JUDICIAL COMPLAINT-AFFIDAVIT
This Judicial Affidavit was taken at the office of PLTCOL Kyle
John Lagunda Gurro at Gingoog City Police Station.

This complaint-affidavit in judicial form is offered pursuant to

Administrative Matter No. 12-8-8-SC, for the following purposes;
1. To establish probable cause for the filing of an information for
violation of Article 266-A (RAPE) of the Revised Penal Code
(R.A 8353) against Fulgoso Ambongan, Justy Ambongan and
Fred Meamoy.
2. To identify and testify on relevant and material documents; and
3. To prove all other matters material and relevant to the case;

Questioned were propounded by PLTCOL Kyle John Lagunda Gurro

and these questions are numbered consecutively and each question is
followed by the answer of the complaint.
Question No.1 (Q1): Do you swear to tell the truth and nothing but

A3: I am Maria O. Sawa 21 years old, single, a 2nd year college student
of Gingoog University and a resident of Brgy Sanjuan, Purok-3,
Gingoog City. (Ako si Maria O. Sawa, baynte uno anyos, dalaga,
estudyante sa ikaduhang tuig sa kolehiyo sa Gingoog unibersidad ug
residente sa Brgy Sanjuan, Purok-3, Gingoog City)
Q4. Why are you here in my office? (Ngano naa man ka sa akong

A4: To give my statement and I want to file a Criminal charge for
Rape against Fulgoso Ambongan, Justy Ambongan and Fred

Q5: Who is Fulgoso Ambongan? (Kinsa si Fulgoso Ambongan?)
A5: He is the cousin of my classmate Thalia Ambongan Meamoy. He
is 24 years old, Single, and a resident of Brgy Malibud, Gingoog City.

Q6: Who is Justy Ambongan? (Kinsa si Justy Ambongan?)
A6: He is the cousin of my classmate Thalia Ambongan Meamoy.
And he is the brother of Fulguso Ambongan. Justy is 22 years old,
Single, and a resident of Brgy Malibud, Gingoog City. (Ig-agaw siya
sa akong classmate nga si Thalia Ambongan Meamoy ug igsoon siya
ni Fulgoso Ambongan. Baynte dos anyos, ulitawo, ug residente sa
Brgy. Malibud, Gingoog City.
Q7: Who is Fred Meamoy? (Kinsa si Fred Meamoy?)
A7: He is the cousin of my classmate Thalia Ambongan Meamoy. He
is 23 years old. Single, and a resident of Brgy Malibud, Gingoog City.

A8: She is my classmate and also a best friend. She is 21 years old,
Single, and a resident of Brgy Malibud, Gingoog City. (Classmate
nako siya ug best friend sab nako. Siya baynte uno anyos, dalaga, ug
residente sa Brgy. Malibud, Gingoog City.)
Q9: Why are you now filling a criminal case for Violation of Article
266-A (RAPE) against Fulguso Ambongan, Justy Ambongan and
Fred Meamoy? (Nganong nagpasaka man ka karon og kasong
kriminal alang sa Paglapas sa Article 266-A (RAPE) batok kang
Fulguso Ambongan, Justy Ambongan ug Fred Meamoy?)
A9: Because they had sexual intercourse with me against my will.
(Tungod kay nakighilawas sila kanako nga supak sa akong kabubut-
on.)
Q10: When did Fulgoso Ambongan, Justy Ambongan and Fred
Meamoy violated you? (Kanus-a nakalapas kanimo si Fulgoso
Ambongan, Justy Ambongan ug Fred Meamoy?)
A10: It was October 5, 2022. Around 11pm in the evening when they
raped me. (Kaniadtong Oktubre 5, dos mil baynte dos. Mga alas onse
sa gabii dihang gilugos ko nila.)
Q11: Can you tell me what happened? (Mahimo ba nimo isulti
kanako kung unsa ang nahitabo?)
A11: On the morning of October 5, 2022, Thalia invites me to their
house at 6 p.m. since she is having a birthday celebration. At around
6 pm, I am here at Thalia’s house, having fun and jamming with the
celebrant and his family and relatives. At around 8 pm, her cousin
proposed buying "Red Horse", and we drank together with Thalia’s
cousins, Fulgoso Ambongan, Justy Ambongan, and Fred Meamoy.
That night, we drank six bottles of Red Horse. Around 11 pm, I
decided to go home because I was dizzy, and I told Thalia's parents
that I was going home and her cousins, Fulguso, Justy, and Fred,
insisted that they take me home. So, I got into their car and suddenly
fell asleep, and when I woke up, I thought we were at home, but we
were not. They brought me to a quiet place without neighbors, so
that is where it all started. (Sa buntag sa Oktubre singko, dos mil
baynte dos, giimbitar ko ni Thalia sa ilang balay sa alas sais sa gabii.

Nianang gabhiona, miinom mig unom ka botelya sa Red Horse. Mga
alas onse sa gabie naka nakahukom ko nga muuli kay nalipong ko,
ug giingnan nako ang pamilya ni Thalia nga muuli ko ug iyang mga
ig agaw nga sila Fulguso, Justy, ug Fred, miinsister nga ihatod ko nila
sa balay. So mao to nisakay ko sa ilaha ug kalit nga nakatulog, ug
pagmata nako, abi nakog naa mi sa balay, pero wala. Gidala ko nila
sa hilom nga dapit nga walay mga silingan, mao nga didto nagsugod
ang tanan.)
Q12: What happened next? (Unsay sunod nga nahitabo?)
A12: They forced me to have sex by the three cousins of Thalia.
Fulgoso took off my shirt and pants and Justy first inserted his penis
into my vagina while Fred squeezing my boobs while masturbating
on my face. After Justy Ambongan satisfying his carnal desire, then
Fulgoso Ambongan licked my vagina and he started inserted his
penis in my vagina, after Fulgoso ejaculated inside my vagina. Fred
followed, he inserted his three fingers on my vagina and started to
inserted his penis on my vagina which it was very hurt. I cried a lot
and I cannot do a thing to fight them because I have no strength to
fight them. (Gipugos ko nila nga makighilawas sa tulo ka ig-agaw ni
Thalia. Gihubo ni Fulgoso ang akong kamiseta ug karsones ug unang
gisulod ni Justy ang iyang kinatawo sa akong kinatawo samtang si

akong nawong. Human matagbaw ni Justy Ambongan ang iyang
unodnong tinguha, dayon gitilapan ni Fulgoso Ambongan ang akong
puwerta ug gisugdan niya pagpasulod ang iyang kinatawo sa akong
kinatawo, human nigawas si Fulgoso sulod sa akong kinatawo.
Misunod si Fred, iyang gisulod iyang tulo ka tudlo sa akong
kinatawo ug gisugdan niya pagpasulod ang iyang kinatawo sa akong
kinatawo nga sakit kaayo. Naghilak ko pag-ayo ug wala akoy
mahimo aron makig-away kanila tungod kay wala akoy kusog nga
makig-away kanila.)
Q13: What did you do after that? (Unsay imong gibuhat human
niadto?)
A13: I begged them to stop, they stop after they have been satisfied.
They have threatened me not to tell others what happened or else
they will kill me and my parents. After that they took me home by
car. (Gihangyo ko sila nga mohunong, mohunong sila human sila
matagbaw. Gihulga ko nila nga dili isulti sa uban kung unsa ang
nahitabo o patyon nila ako ug akong mga ginikanan. Human niadto

A14: I was able to home at 4:30 am, I still crying and my mother Petra
O. Sawa, was worried about me and she forced me to tell what
happened, so I tell her that I was raped by the cousins of Thalia and I
suddenly fainting. (Nakauli kog alas kwatro y media, naghilak
gihapon ko ug akong mama Petra O. Sawa, nabalaka nako ug
gipugos ko niya nga isulti ang nahitabo, mao nga ako siyang
giingnan nga gilugos ko sa mga ig-agaw ni Thalia ug ako kalit

Q15: What did your mother do after she found out? (Unsa ang
gibuhat sa imong inahan pagkahuman niya nahibal-an?)
A15: My mother was very angry with Thalia's cousins and she
accompanied me to the Gingoog City Police Station which is the
nearest Police Station. Police Staff Sergeant (PSSg) Stephen Curry
took my statements and he helped me file the Police Blotter of the
case. I have here a copy of the said Police Blotter. (Nasuko pag-ayo

Gingoog City Police Station nga mao ang pinakaduol nga Police
Station. Gikuha ni Police Staff Sergeant (PSSg) Stephen Curry ang

Blotter sa kaso. Naa koy kopya sa giingon nga Police Blotter.)

Q17: After making the Police Blotter. (PSSg) Stephen Curry told us
that we should examined my body for semen or other bodily fluids.
So, we went to Lipunan Hospital to examined my body. (Human sa
paghimo sa Police Blotter. (PSSg) Gisultihan mi ni Stephen Curry nga
kinahanglan namong susihon ang akong lawas alang sa semilya o
ubang mga likido sa lawas. So, niadto mi sa Lipunan Hospital para
ipa-eksamin akong lawas.)
Q18: What happened to the Lipunan Hospital? (Unsay nahitabo sa
Lipunan Hospital?)
A18: When we arrived at Lipunan Hospital Pssg. Stephen Curry
explained to the receiving staff about what happened. Then they
brought me to examination room and I was examined by Dr. Roel
Macapilit. It was found out that I have suffered vaginal laceration.
Dr. Roel Macapilit issued this Medical Certificate to that effect.
