    AGREEMENT TO INDEMNITY

    This Agreement made at Badlapur this 26th day of July 2021 executed by
    Smt.Madhavi Shrikant Khanvalkar w/o S.M. Khanvalkar aged 70 years, residing at
    Badlapur hereinafter called the DEPOSITOR (2) Smt. Madhavi Shrikant
    Khanvalkar w/o S. M. Khanvalkar aged 70 years, residing at 10, Sharmili
    Apartment Wanilane, Gajanan Nagar, Karjat road, Kulgaon, Badlapur (e) 421503
    the parties (1) and (2) hereinafter collectively called the INDEMNIFIERS which
    expression shall wherever the context to admits or requires, mean and include their
    respective successors and assigns in favour of Canara Bank, a body corporate,
    constituted under the Banking Companies ( Acquisition and Transfer of
    Undertaking) Act, 1970 with its Head Office at 112, J C Road, Bangalore – 560
    002 and among others a branch office at Jadhav market, opp.railway station,
    Badlapur (w) which expression shall wherever the context so admits or requires
    shall mean and include its successors and assigns.

    WHEREAS the Depositor had deposited a sum of Rs. 1,00,000/- (One lakh Only)
    in Fixed / Kamadhenu Deposit with the Bank at 7 % interest for a period of 365
    days/weeks/months for which the Bank issued the deposit receipt bearing Fixed/
    Kamadhenu Deposit Receipt No. 0215-415000452 dated 15/7/2019 and

    WHEREAS the Depositor has lost or misplaced the said Fixed/ Kamadhenu
    Deposit Receipt and the same is not traceable, and

    WHEREAS the Depositor has represented to the Bank that he has lost the said
    Fixed/ Kamadhenu Deposit Receipt and he may be issued a duplicate Fixed/
    Kamadhenu Deposit Receipt, and

    WHEREAS the Depositor has also assured the Bank and the Fixed/ Kamadhenu
    Deposit Receipt remains untraced and that in case the receipt is found/ the
    Depositor comes into possession of the same at any time, he will immediately
    inform the Bank and hand over the same to the Bank, and

    WHEREAS the Bank has agree to issue a duplicate Fixed/ Kamadhenu Deposit
    Receipt in condition that the depositor along with two other respectable and
    creditworthy persons shall indemnity the Bank against all losses etc., that may be
    caused to the bank as a consequence of issuing a duplicate Fixed Deposit Receipt/
    Kamadhenu Deposit Receipt.

    IN CONSIDERATION OF THE PREMISES, the indemnifiers execute this


    indemnity and this Deed witnessed as follows:
    In consideration of the Bank issuing a duplicate Fixed/ Kamadhenu Deposit
    Receipt referred to above bearing No …………… date…………..
    Rs………………… (Rupees………………………………………………….) the
    original of which has been lost and has not been pledged, transferred or assigned to
    any other person, the Depositor and the Indemnifies hereby jointly and severally
    agree to indemnify and keep indemnified the Bank, their successors and assigns
    harmless against all loss, claims, costs, charges, expenses and consequences that
    may arise from their so issuing a duplicate Fixed Deposit Receipt/ Kamadhenu
    Deposit Receipt and from wrongful dealing or encashment of the original
    FDR/KDR in any manner whatsoever or any other consequence connected with the
    said FDR/KDR or duplicate thereof and we, the said depositor and the
    Indemnifiers further undertake to deliver to the Bank the said original FDR/KDR,
    if and when found.

    IN WITNESS WHEREOF THE Depositor and the Indemnifiers have hereunto


    affixed their respective hands the day and year first above written.
