HACKING OF THE WALL AND/OR ANY PART OF THE STRUCTURE IS STRICTLY PROHIBITED AS
THE WALL IS A LOAD BEARING WALL CONSTRUCTED BASED ON SHEAR WALL TECHNOLOGY.

PART (A) : RENOVATION APPLICATION


1) For the purpose of this Property Renovation Application Form (PRAF), all reference to Owner shall include parcel owner
or parcel owner’s tenant or licensee with written permission by parcel owner to occupy the unit in question.
2) If applicant is NOT the parcel owner of the unit in question, parcel owner’s Consent and Indemnity shall be duly signed by
the parcel owner giving written consent for the renovation work as applied hereunder to be carried out within the said unit
in the manner prescribed by the Management Office.
3) If applicant is the parcel owner of the unit in question, parcel owner(s) Indemnity and Declaration shall be duly signed by
the parcel owner for the renovation work as applied hereunder to be carried out within the said unit in the manner
prescribed by the Management Office.

PROPERTY RENOVATION – TERMS & CONDITIONS

1.0 PROPERTY RENOVATION TERMS & CONDITIONS :

(For the purpose of this Property Renovation Terms and Conditions, reference to ‘Owner’ herein shall
include parcel owners and tenants which are able to produce to Management Office ‘Parcel Owner consent
and Indemnity’ duly signed by relevant parcel owner.

Application & approval processing period takes 7 to 14 working days


1.1. Prior to carrying out any renovation work, approval of Management Corporation (Management Office) must
first be obtained before commencement of any renovation work. Owner(s) must submit their Renovation
Application Form to Management Office together with the following documents:

1.1.1. 2 sets of plans and circuit drawings of electrical modifications, if applicable;


1.1.2. The scope of renovation work including installation of electrical equipment, if applicable;
1.1.3. A copy of work schedule;
1.1.4. Particulars of contractor(s), complete with photocopy of trading license, workers’ IC or
passport and work pass;
1.1.5. Parcel owner consent and indemnity duly signed by the owner if the applicant stated in this
Renovation Application Form is a tenant;
1.1.6. Such other documents as may be required and notified by time to time by Management Office.

1.2. All Renovation Application shall be subject to the approval of Management Office which approval shall be
granted, granted with conditions or denied at its sole and absolute discretion. Management Office shall
have the right to approve any Renovation Application attached with conditions and the owner together with
the appointed contractor shall be required to carry out such renovation work in strict adherence to the said
conditions imposed by Management Office.

1.3. Renovations works are advised to be carried out after the initial defects repairment has been
completed, in such the defect list has been submitted to the developer after key handover. If the
renovation works carried out includes the defective area, while the repairments are not yet completed,
the defect liability for that area will VOID. The owner will also be responsible to repair the area with
own costs.

1.4. If replacement of tiles are to be done, the defect liability for the area will VOID. Owner shall give an
undertaking to the Management whereby owner agrees to be responsible to do proper water-proofing
with water leaks test. Any future leaks after tiles replacement must be repaired by the owner within
14 days of being notified of such complaint.

2.0 RENOVATION LIMITS

2.1 All renovation works shall be strictly confined to the limit of the units. Knocking down and hacking of
structural slabs, columns, walls, beams and renovation or alterations to the common areas are STRICTLY
PROHIBITED.

2.2 Prior approval must be obtained from the Fire Department (BOMBA) for any changes to the main
entrance to the individual unit.

2.3 All local council by-laws must be strictly adhered to.

2.4 No renovation or alteration to the external façade of the parcel shall be allowed.

2.5 No extra tap or extension shall be allowed at the water meter.

2.6 No reflective film for the window tinted. (Only dark tinted window allowed)

2.7 All drain pipe openings, where renovation work is undertaken, must be covered to avoid any debris
from failing into the drain / pipe and cause blockage to it.

3.0 RENOVATION DEPOSIT

3.1 A refundable renovation deposit of RM 3,000.00 as stated (subject to the duration of the renovation works
to be carried out to the parcel) shall be paid by the owner / contractor to the Management Office at least three
(3) days prior to commencement of renovation works.

3.2 Renovation deposit is paid to ensure that the renovation complies with the renovation rules and
regulations guidelines and the renovation plan, all unwanted debris are cleared away and disposed off

and that no common property and / or other owners’ property suffer any damage.

3.4 In the event any parts of the common area are dirtied, damaged or debris are not properly removed,
the Management Office shall without any notice undertake to clean, remove and repair the areas
affected and the cost incurred shall be deducted from the renovation deposit or billed directly to the
contractor concerned.

3.5 Should the repair, clearing and cleaning cost exceed the renovation deposit, the owner / contractor
shall have to pay the difference / excess.

3.6 Each unit deposit is NOT TRANSFERRABLE to be used for other units.

4.0 JOINT INSPECTION


A joint inspection shall be conducted together with the owner and contractor and the Management Office
to confirm that renovation works has been completed and the premises is kept clean and no damage was
done to any part of the working area and common property / adjacent units.

5.0 REFUND OF RENOVATION DEPOSIT

5.1 The refund of renovation deposit shall be made within two (2) months after receipt of written
confirmation of joint inspection by the owner, contractor and the Management to confirm that all
renovation works have been satisfactorily completed.

5.2 Owners may request for the renovation deposit to be refunded in the way of making a contra to their
outstanding management charges.

6.0 CLEARANCE

6.1 Contractors are required to present to the personnel at the guard house the Renovation
Application Form that have been approved by Management in exchange for Contractor’s Pass to
access and enter the project site.

6.2 Our security personnel shall have the absolute right to deny access to any contractors who fails to
produce the requisite approved Renovation Application Form. Furthermore, access shall be
denied to workers whose names are not listed in the approved Renovation Application Form.

6.3 All contractors together with their respective workers shall be required to register with the Guard
House personnel and shall at all times wear the contractor pass.

6.4 Overnight stay at renovation site is strictly prohibited. Any contractors and/or their workers who
fail to leave renovation site by 5:00pm of the relevant work day shall be treated as trespassers.
Contractors and their workers shall be required to report to the Guard House at the end of each working
day to return the contractor’s pass.

6.5 Contractor shall be solely responsible and shall be solely liable and accountable to relevant authorities in
respect of workers hired by the said contractor to carry out the renovation work. In the event it is discovered
that the contractor had brought in or permitted or allowed to be brought in any workers without proper work
pass (if applicable), a police report shall be lodged against the worker and the contractor and if discovered
by relevant authorities, the contractor shall indemnity and save harmless the Management against any and

all claims, fines, prosecutions, liability resulting from the contractor having caused to be brought in the said
illegal workers.

6.6 In the event of loss of Contractor Pass, the contractor shall be required to pay RM50.00 for each
pass lost.

7.0 INSTALLATION OF AIR-CONDITIONER / GRILLES / KITCHEN CABINET

7.1 Installation of air-conditioning units, compressors, grilles, kitchen cabinet, etc shall be carried out properly
and shall strictly conform to the standards, designs, location and regulations of the Management (Standard
design/pattern and installation location plan can be obtained from the Management Office).

7.2 In the event of breach or non-compliance, the Management reserves the right to without any reference
to owner, dismantle or relocate items not in compliance with standards, requirements, rules and
regulations determined.

7.3 All costs incurred as stated in paragraph 7.2 above shall be billed by the Management Office to the relevant
owner’s account.

7.4 Air-Conditioning
7.4.1 All air-conditioners wiring and piping shall be concealed with trunking from the compressor to
the air-conditioning units
7.4.2 Air-conditioning drain pipes shall be installed according to the design and requirement of the
Management. The Management must be consulted before the installation of the aircondition unit.
Exposed trunking and pipes must be painted with the color scheme matching the external walls on
which the installation is affixed
7.4.3 When removing air-conditioning units, the brackets must also be removed and holes on the walls
must be filled up and repainted with original / similar color scheme paints.

7.5 Grilles
7.5.1 At least one opening to metal grilles is recommended for fire escape or other emergencies
7.5.2 Installation of grilles are strictly prohibited at the common areas
7.5.3 All grilles must be painted and installed with the color and design as decided and advised by
the Management Office to ensure the uniformity of color and design of grilles.

8.0 RESPONSIBILITY AND COVENANTS BY OWNER(S) / TENANT (S)

8.1 The owner shall be responsible for the proper conduct of their appointed contractors and shall ensure that:-
8.1.1 All materials shall be properly wrapped, contained and packed whilst being transported to the
premises by using Bomba lift only. Any contractor using passenger lift will be fined and deducted
from the renovation deposits.
8.1.2 The contractors must ensure that there is no excessive noise whilst undertaking renovations or
repairs works.
8.1.3 All renovation debris, including packing and crafting material shall be removed and disposed off by
the contractors concerned to the approved dumping grounds away from the property building.
8.1.4 Inconvenience shall not be caused to other residents whilst using the staircase
8.1.5 Water and electricity supply shall not be obtained from the common areas supply.

8.2 The owner hereby agrees to permit the Management’s authorized personnel, at all reasonable times,
to enter upon the parcel to view the condition thereof when the renovation is in progress.

8.3 The owner hereby agrees and covenants with the Management that the owner shall:
8.3.1 ensure that the owner’s design plan and drawings in respect of the proposed renovation work shall
comply with all applicable laws, by-laws, rules, regulations and requirements as may be imposed
by the Appropriate Authority and that the design plan and drawings shall be drawn by competent
professional
8.3.2 upon receipt the approval from the Management office, submit the design plan of the proposed
renovation works fit out of the said property to the Appropriate Authority for approval and obtain
such approval from the Appropriate Authority.

8.3.3 indemnity and keep the Management and Developer indemnified against all fines, penalties,
charges, claims, liabilities, damage, losses, Appropriate Authority vis-à-vis the renovation works
within the said property
8.3.4 prior to the commencement of the renovation works of the said Property, take out at the owner’s
own cost and expenses an insurance policy with an insurance company in respect of:-
a) comprehensive general liability insurance with broad form endorsement, including
personal injury liability and workmen’s compensation ; and
b) all risks insurance on the fixture, equipment and machinery vis-à-vis the renovation of the
said Property, and punctually pay all premiums thereto; the owner shall upon demand
forward the Management the original policy for the inspection
8.3.5 at its own costs and expenses fit out or make renovation at the said Property strictly in accordance
with the design plan, drawings, specifications, fittings and fixtures as approved by all the parties
concerned as required in this Application Form and complete the fitting out and renovation works
of the said Property in workmanlike manner within the estimated renovation period stipulated in
this Application Form
8.3.6 repair and/or make good to satisfaction of the Management Office any damage caused to the
adjacent or neighboring property and/or the common property, irrespective of whether such damage
was caused directly or indirectly as a result of the renovation works carried out by the owner in
respect of the said Property, failing which the Management Office shall be entitled to cause such
work to rectified or corrected in the manner as required by the architect of the Management and all
costs and expenses incurred thereof shall be borne by the owner and shall be a debt due to the
Management Office to be paid by the owner to the Management Office to be reflected in the owner’s
next billing.

9.0 NO DAMAGE TO COMMON AREA / COMMON PROPERTY

The owner shall:-


9.1 make good any damage or breakage to the common property / common area, any adjoining
premises or facilities or any part thereof occasioned by the want of care, or due to negligence,
careless acts or omission on the part of the owner, appointed contractor, its servants, agents or
such other persons authorized to carry out the renovation work in question
9.2 keep the passage ways, corridors, stairs and entrances leading to from the said property clear and
free from rubbish and dirt
9.3 not store any goods within the Common Property or in any manner obstruct, litter or make untidy
9.4 not throw, place or allow to fall or cause or permit to be thrown or placed in the stairway shafts,
water closets, lavatories, convenience, sweepings, dirt, rubbish, waste paper or any unsuitable
substances
9.5 The owner shall be solely responsible for all costs and expenses involved in repairing and making
good the damage caused to the Common Property to the satisfaction of the Management. In the
event the owner(s) refuse/or neglect the repair and making good as aforesaid, the same shall be billed by
the Management Office to the owner as a debt due to the Management Office for having to incur cost and
expenses to repair the same.

10. INDEMNITY

In addition to all above-stated, the owner shall indemnify and keep the Management and Developer fully indemnified
against all actions, claims, proceedings, demands, losses, damage, costs and expenses arising from or in
connection with:

10.1 all suits, appeals, penalties, claims, proceedings, actions, costs, losses, charges and expenses which the
Management and Developer may sustain, incur or pay arising out of or in connection with any act,
omission, breach, default or neglect on the part of the owner or appointed contractor, its servants,
employees, workers, staff;
10.2 any loss or damage cause to the said adjoining or neighboring or common property;
10.3 the overflow, leakage or escape of water, smoke, fire, electricity, fumes or other substance whatsoever in
or from the said Property or caused or appointed contractor, its servants, employees , worker, staff;
10.4 any loss, damage or injury or death from any cause whatsoever to the property or person or to the said
Property caused or contributed by the use of the said Property during the renovation period or by an act,
omission, neglect, breach or default by the owner or appointed contractor, its servants, employees, workers,
staff;

10.5 any breach or non-observance by the owner or appointed contractor, its servants, employees, workers, staff
of any of the provisions of this Renovation Application Form of the Rules and Regulations stipulated
herein;

10.6 any damage caused to the common property / common area whether directly or indirectly from the
renovation work in respect of the said property;
10.7 any breach or non-observance by the owner of appointed contractor, its servants, employees, workers, staff
towards the additional terms and conditions imposed by the Management and Developer from time to time;
10.8 any breach or non-observance by the owner or appointed contractor, its servants, employees, workers, staff
towards all laws and legislation, rules and relations, circular, directives, by-laws and standard operation
procedure (SOP) imposed by any governmental organization.

11. ELECTRICAL WORKS


All electrical works must comply strictly with SESB regulations and to be carried out only by licensed electrician.

12. WORKING HOURS


Renovation, delivery and removal works shall be carried out only during the following times:

Monday to Friday : 8.00am to 5.00pm


Saturday : 8.00am to 12.00pm (Heavy work)
: 1.00 pm to 5.00pm (Non-noisy work)
Sunday / Public holiday : STRICTLY NO WORKS ALLOWED

13. DAILY INSPECTION
The management will do daily inspection every Monday to Saturday in certain units to ensure that the renovation works
are being carried out accordingly. Contractors shall fill in the schedule below with information of the number of
workers working inside the unit, type of work carried out in the unit according to their specific working days and time.

said unit, hereby expressly unconditionally and irrevocably confirm declare and covenant that I/We have read and

covenant that I/We at all times adhere and compliance with the said terms and conditions and to abide by all
directions as may be given from time to time by the Management in the carrying out of the renovations works
applied hereunder. In the event of failure, refusal and/or neglect on my/our part to adhere to the said terms and
conditions as well as directions from the Management

I/We hereby acknowledge and agree that Management shall have the absolute right to deny access to the Contractor
in default into this project and I, the owner shall be fully responsible and liable to the Management in the event of
any damage claims actions fines arising or resulting from my breach of these terms and conditions. I/We hereby
undertake to be fully responsible for all renovation work to be carried out and hereby warrant that the renovation
work shall be carried out strict adherence and compliance with the above-stated terms and conditions and I/We
shall fully indemnify the Management in respect of any injury or death to persons or any damage to adjacent
properties or damage to common property / common area arising or resulting from the renovation work within the
said property.
