
I. Attend all sessions, meetings, and conventions facilitated by the USeP-USG;
II. Submit resolutions, ordinances and bills that benefit the student body in general;
III. Deliberate and approve policy proposals presented by the Executive Department
and Constitutional Commissions, such as:
a. The annual procurement plan during year-end convention;
b. Resolutions, bills, or acts during conventions; and
c. Implementing rules and regulations.
IV. Approve and implement house rules and procedures of the USeP-USG Congress;
and
V. Sign all pertinent documents requiring their signature.

(D) Secretary General:


I. Shall render secretariat services to the Congress, complete the printing and
distribution of the Records of the Congress, and submit to the Speaker all the
pertinent documents thereof;
II. Shall be appointed at the discretion of the USeP-USG Congress Chairperson with
a duly approved resolution that constitutes a two - thirds (⅔) vote from its members;
III. Shall be responsible with the management of all records and pertinent documents
of the Congress (e.g., minutes, resolutions, bills, ordinances, etc.) of the USeP-

USG Congress; and


IV. The USeP-USG Congress Secretary General shall have NO VOTING POWER in
all the proceedings of the Legislative Department.

(E) Congress Staff – the USeP- USG Congress shall appoint staff which includes but not
limited to Technical Staff and Sergeant at Arms, depending on the kind of assistance the
body deems necessary to suffice its functions proficiently.

SECTION 4: The USeP-USG Congress shall establish standing committees among themselves,
including, but not limited to the following:

(A) Grievance Committee: This committee shall address all complaints with regard to the
conduct of officers, formulation of programs and policies of the USeP-USG, and
implementation of projects, programs, and activities;

(B) Oversight Committee: This committee shall address all matters concerning legislative
deliberation of the USeP-USG programs, projects, and provide recommendations to the
USeP-USG Executive Department and USeP-USG Congress;

(C) Committee on Rules and Ethics: This committee shall establish and impose Rules and
Penal Code to better practice proper decorum in the USeP-USG Congress;

(D) Blue Ribbon Committee: This committee shall cater all matters related to investigations
of anomalies and corruption, including, but not limited to the investigation of: malfeasance,
misfeasance, and nonfeasance in the office by officers or staff of the USeP-USG, its
branches, subdivisions and instrumentalities; and investigation of any matter of public
interest on its own initiative or brought to its attention by any Member of the USeP-USG
Congress;

(E) Impeachment Committee: This committee shall cater all matters regarding any
impeachment proceedings of all impeachable officers. Impeachable officers include all
officers of the USeP-USG on the grounds that there is gross neglect of duty, any form of
misconduct that undermines the integrity of the USeP-USG, bribery, malversation of
council funds, graft and corruption, or betrayal of public trust, and all of the grounds not
mentioned herein; and

(F) Constitutional Amendments and Revisions of Codes Committee: This committee shall
cater all matters as for the proposal of amendments of the USeP-USG Constitution and the

revision of the existing codes.

SECTION 5. In the case that a new student council has been established as a result of the
University’s expansion, representatives from the new council/s shall be part of the Congress via
Bill approved by the members of the Congress.

ARTICLE XI
CONSTITUTIONAL COMMISSIONS OF USeP – UNIVERSITY
STUDENTGOVERNMENT

SECTION 1: General Provisions


(A) The Constitutional Commissions, which shall be autonomous, are the Commission on
Audit (CoA) and the Commission on Elections (ComElec);

(B) No Member of a Constitutional Commission shall, during his tenure, hold any executive
or legislative position in the USeP-USG, USeP-SC, USeP-LC, USeP-LCM, and USeP-
CCO;

(C) Each Commission en banc may promulgate its own rules concerning pleadings and practice
before it or before any of its offices. Such rules however shall not diminish, increase, or
modify substantive rights and laws in the 2021 USG Constitution, Student Handbook, and
other laws of the land and the University;

(D) Each Commission shall perform such other functions as may be provided by law.

SECTION 2: Commission on Audit


(A) shall automatically consist of the USeP-Student Councils’ General Auditors, respectively;

(B) There shall be a USeP-USG Commission on Audit, which will be led by the USeP-USG
Vice- President for Audit and Logistics;

(C) The USeP-USG Commission on Audit (CoA) Chairperson shall have the following duties
and responsibilities:
I. shall preside over the sessions of the Commission;
II. shall formulate a standardized auditing system together with a Committee that must
be implemented by the USeP-Student Councils’ Commission on Audit (CoA)
Chairpersons;
III. shall convene all the commissioners for proper deliberation procedures, ensuring
that the formulated auditing procedure is well implemented and observed; and

IV. shall consolidate, review, and submit the semestral reports submitted by the
Commissioners to the Office of Student Affairs and Services (OSAS) for clearance
unblocking prior to enrolment.

(D) The USeP-USG Commission on Audit (CoA) Commissioners shall have the following
duties and responsibilities:
I. shall implement the standardized auditing system formulated by the USeP-USG
Vice-President for Audit and Logistics;
II. shall deliberate upon the implementation of the auditing system; and
III. shall consolidate, review, and submit the semestral reports covering the Financial
Statements of the USeP-SC, USeP-LC, USeP-LCM, and USeP-CCO to the
Chairperson of the USeP-USG CoA of the USeP-USG, respectively.

SECTION 3: Commission on Elections (ComElec)


(A) The USeP-ComElec shall be the governing body of all the campus/council ComElec

(B) There shall be a USeP ComElec, which will be headed by the USeP ComElec Chairperson,
who must be elected within the commissioners of each USeP-Student Council Comelec.
The ComElec Chairperson will act as the chief executive of the Commission and will
preside over their meetings or conferences;

(C) The USeP ComElec shall facilitate the election process of the USeP student government
and councils which includes:
I. Filing of Candidacy of Candidates;
II. Pre-Election Orientation;
III. Campaign Period and Guidelines;
IV. Miting de Avance;
V. Election Proper;
VI. Counting Process;
VII. Declaration of Incoming Student Leaders;
VIII. Signing of the Official Results of the Election;
IX. Grievance period (if applicable); and
X. Proper consolidation of all pertinent documents to be forwarded to the USeP-USG
Vice President for Business Correspondence, SC General Secretary, CCO
Secretary, or LCM secretary for archiving purposes immediately after the Signing
of the Official Results of the Election.

(D) The members of the USeP ComElec shall be USeP–Student Councils’ ComElec
Chairpersons.

(E) The USeP ComElec Commissioners shall have the following duties and responsibilities:
I. shall uphold honesty and impartiality in the conduct of the election process;
II. shall be the ones to canvass election results;
III. shall be the ones to facilitate in the electoral proceedings;
IV. shall prepare and distribute the necessary election paraphernalia, and other election
related materials all throughout the election process;
V. shall review the requirements for the qualification of the candidates for the election
of the USeP-USG;
VI. shall comply with the standardized Election Proceedings of the USeP-USG;
VII. submit a Comprehensive Report on the conduct of each election, plebiscite,
initiative, referendum, or recall to both the USeP-USG President and the USeP-
USG Congress, respectively; and
VIII. shall conduct a Miting de Avance for the candidates at least two (2) days before the
Election Proper.

(F) The USeP-SC Commissioners will provide staffs in the USeP ComElec that requires
manpower and other related agendas in the election process in accordance with the
qualifications set herein and when deemed necessary.

ARTICLE XII
THE USeP – STUDENT COUNCILS AND ITS COMPOSITION

SECTION 1: The USeP-Student Councils (USeP-SC) shall be the highest autonomous


governing body of the respective campuses/units of the University.

SECTION 2: The USeP-SCs shall be referred to as the following:


(A) USeP – Tagum Student Council (USeP-TSC)
(B) USeP – Obrero Student Council (USeP-OSC)
(C) USeP – Mintal Student Council (USeP-MinSC)
(D) USeP – Mabini Student Council (USeP-MSC)

SECTION 3: The USeP-Student Councils have the primary duty of promulgating laws and the
general welfare of the USeP students.

SECTION 4: The USeP-Student Councils of each campus/unit shall have its own Codes and By
Laws provided that:
(A) it is in accordance with the USeP-USG Constitution and all other existing laws and
regulations of this University

(B) It is duly recognized and approved by the Office of Student Affairs (OSAS)

SECTION 5: Composition of the USeP-Student Councils


(A) Constitutional Bodies
I. USeP-Student Council Executive Committee;
II. USeP - Student Council Legislative Committee, known as USeP-Student Council
House of Representatives (USeP-SC-HoR).

(B) Constitutional Commissions


I. USeP - Student Council Commission on Audit (USeP - SC CoA); and
II. USeP - Student Council Commission on Elections (USeP - SC ComElec)

(C) USeP-Student Council Umbrella may consist of the following


I. USeP - Local Councils;
II. USeP - League of Class Mayors; and
III. USeP - Council of Clubs and Organizations.

SECTION 6: The USeP -Student Council may establish Ad Hoc Committees provided that it is
in accordance with the USeP-Student Council’s objectives and duly recognized by the Office of
Student Affairs and other concerned offices.

ARTICLE XIII
THE USeP – STUDENT COUNCIL CONSTITUTIONAL BODIES

SECTION 1: The USeP-SC Executive Department


(A) Shall be vested with the executive powers;

(B) The duties and functions of its officers are as follows;


I. USeP-SC President
a. shall be the official representative and the chief of the Executive Committee of
the USeP-SC;
b. shall enforce this Constitution and other regulations that may be promulgated;
c. shall coordinate with the Office of the USeP-USG, Office of the Student Affairs
and Services (OSAS), and any offices that might be involved on matters
pertaining to their constituents;
d. approve and sign all financial statements, official minutes, resolutions,
correspondences, and other official papers of the subordinate offices and
constitutional commissions;
e. may establish Ad Hoc Committees and appoint Chairpersons whenever the

need arises provided that the legislative measure has been duly approved the
House of Representatives
f. shall submit and address the overview of the USeP-SC Executive Committee’s
programs for the academic year to the USeP-SC-HoR at their first regular
session;
g. shall issue executive orders for faithful and appropriate implementation of
policies;
h. may call for conventions, assembly, seminars, or any gatherings as the USeP-
SC may deem necessary;
i. shall be eligible for re-election to any position in the USeP-SC in accordance
with the qualifications set herein;
j. shall have a voting power in the USeP-SC Executive Committee in accordance
with the qualifications set herein;
k. shall perform such other functions as may be deemed necessary for a matter of
direct representation and direct responsibility determined by a resolution or
ordinance from the USeP-SC HoR for the USeP student body;
l. shall be vested with veto power to act upon the legislations passed by the USeP-
SC HoR, to maintain equilibrium of governmental powers;
m. shall be part of the drafting of the Annual Procurement Plan (APP) that will be
presented during the Year-end Convention and Annual Action Plan during
Strategic Planning;
n. shall be one of the signatories of the USeP-SC bank account;
o. shall present a semestral budget appropriation subject for the approval of the
USeP-SC HoR.

II. USeP-SC Vice President for Internal Affairs


a. shall assist the USeP-SC President in all internal matters when deemed
necessary;
b. shall design community development and environment-related programs that
the USeP-SC will initiate;
c. shall be eligible for re-election to any position in the USeP-SC in accordance
with the qualifications set herein;
d. shall have a voting power in the USeP-SC Executive Committee in accordance
with the qualifications set herein;
e. shall take over the function of the President cases of the latter’s absences and
disabilities, but only limited to the following:
i. May call and preside meetings with the permission of the student council
Presidents;

ii. The USeP-SC Vice President for Internal Affairs shall take over as the
Chief of the Executive Committee by virtue of the USeP- SC President’s
resignation/leave of absence, mental/physical incapacity, expulsion
from the University, or death; and
iii. shall perform other duties as the President or an approved resolution may
direct, provided that it is related to the activities of the USeP-SC.

III. USeP-SC Vice President for External Affairs


a. shall coordinate with the Office of the USeP- USG, Office of Student Affairs
and Services (OSAS), and any offices that might be involved on matters
pertaining to external affairs;
b. shall be accountable to all USeP-SC external activities and income generating
projects;
c. shall be eligible for re-election to any position in the USeP-SC in accordance
with the qualifications set herein;
d. shall have a voting power in the USeP-SC Executive Committee in accordance
with the qualifications set herein;
e. shall perform other duties as the President or an approved resolution may direct,
provided that it is related to the activities of the USeP-SC;
f. shall be part of the drafting of the Annual Procurement Plan (APP) that will be
presented during the Year-end Convention and Annual Action Plan during
Strategic Planning;
g. shall establish linkages with other campuses and its clubs and organizations for
the development of the USeP-SC; and
h. shall be responsible for the communications outside the campus during external
dealings.

IV. USeP-SC General Secretary


a. shall take charge of the minutes during meetings of the USeP-SC signed by the
USeP-SC Executive Committee for the correctness and clarifications of the
minutes;
b. shall secure all pertinent documents such as executive orders, committee reports
and minutes, resolutions, ordinances, inventory reports and the like;
c. shall prepare notices and communications of the USeP-SC to the sub-
organizations and other organizations at least two (2) days before the scheduled
date and time;
d. shall submit all pertinent documents every end of the semester;
e. \shall perform other duties as the USeP-SC President, by virtue of an Executive

Order, may direct;


f. shall provide technical support to the USeP-SC Executive Committee and other
sub-organizations when deemed necessary;
g. shall be one of the members of the archiving committee set by the USeP-USG
and shall be responsible in making the Implementing Rules and Regulations for
the compliance of semestral Accomplishment Reports and governing the
acquisition, disposal, and retention of records of the USeP-SC;
h. shall be the one to present the Accomplishment Report to the USeP-SC during
General Assembly;
i. shall assume office for a term of one (1) academic year which commences after
their oath of office;
j. shall be eligible for re-election to any position in the USeP-SC in accordance
with the qualifications set herein; and
k. shall have a voting power in the USeP-SC Executive Committee.

V. USeP-SC General Treasurer


a. shall take part in the budgeting of the semestral appropriations in collaboration
with the USeP-SC officers and adviser;
b. shall be the Chairperson of the USeP-SC budget and finance committee of the
USeP-SC;
c. shall disburse money as authorized by the USeP-SC President in line with the
appropriations provisions as stated in the USeP-USG Constitution;
d. shall exercise proper fund management, secure receipts and always be ready to
respond to whatever financial inquiries that may arise from the USeP-SC;
e. shall render reports on the Financial Statement to the USeP-SC one (1) week
before
f. the end of semester;
g. shall also be responsible for the USeP-SC Annual Procurement Planning, and
realignment when deemed necessary;
h. shall assume office for a term of one (1) academic year which commences after
their oath of office;
i. shall be eligible for re-election to any position in the USeP-SC in accordance
with the qualifications set herein; and
j. shall have a voting power in the USeP-SC Executive Committee.

VI. USeP-SC General Auditor


a. shall conduct auditing as to the remaining funds, receipts, expenditures, and
inventory of all USeP-SC every end of the semester;

b. shall investigate any discrepancies in the Financial Statement of the USeP-SC


prior to its presentation to the USeP-SC;
c. shall coordinate with the USeP-USG Vice President for Finance to check all
monetary resources and properties and to monitor the progress of the Financial
Statement to be in accordance with USeP-Commission on Audit’s auditing
guidelines;
d. shall be eligible for re-election to any position in the USeP-SC in accordance
with the qualifications set herein;
e. shall have a voting power in the USeP-SC Executive Committee;
f. shall assume office for a term of one (1) academic year which commences after
their oath of office;
g. shall perform such other duties as the USeP-SC President, by virtue of an
Executive Order, may deem necessary.

VII. USeP-SC Public Information Officer


a. shall be the property custodian of the USeP-SC;
b. shall take charge of the information dissemination drive regarding the plans,
programs and activities set forth by the University, the USeP-USG and the
USeP- SC;
c. shall be the official spokesperson of the USeP-SC;
d. shall be the Liaison officer for canvassing and extracting of the Annual
Procurement Plan and Annual Appropriations Plan;
e. shall be the chairperson of USeP-SC Logistics Committee;
f. shall be responsible for the production of public materials and boosting of the
student council's public relations;
g. shall be the Liaison Officer of the USeP-SC regarding student records;
h. shall assume office for a term of one (1) academic year which commences after
their oath of office;
i. shall perform such other duties as the USeP-SC President, by virtue of an
Executive Order, may direct;
j. shall be eligible for re-election to any position in the USeP-SC in accordance
with the qualifications set herein; and
k. shall have a voting power in the Executive Committee.

SECTION 2: The USeP-SC Legislative Department


(A) The Legislative Power shall be vested to the USeP-SC HoR.

(B) The USeP-SC House of Representatives shall be composed of the following:

I. USeP-SC House Chairperson


II. USeP-SC Deputy Chairperson
III. Student Council Legislators from each college/department
a. Each USeP-Student Council Legislator in every college/department must
have the following ratio;
I. USeP-Obrero Student Council – one (1) representative for every 300
students per college.
II. USeP-Mabini Student Council - two (2) representatives per year
level. USeP-Mintal Student Council - two (2) representatives per
department.
III. USeP-Tagum Student Council - three (3) representatives per
program.
b. For every excess of at least half of the required ratio per
college/department, there shall be one (1) additional representative for the
respective college/department, except for USeP-Tagum Student Council
and USeP Mabini Student Council.

IV. CCO Sectoral Legislative Board Chairperson


V. LCM Sectoral Representative

(C) The USeP-SC HoR shall elect its Chairperson among its members who will maintain order,
manage its proceedings, and govern the administration of the House during Regular and
Special Sessions; and shall also function as a Student Council Legislator outside Regular
and Special sessions and/or when they relinquish their seat as the Presiding Officer.

(D) The USeP-SC HoR Deputy Chairperson


I. shall be the second highest ranking position of the House, being charged with
numerous duties and responsibilities set forth by law and the House Rules;
II. shall be elected among the members of the USeP-SC HoR during the first (1st)
session of the USeP-SC HoR; and
III. The USeP-SC HoR Deputy Chairperson shall assume the duties and responsibilities
of the USeP-SC HoR Chairperson when the latter is on Official Business.

(E) The duties and functions of the USeP-SC HoR are as follows:
I. shall attend all sessions, meetings, and conventions of the USeP-SC HoR;
II. shall pass resolutions, bills and ordinances that are beneficial to the student body;

III. shall deliberate and approve proposals and other pertinent documents presented by
the USeP-SC Executive Committee and USeP-SC HoR that require representation
of colleges/departments such as, but not limited to the Annual Procurement Plan
presented during the year-end convention, Ordinances, etc.
IV. shall approve and implement House Rules and Procedures of the USeP-SC HoR;
V. shall sign all pertinent documents;
VI. may appoint other house staff and members when deemed necessary by the virtue
of a resolution, to better attend to the needs of its proceedings.
VII. may expunge or suspend members with a two thirds (⅔) vote of all its members;
and
VIII. may abolish a Local Council by virtue of bill or resolution, duly affirmed by the
USeP-SC President, based on any of the following grounds:

a. The USeP-LC is redundant in function to another existing USeP-LC;


b.The USeP-LC does not have the financial capacity to sustain operations;
c. The abolishment of the USeP-LC is crucial in maintaining the harmony
among the USeP-Local Councils and the USeP- Student Councils in
general; and
d.If for any other grave reason, the USeP-SC HoR may deem necessary.

(F) The USeP-SC HoR shall establish its committees such as, but not limited to the following:
I. Grievance Committee: shall cater all complaints with regards to the conduct of
officers, formulation of programs and policies of the USeP-SC HoR and
implementation of projects, programs, and activities.

II. Oversight Committee: shall cater all matters pertaining to legislative deliberation
of the USeP-SC HoR programs, projects, and provide recommendations to the
USeP-SC Executive Committee.

III. Budget Appropriation, Ways, and Means Committee: shall cater all matters
concerning budget, fund appropriations and income generating projects. They shall
also be tasked to review the proposed financial plan of the USeP-SC and
suborganizations and provide recommendations to the USeP-SC HoR.

IV. House Rules and Ethics Committee: shall create a Penal Code for the proper
implementation of rules and regulation of the USeP-SC HoR.

V. Blue Ribbon Committee: shall cater all matters related to investigations of


anomalies and corruption including but not limited to investigation of, malfeasance,

misfeasance and nonfeasance in office by officers or staff of the USeP-SC, its


branches, subdivisions and instrumentalities; and investigation of any matter of
public interest on its own initiative or brought to its attention by any Member of the
USeP-SC HoR.

VI. Impeachment Committee: shall cater all matters regarding any impeachment
proceedings of all impeachable officers. Impeachable officers include all officers
of the USeP-SC, gross neglect of duty, any form of misconduct that undermines the
integrity of the USeP-SC, bribery, malversation of council funds, graft and
corruption, or betrayal of public trust.

VII. Constitutional Amendments and Revisions of Codes Committee: shall cater all
matters proposing amendments to the USeP-SC Constitution and the revision of the
existing codes.

(G) The USeP-SC HoR Secretary General


I. shall be appointed at the discretion of the USeP-SC HoR Chairperson, with a duly
approved resolution with a two-thirds (⅔) vote from its members;
II. shall be responsible with the management of all pertinent documents (e.g., minutes,
resolutions, bills, ordinances, etc.) of the USeP-SC HoR;
III. shall have NO VOTING POWER in all the proceedings of the Legislative
Committee; and
IV. shall disseminate all necessary information with regards to all sessions and
meetings of the USeP-SC HoR.

ARTICLE XIV
USeP - LOCAL COUNCIL

SECTION 1: A USeP-Local Council (USeP-LC) is a student governing body within the


respective campuses of the University which is given executive power by their respective USeP-
Student Council over a specified group of students.

SECTION 2: Every college, school, department, or institute is entitled to one USeP-Local Council
(USeP-LC) which shall exercise its following duties and responsibilities under its jurisdiction,
provided that it is in accordance with the existing laws and regulations established and
promulgated by the higher governing offices and campus administration.

SECTION 4: Every USeP-Local Council must have its official logo, subject for approval by the
USeP-SC House of Representatives by virtue of a resolution.

SECTION 5: All USeP-Local Councils may establish committees under its jurisdiction and/or
additional positions in their structure provided that it is duly approved by the USeP-SC HoR
through a resolution.

SECTION 6: The Duties and Functions of the USeP-Local Council Officers are as follows:
(A) USeP - Local Council Governor
I. shall be the head and official representative of the USeP-LC, and shall also be the
official representative to the USeP-Student Council when deemed necessary;
II. shall enforce this Constitution and other regulations that may be promulgated;
III. shall scrutinize, approve and sign all legal documents and records of the Local
Council;
IV. shall recommend measures to the USeP-SC HoR;
V. may issue Executive Orders for faithful and appropriate implementation of USeP-
a USG and USeP-SC programs, resolutions and ordinances;
VI. shall be held accountable to all USeP-LC activities;
VII. shall be eligible for re-election to any position in the USeP-LC in accordance with
the qualifications set herein;
VIII. shall have a voting power in the USeP-LC in accordance with the qualifications set
herein;
IX. shall be part of the drafting of the Annual Procurement Plan (APP) that will be
presented during the Year-End Convention and Annual Action Plan during
Strategic Planning;
X. shall report all programs, projects and events to the USeP-LC;
XI. shall also be responsible for the establishment of linkages with other USeP-LCs,
academic organizations, and other key agencies for the development of the USeP
Local Council;
XII. shall be one of the signatories of the USeP-LC bank account;
XIII. shall also be responsible for the preparation of the semestral budget appropriation
subject for approval from the Class Mayors;
XIV. shall be eligible for re-election to any position in the USeP-LC in accordance with
qualifications set herein; and
XV. shall conduct a turn-over ceremony of their administration to the newly elected

USeP-Local Council, respectively.

(B) USeP - Local Council Vice Governor


I. shall assist the USeP-LC Governor in enforcing this Constitution and other
regulations that may be promulgated by this University, USeP-USG Congress, and
USeP-SC HoR;
II. shall assume all the duties and responsibilities of the USeP-LC Governor in cases
of the latter’s temporary or permanent absence or disability to perform;
III. shall perform such other functions as the USeP-LC Governor, by virtue of an
Executive Order, may deem necessary;
IV. shall have a voting power in the USeP-LC in accordance with the qualifications set
herein;
V. shall be accountable to all income generating projects of the USeP-LC;
VI. shall assume office for a term of one (1) academic year which commences after
their oath of office.;
VII. shall be eligible for re-election to any position in the USeP-LC in accordance with
qualifications set herein; and
VIII. shall properly turn-over their administration to the newly elected USeP-LC Vice
Governor.

(C) Local Council Secretary


I. shall secure and relay all pertinent documents such as Executive Orders, Committee
Reports, Minutes, Resolutions, Ordinances, Inventory Reports, et cetera;
II. shall record the minutes during the USeP-LC meetings;
III. shall prepare notices and communications of the USeP-LC to other organizations
and offices pertaining to the activities prior to the scheduled time;
IV. shall consolidate their Accomplishment Reports after the end of the semester and
shall present the same to the USeP-Local Council one (1) week before the end of
every semester;
V. shall have a voting power in the USeP-Local Council;
VI. shall assume office for a term of one (1) academic year which commences after
their oath of office;
VII. shall be eligible for re-election to any position in the USeP-LC in accordance with
the qualifications set herein; and
VIII. shall turn over all pertinent documents and Accomplishment Reports to the newly
elected USeP-Local Council Secretary during the turn-over ceremony to be
facilitated by the Incumbent USeP-Local Council Governor.

(D) USeP - Local Council Treasurer


I. shall take part in the budgeting of the semestral appropriations in collaboration with
all the USeP-Local Council officers and its Adviser;
II. shall disburse money as authorized by the USeP-LC Governor, with respect to the
standing appropriations of this Constitution and the University;
III. shall exercise proper fund management, secure Official Receipts and shall always
be ready to prepare for further inquiries from the USeP-LC by virtue of a Financial
Statement;
IV. shall present the Financial Statement to the USeP-Local Council two (2) weeks
V. before the end of every semester;
VI. shall assume office for a term of one (1) academic year which commences after
their oath of office;
VII. shall be eligible for re-election to any position in the USeP-LC in accordance with
the qualifications set herein;
VIII. shall have a voting power in the USeP-LC; and
IX. shall be one of the signatories of the USeP-LC bank account.

(E) USeP - Local Council Auditor


I. shall conduct auditing measures to the Financial Statement prepared by the USeP
LC Treasurer and the Inventory Report prepared by the USeP-LC Secretary upon
its presentation to the USeP-LC;
II. shall investigate upon any discrepancies in the above-mentioned documents in
coordination with the USeP-LC, together with its Adviser;
III. shall be eligible for re-election to any position in the USeP-LC in accordance with
the qualifications set herein;
IV. shall have a voting power in the USeP-LC; and
V. shall assume office for a term of one (1) academic year which commences after
their oath of office.

ARTICLE XV
USeP – COUNCIL OF CLUBS AND ORGANIZATIONS

SECTION 1: General Provisions

shall be the arm of the Student Council, who shall coordinate with different duly recognized
undergraduate clubs and organizations in unifying and promoting their respective clubs and
organizations herein;
shall be the main base of every club and organization for them to be officially recognized in the
premises of the University herein;

The name of the USeP-Council of Clubs and Organizations and any other duly recognized
clubs/organizations shall never be used in any unjust and illegal activities;
The representation of the Club/Organization Head of every duly recognized club and organization
to the USeP-CCO shall constitute its members as a whole;
No extant organization head shall be part of the USeP-CCO Executive to avoid conflict of interest
toward both parties;
shall be guided by the Parliamentary Rules and Procedures during meetings, assemblages, and/or
sessions;
may suspend any unrecognized clubs and organizations in the campus/unit and any social media
platforms provided that:
The unrecognized clubs and/or organizations have committed acts that are deemed
unlawful and/or detrimental to the University, USeP-CCO, student body, and/or the
club/organization members; and
The Office of Student Affairs and Services (OSAS) have recommended or approved of its
suspension;
shall govern all existing recognized clubs and organizations inside the campus/unit and all social
media platforms.

SECTION 2: The USeP-CCO shall have the set of officers as indicated below:
(A) Executive Board
I. USeP-CCO President;
II. USeP-CCO Vice President for Internal Affairs;
III. USeP-CCO Vice President for External Affairs;
IV. USeP-CCO Vice President for Secretariat and Communications;
V. USeP-CCO Associate Vice President for Secretariat and Communications;
VI. USeP-CCO Vice President for Finance;
VII. USeP-CCO Vice President for Auditing;
VIII. USeP-CCO Vice President for Business and Event Management;
IX. USeP-CCO Logistics and Property Superintendent

(B) Legislative Board

SECTION 3: The USeP-CCO Clusters may group its recognized clubs and organizations into
the following clusters:

(A) Academic Cluster - The organizations that foster excellence in various academic fields. It
consists of a group of students enrolled in academic courses offered by the University,
those eligible for study grants and/or scholarship privileges;

(B) Campus Ministry Cluster - The organizations that promote spiritual lift and moral
preservation. This includes various religious and morality sects;

(C) Socio-Civic Cluster - The organizations that render civic-oriented services and coordinate
with the community for other social functions. These included environmentalists, human
rights advocates, social workers, political organizations, and minority groups;

(D) Inter-Fraternity and Sorority Cluster - The organizations of college students who share
common professional interests, religious, social and academic brotherhood and sisterhood,
a private, usually residential, social club of male and female students that extol lifetime
brotherhood and sisterhood;

(E) Sports Cluster - The organization of students participating in competitive sports activities
involving physical and mental exertions and skills. This includes athletic varsity, varsity
debate, and parliamentarian; and

(F) Culture and Arts Cluster - The organizations that observe the importance of art and
cultural preservation. This includes visual artists, performing arts, and the like.

SECTION 4: Membership
(A) This governing body shall administer all the duly recognized clubs and organizations, who
shall be set to commence before and to end a month after the start of classes of the first
semester only;

(B) Renewal and Recognition Process. The duration of the renewal or recognition period for
clubs and organizations shall be set to commence before the start of the semester and to
end a month after the start of classes of the first semester only;

(C) Renewal and Recognition Documents. This refers to a compilation of pertinent


documents submitted by an applying club or organization to certify its intention to be duly
recognized and/or renewed. It contains viable pieces of information such as the club or
organization’s intention to be recognized/renewed, list of officers and members,
commitment of the officers and adviser, proposed action plan for the entire academic year
and other certifications that the USeP-CCO and the OSAS may deem necessary;

(D) A Certificate of Recognition (CoR) duly signed by the USeP-CCO President and the
OSAS, shall be issued to the successful applying club/organization after thorough
deliberation, which shall only be valid for one (1) academic year from the date of issuance
therein;

(E) The Recognition Ceremony of the duly recognized clubs/organizations shall commence
two (2) weeks after the deadline for the recognition/renewal period on the first semester of
the academic year on a date specified by the Council of Clubs and Organizations,
respectively. The Recognition Ceremony shall be part of the Council of Clubs and
Organizations’ 1st General Assembly for the specific year. A Comprehensive and Official
List shall be forwarded to the Office of Student Affairs and Services;

(F) Evaluation. The duration of the evaluation period shall be set to commence a month before
the end of the first semester and to end a month after the start of classes of the second
semester for the first semester and two (2) weeks before the graduation ceremonies for the
second semester;

(G) Certificate of Completion (CoC) shall be issued by the Council of Clubs and
Organizations that will certify that a club or organization was able to accomplish the
pertinent documents that were required to submit prior or on the deadline of submission of
the following: Accomplishment Reports and Financial Statements.

ARTICLE XVI
USeP – LEAGUE OF CLASS MAYORS

SECTION 1: The USeP - League of Class Mayors (USeP - LCM) shall be composed of all the
class mayors within the respective campus/unit of the University of Southeastern Philippines.

SECTION 2: The USeP - League of Class Mayors (USeP - LCM) set of officers shall be the
following:
(A) USeP-LCM President
(B) USeP-LCM Vice President
(C) USeP-LCM Secretary General
(D) USeP-LCM Treasurer
(E) USeP-LCM Auditor
(F) USeP-LCM Sectoral Representative

SECTION 3: The USeP-LCM of each campus/unit shall have its own Codes and By-Laws

provided that:
(A) It is in accordance with the USeP-SC Local Codes, USeP-USG Constitution, and all other
existing laws and regulations of this University.
(B) It is duly recognized and approved by the Office of Student Affairs (OSAS)

SECTION 4: The USeP-League of Class Mayors Officers shall have the following duties and
responsibilities:
(A) USeP-LCM President:
I. Shall assume the office after the oath taking;
II. Shall govern all duly elected bona fide Class Mayors within the Campus;
III. Shall formulate laws, resolutions and/or policies only in the affairs pertaining to the
sector being represented;
IV. Shall sign resolutions, memoranda, communication letters and other documents
regarding to the sector being represented;
V. Shall have the sole authority to propose an appropriate budget to the House of the
Representatives and approve budgetary proposals utilizing the proceeds from the
income generating projects of the sector being represented;
VI. shall have the authority to implement rules, regulations and other laws for the sector
being represented;
VII. shall embody the governing principles as mandated by this Constitution
for the welfare of the sector being represented and of the students as a whole; and
VIII. shall be one of the signatories of the USeP-LCM bank account.

(B) USeP-LCM Vice President:


I. shall assume the office after the oath taking;
II. shall assume the Executive Power of the USeP-LCM President in their absence or
inability to perform their above mentioned duties and responsibilities by virtue of
their resignation/leave of absence, mental/physical incapacity, expulsion from the
University, or death;
III. shall work hand-in-hand with the USeP-LCM Officers regarding to the exertion of
the previous subsection;
IV. shall deal with other relevant internal and external affairs of the office and
legislations for the improvement of the sector represented; and
V. shall perform other duties and responsibilities that the USeP-LCM President, by
virtue of an Executive Order, may direct.

(C) USeP-LCM Secretary:


I. shall assume the office after the oath taking;

II. shall deal with all correspondences pertaining to the sector being represented;
III. shall establish a receiving and archiving system for all communication letters being
addressed to the USeP-LCM;
IV. shall be the one to prepare the agenda and the minutes of all meetings/assemblages;
V. shall record and secure the minutes of all meetings, assemblages and sessions, and
shall also be the one to disseminate the same to its absentee members/officers;
VI. shall prepare the accomplishment reports of the office every end of the term; and
VII. shall perform other duties and responsibilities that the USeP-LCM
President, by virtue of an Executive Order, may direct.

(D) USeP-LCM Treasurer:


I. shall assume the office after the oath taking;
II. shall be the accountable for all financial matters of the sector being represented;
III. shall be the keeper of the USeP-LCM bank account (passbook);
IV. shall be the one to take charge of all monetary transactions of the sector being
represented;
V. shall disburse money only upon the approval of the USeP-LCM;
VI. shall be the one to secure all receipts and compile it as attachments to the Financial
Statement, which shall be submitted and presented to the USeP-LCM Officers for
further deliberation especially by the Auditor;
VII. shall be one of the signatories of the USeP-LCM bank account; and
VIII. shall perform other duties and responsibilities that the USeP-LCM
President, by virtue of an Executive Order, may direct.

(E) USeP-LCM Auditor:


I. The USeP-LCM Auditor shall assume the office after the oath taking;
II. The USeP-LCM Auditor shall conduct necessary auditing measures regarding the
cash flow of the sector being represented;
III. The USeP-LCM Auditor, upon conductance of necessary auditing measures, shall
submit and present its Audit Report to the USeP-LCM upon presentation of the
Financial Statement by the USeP-LCM Treasurer at least two (2) weeks before the
deadline of the aforementioned document; and
IV. shall perform other duties and responsibilities that the USeP-LCM President, by
virtue of an Executive Order, may direct.

(F) USeP-LCM Sectoral Representative:


I. shall formulate resolutions and legislations that would cater to the needs of the
mayoralty sector; and

II. shall be the official representative of the USeP-LCM in USeP-Student Council HoR
and USeP-USG Congress.

ARTICLE XVII

CLASSROOM OFFICERS

SECTION 1: The class shall be the smallest political unit of the respective campuses of the
University. It is defined to be a group of students enrolled in the same course of study which is
assigned by a unique Section Code by the University Administration, as indicated in their
Certificates of Registration (CoR’s). There shall be no minimum number of students to constitute
a class.

SECTION 2: A class must elect its own set of officers which shall consist of the following:
(A) Mayor;
(B) Vice Mayor;
(C) Secretary;
(D) Treasurer;
(E) Auditor

SECTION 3: The Class Mayor has the following roles and responsibilities:
(A) shall preside on all meetings held by the class;
(B) shall see to it that all approved and passed laws, ordinances, resolutions, and orders are
properly disseminated and implemented in the classroom;
(C) shall initiate all duly authorized collections, through the help of the class treasurer, in
coordination with the class adviser;
(D) shall attend all meetings called for by the USeP-Student Council, League of Class Mayors,
Local Student Councils and all other organizations and entities requiring their presence;
(E) shall represent the class on concerns regarding his constituents; and
(F) shall perform other constitutional duties and tasks delegated to them by the USeP- Student
Council, League of Class Mayors, Local Council, and other organizations and entities.

SECTION 4: All other class officers aside from the Class Mayor shall perform the natural duties
and functions of their position in accordance with all the existing laws of this University and
student government.

SECTION 5: The Class Officers have a tenure of one (1) Academic Year, and are all eligible for
re-election.

ARTICLE XVIII
QUALIFICATIONS

SECTION 1: General Qualifications


(A) They must be a bona fide undergraduate student of the University.
(B) They must not be an Incumbent Commissioner among any of the Constitutional
Commissions both in USeP-USG and USeP-SC.
(C) They must have good moral character and no criminal/derogatory record.
(D) They must have a remaining residency in the University that will suffice their term in
office.
(E) They must have a remaining residency in the University that will suffice their term of
office.

SECTION 2: Qualifications for the USeP-USG Executive Department Officers


(A) They must have at least one (1) year remaining residency in the University during the day
of oath of their office.

(B) They must have at least 2 years of active leadership in any student offices of the university.

(C) Specific Qualifications for USeP-USG President:


I. They must be a former or the outgoing USeP-USG VPIEA, USeP-Student Council
President, USG Congress Chairperson, or SC House of the Representatives
Chairperson.

(D) Specific Qualifications for USeP-USG Vice President for Internal and External Affairs
I. They must be a former or the outgoing member of the USeP-USG Executive
Department, USeP-USG Congress Chairperson, USeP-USG Congress DPO, USeP-
SC President, USeP-SC HoR Chairperson, USeP-SC Internal Vice President,
USeP-SC External Vice President, USeP-SC DPO, USeP-CCO, or USeP-LCM
President

(E) Specific Qualifications for USeP-USG VP for Business Correspondence and Records,
USeP-USG VP for Finance, USeP-USG VP for Audit and Logistics, USeP-USG VP
for Publication and Information:
I. They must be a former or an outgoing USG Officer, USeP-SC Officer, USeP-LC
Officer, USeP-CCO Officer, or USeP-LCM Officer.
II. In the event that nobody qualifies in the specific requirements for any of the
respective positions in the USG Executive Department, the incumbent members of
the Congress may adopt a legislative measure to suspend, remove and/or add
provisions in the specific qualifications as they deem necessary; or convene SC

Executive & Legislative Department, LCM President and CCO President per
campus, for an internal election, through nominations, with the presence of the
ComElec, provided that nominees possess the general qualifications set in the
Constitution.

(F) In the event that nobody qualifies in the specific requirements for any of the respective
position in the USG Executive Department, the incumbent members of the Congress may
adopt a legislative measure to suspend, remove and/or add provisions in the specific
qualifications as they deem necessary; or convene SC Executive & Legislative Department,
LCM President, and CCO President per campus, for an internal election, through
nominations, with the presence of the ComElec, provided that nominees possess the
general qualifications set in the Constitution

SECTION 3: Qualifications for USeP-Student Council Executive Department Officers


(A) They must have at least one (1) year residency in the University
(B) They must not hold any key position of any existing clubs and/or organizations in their
respective campuses;
(C) They must have a prior student leadership experience in their respective campuses/units;
(D) The USeP-SC President and Vice Presidents for Internal and for External Affairs must have
attended seminar/s such as, but not limited to:
I. Leadership Enhancement Training
II. Strategic/Action Planning
III. Leadership Conventions

SECTION 4. Qualifications for USeP-SC HoR Legislators


(A) They must have at least one (1) year residency in the University of Southeastern
Philippines;
(B) They must not hold any key position of any existing recognized clubs and organizations in
the respective USeP-Campus/Unit;
(C) They must have intermediate knowledge in Parliamentary Rules and Procedures;
(D) They must have attended seminar/s such as, but not limited to:
I. Parliamentary Rules and Procedures Seminar
II. Resolution and Bill Making Seminar
III. Leadership Seminar

SECTION 5. Qualifications for USeP-Local Council Officers


(A) They must have at least one (1) year residency in the University.
(B) They must not hold any key position of any existing clubs and/or organizations in their

respective campuses.
(C) They must have basic knowledge of Parliamentary Rules and Procedures.
(D) The USeP-Local Council Governor and Vice Governor must have attended seminar/s such
as, but not limited to:
I. Strategic/Action Planning
II. Leadership Conventions

SECTION 6. Qualifications for USeP-Council of Clubs and Organizations Officers


(A) Executive Board Officers
I. They must be a club/organization president or an official representative of a duly
accredited club/organization;
II. In case of an official representative, they shall be among the officers declared upon
the issuance of the club’s or organization’s recognition application from which they
represents;
III. They must not be running for a position in the entire Student Council and those
down under;
IV. They must have one (1) more year of residency upon election; and
V. They must have basic knowledge on Parliamentary Rules and Procedures.

(B) Legislative Board Officers


I. They must be an incumbent club/organization president or an official representative
of a duly recognized accredited club/organization;
II. In case of an official representative, they shall be among the officers declared upon
the issuance of the club’s or organization’s recognition application from which they
represents;
III. They must come from the cluster where they are vying for; and
IV. They must have an intermediate knowledge of Parliamentary Rules and Procedures.

SECTION 7. Qualifications for the USeP-LCM Officers


(A) They must be an incumbent class mayor.
(B) They must have at least one (1) year residency in the University of Southeastern
Philippines.
(C) They must have an experience of being a student leader in the respective campuses.
(D) They must not be vying for any position in USeP-SC, USeP-LSC and USeP-CCO.
(E) They must not have a key position in any clubs and organization in their respective
campus, except for membership.
(F) The USeP-LCM Officers, excluding the USeP-LCM Sectoral Representative, shall
have basic knowledge of Parliamentary Rules and Procedures.

ARTICLE XIX
ELECTION

SECTION 1: Election Timeline


(A) The USeP-USG Elections shall be conducted on April or one (1) month before the end of
the second semester of the Academic Year provided that it is held before the USeP-Student
Council and Local Council Elections.
(B) After the Election, the Declaration of Newly Elected Officers shall be done two (2) days
after the election proper, and shall be posted to the USeP-SC Bulletin and Local Councils’
Official Social Media Pages, respectively.
(C) The USeP-CCO Elections shall commence two (2) weeks after the Declaration of previous
provision, respectively.
(D) The set of class officers shall be elected not later than the first two weeks of classes.
(E) The new set of USeP-LCM Officers shall be elected on the first (1st) week of September
or a week after the end of the first month of classes.
(F) Appointments for Commission on Audit (CoA) and Commission on Elections (ComElec)
shall be done one (1) week after the opening of the USeP-SC HoR, respectively.
(G) \The Oath Taking Ceremony shall commence one (1) week after the Declaration of Newly
Elected Officers for the USeP-USG, Student Council and Local Student Council; right after
Election for the USeP-LCM and CCO; and after the third reading of Resolutions to
Granting the Appointment of the Commissioners for the Commission on Audit (CoA) and
Commission on Elections (ComElec).

SECTION 2: Election process for the USG Executive Department


(A) The USeP-USG Election shall be conducted during the USeP-USG Year End Convention.
(B) The USeP-USG Congress can formulate a resolution to suspend the USeP-USG Election
in times of natural disaster/calamity or pandemic.
(C) The official voters per campus shall be (1) Student Council Executive Representative, five
(D) (5) Student Council Legislators, five (5) Organizational/Club Heads, and five (5) Class
mayors.
(E) The official voters per campus aside from the Vice-President for Internal Affairs must all
undergo the process of internal election a week prior to the conduct of the election.
(F) The chosen voters shall proceed to the voting area after the selection process.
(G) In the event that nobody qualifies in the specific requirements for any of the respective
positions in the USG Executive Department, the incumbent members of the Congress may
adopt a legislative measure to suspend, remove and/or add provisions in the specific
qualifications as they deem necessary; or convene SC Executive & Legislative Department,
LCM President and CCO President per campus, for an internal election, through

nominations, with the presence of the COMELEC, provided that nominees possess the
general qualifications set in the Constitution
(H) All the candidates are required to submit their Leaves of Absence (LOA) to the USeP-USG
Congress upon the receipt of the memorandum from the USeP-USG Commission on
Elections.
(I) The candidate who will have the highest number of votes shall be declared the new officer
for the position. The candidate who had the second highest number of votes shall be the
legible replacement whenever the position is vacated except for the USeP-USG President.
(J) Casting of votes shall be done through secret balloting, followed by the counting of ballots
to be closely monitored by the Office of Student Affairs and Services (OSAS). Should a
State of Calamity/Public Health Emergency and/or the like arise prior or on the Election
Proper, the manner of voting will automatically shift from Secret Balloting to an ONLINE
VOTING PLATFORM duly prepared and secured by the USeP-USG Commission on
Elections (ComElec), in coordination with the Office of Student Affairs and Services
(OSAS), accordingly; Proper, the manner of voting will automatically shift from Secret
Balloting to an ONLINE VOTING PLATFORM duly prepared and secured by the USeP-
USG Commission on Elections (ComElec), in coordination with the Office of Student
Affairs and Services (OSAS), accordingly;
(K) Proclamation of winners shall commence the day after the official canvassing of votes. The
resulting document must be duly signed by the USeP-USG Commission on Elections
(ComElec) and shall be posted through social media platforms, respectively.
(L) In case of a TIE on any USeP-USG Positions, the USeP-USG Commission on Elections
(ComElec) must conduct a re-election with the same sets of voters.
(M) In the event that nobody qualifies in the specific requirements for any of the respective
positions in the USG Executive Department, the incumbent members of the Congress may
adopt a legislative measure to suspend, remove and/or add provisions in the specific
qualifications as they deem necessary; or convene SC Executive & Legislative Department,
LCM President and CCO President per campus, for an internal election, through
nominations, with the presence of the ComElec, provided that nominees possess the
general qualifications set in the Constitution

SECTION 3: Election process for the University Student Government Congress


(A) The USeP-SC HoR shall have their election for the Representatives of their respective
Student Councils in the USeP-USG Congress.
(B) There shall be only five (5) representatives from each Student Council House of
Representatives of which the USeP-CCO and USeP-League of Class Mayors Sectoral
Representatives are automatically part of.
(C) When the election for USeP-USG Congress members has commenced, the USeP-USG

Congress will now officially open. Thus, one of their Agenda for the opening of the USeP-
USG Congress will be the election of their Chairperson and House Deputy Speaker. The
election will be presided over by the Incumbent Chairperson, to be relinquished to the
newly elected Chairperson, after they has taken their oath of office.
(D) After the election, the Incumbent Chairperson shall declare the results and shall preside
over the Oath of Office of the newly elected Chairperson and House Deputy Speaker.
(E) The Incumbent Secretary General will record and sign the election process of the Congress.

SECTION 4. Election Process for the Classroom Officers


(A) The USeP-LC Vice Governor shall be the one to facilitate the elections to each Class.
(B) The Election of Classroom Officers shall also be observed by the College/Department
COMELEC Commissioners.
(C) In case there are no duly elected officers in the LC by virtue of Failure of Elections in the
Local Council, it shall be the duty of the USeP-SC Vice President for Internal Affairs to
spearhead the election of Class Officers on behalf of the Local Council.

ARTICLE XX
FUNDING

TITLE I
SOURCE OF FUNDS

SECTION 1: General Administrative Fund - refers to the fund collected by the Council to its
members, may it be in the form of registration, membership or council fee.

SECTION 2: Income Generating Fund - refers to the fund generated through the initiative of
the student leaders in business and entrepreneurship.

SECTION 3: Trust Fund - refers to the fund allocated as a support by the higher office; a form
of monetary fund that will sustain the operations of the organization. One-hundred percent (100%)
of this fund will be intended for flexible budget utilization.

TITLE II
BUDGETING

SECTION 1: The Budget Utilization Breakdown and Allocation for the USeP-Student Council
and USeP-Local Student Council will be as follows.
(A) Fixed Budget Utilization (40%)
I. Projects

This will have fifty percent (50%) of the Fixed Budget Utilization. This will be

intended for tangible and/or intangible projects to be produced by the Council per
semester.

II. Council Allocation to lower offices


This will have twenty-five percent (25%) of the Fixed Budget Utilization. This
allocation is intended to the lower offices under the USeP-SC, namely the USeP-
LCM, USeP-CCO, USeP-SC HoR and the two (2) constitutional commissions,
namely the USeP-CoA and USeP-ComElec. The distribution of this allocation will
be upon the decision of the USeP-SC HoR, and shall be subject for approval by the
USeP-SC President.

III. Income Generating Allocation


This will have twelve percent and a half (12.5%) of the Fixed Budget Utilization.
This allocation is utilized upon the existence of any proposed income generating
projects. This will be the responsibility of the USeP-Student Council Vice President
for Business and Information, in coordination with the USeP-Student Council,
respectively.

IV. Depository
This will get twelve percent and a half (12.5%) of the Fixed Budget Utilization.
This allocation will not be used, unless given justifiable and reasonable cause. This
will be considered as the savings of the council.

(B) Flexible Budget Utilization (60%)


I. Student Development
The student development will have seventy percent (70%) of the Flexible Budget
Utilization. This budget is intended for student activities, competitions, training,
seminars, and those not mentioned herein that benefit themselves to becoming well
rounded individuals.

II. Student Leaders Development


The student leaders' development will have ten percent (10%) of the Flexible
Budget Utilization. This is a budget to support the activities of the student leaders
such as meetings, seminars, training, and other activities not mentioned herein.

III. Operational Expenses


The operational expenses will have twenty percent (20%) of the Flexible Budget

Utilization. This budget is intended for the office supplies of the council.

Utilization. This budget is intended for the office supplies of the
council/commission.

ARTICLE XXI
MEETINGS, SEMINARS, TRAININGS, AND CONVENTIONS

SECTION 1: The USeP-USG Executive Department shall have a regular meeting every month.

SECTION 2: The USeP-USG may also conduct a special meeting upon the approval or request
of the USeP-USG President.

SECTION 3: The USeP-USG shall conduct seminars, trainings, and conventions that are relevant
to its departments and the entirety of the USeP-USG, every academic year. These events shall
include but not limited to the following:
(A) Pre-Leadership Seminar;
(B) University Leadership Enhancement Training;
(C) Mid-Year Convention; and
(D) Year End Convention.

SECTION 4: Seminars, training, and conventions shall take place, but shall depend on the
availability of the Schedule and to the discretion of the USeP-USG.

SECTION 5: The following seminars, trainings, and conventions shall have the following
highlights, which will not be limited to:

SECTION 6: All USeP-SC HoR shall submit and present resolutions or bills during the Mid-year
Convention of the USeP-USG.

SECTION 7: The USeP-USG Congress shall have the discretion in determining the schedule of
their sessions.

ARTICLE XXII
ADVISER

SECTION 1: An adviser should be responsible for giving advices, suggestions and notifications
as well as approval for the USeP-USG, Student Council, Local Student Council, League of Class
Mayors, Council of Clubs and Organizations, Commission on Audit, Commission on Elections
and all duly recognized clubs and organizations, respectively.

SECTION 2: The officers of the USeP-USG and other student governments, under its jurisdiction,
as a body, are reserved with the right to choose whom they are to appoint as their adviser, provided
that the preferred adviser is a full-time faculty member of the University or a full-time employee
of the University, respectively. Preferred advisers are those faculty members assigned by the

faculty to be in-charge of student relations. A letter of intent shall be sent by the USeP-USG and
other student councils, under their jurisdiction, to their preferred adviser. The appointed adviser
shall send a letter of acceptance to the specified offices upon receipt of the letter. The concerned
office shall then issue a resolution for the appointment of their Preferred Adviser.

ARTICLE XXIII
IMPEACHMENT, RECALL, RESIGNATION AND VACANCIES

SECTION 1: Any officers of any distinguished offices can be impeached on the grounds of
negligence of duties stipulated under this act, and corruption, which shall be bound by the
following justifications herein:
(A) Impeachment by their constituents through a call for re-election to be raised upon a two
thirds (⅔) vote of all its members and definitely the University of Southeastern Philippines
students or its co-officers when a legal document is presented;
(B) Impeachment by their constituents when caught conniving with rebellious acts of
terrorizing against the student body, the University and/or the Filipino mankind;
(C) Any officers of any distinguished offices shall be impeached through a legislative due
process
(D) Failing grades during the tenure of office of any officers shall be considered as a ground
for expungement; and
(E) Consecutive absences of any officers during sessions, meetings, committee hearings, and
the like shall be regarded grounds for impeachment.

SECTION 2: This USeP-USG Constitution may be revised by a two-thirds (⅔) vote of all the
members of the USeP-USG Congress, provided that prior notice of such proposed amendment is
given to all members, and that no provision herein which is based on, or prescribed by, existing
laws shall be amended, provided further that the proposed provision shall undergo a plebiscite
process for final approval.

SECTION 3: Any officers of any distinguished offices are subject to recall in its inefficiency in
the position exercised by the USeP students.

SECTION 4: Any officer has the right to file a resignation, provided that they have a valid reason
for doing such an act.

SECTION 5: All vacancies in the roster shall be filled through appointment, may be filled by
appointment, and all appointments shall be approved by the Legislative Department. (delete)

SECTION 6. Rule of Succession. In cases of vacancy in the highest position of the USeP-USG,
USeP-CCO, USeP-LCM, and USeP-LC. The next officer, according to the hierarchical structure,
shall assume the roles, duties and responsibilities of the vacated position.
(A) In cases of vacancies in the positions except the highest position, the vacancies shall be
filled by the candidates who have garnered the second highest votes for the election of the
position. These vacancies shall be filled with the coordination and supervision of both the
Legislative Department and COMELEC.
(B) The officer filling in the vacated position can fully function and assume the roles and
responsibilities of the vacated position after taking an oath of office as led by proper
authorities.

ARTICLE XXIV
AMENDMENTS AND REVISION
SECTION 1: This USeP-USG Constitution may be amended by a two-thirds (⅔) vote of all the
members of the USeP-USG Congress, provided that prior notice of such proposed amendment is
given to all members and provided further that no provision herein which is based on, or prescribed
by, existing laws shall be amended.

SECTION 2: This USeP-USG Constitution may be revised by a two-thirds (⅔) vote of all the
members of the USeP-USG Congress, provided that prior notice of such proposed amendment is
given to all members, and that no provision herein which is based on, or prescribed by, existing
laws shall be amended, provided further that the proposed provision shall undergo a plebiscite
process for final approval.

ARTICLE XXIV
FINAL PROVISION

SECTION 1: Transitory Clause. - All transitory provisions shall only be applicable to the USeP
Student Council, Local Council, Council of Clubs and Organizations, League of Class Mayors and
Constitutional Commissions as stipulated.

SECTION 2: Retaining Clause. - All documents that existed before the approval of this
constitution shall be retained as long as it does not refute this Constitution.

SECTION 3: Separability Clause. - If any provision of this Constitution is found to be invalid,


all other provisions not affected shall remain in effect.

SECTION 4: Repealing Clause. - All laws, resolutions or ordinances inconsistent with this

Constitution are hereby repealed or modified accordingly.

ARTICLE XXV
EFFECTIVITY

SECTION 1: This Constitution shall undergo a plebiscite after the approval of the 2/3 votes of
the total members of the USeP-USG Congress;

SECTION 2: This Constitution shall take effect through a plebiscite with a gathered signature of
the majority (50% + 1) of the total population of the students of the University of Southeastern
Philippines, duly authored by the USeP-USG Congress-Committee on Constitutional Revision and
Amendments of Codes, duly acknowledged by the USeP-Student Council Advisers and the Office
of Student Affairs and Services Director and Campus/Unit Coordinators.

The foregoing proposed USeP–USG Constitution was approved through a plebiscite made

possible by the USeP-SSG-Committee on Constitutional Revision and Amendments of Codes on

the 10th day of NOVEMBER, Two Thousand and Twenty-One, acknowledged by the USeP-

Student Council Advisers, and the Office of Student Affairs and Services Coordinators, whose

signatures are hereunder affixed.
