    DEED OF ASSIGNMENT OF RIGHTS AND ASSUMPTION OF LOAN / MORTGAGE

    KNOW ALL MEN BY THIS PRESENTS:


    This, Deed of Assignment of Rights and Assumption of Loan /Mortgage made and
    executed this 9th of January, 2023 at the City of Baliuag, Province of Bulacan between :
     
                MARIO SALVADOR T. BALDADO, Filipino, of legal age, a resident of 1118 Lirio St.,
    Barrio San Jose Tala, Brgy 187, City of Caloocan, National Capital Region, hereinafter known
    as the TRANSFEREE, and LAYCA N. GATMAITAN, Filipino, of legal age, single, a resident of 
    371 Alicia St., Aurea Vill., Subic, Baliuag City, Bulacan and hereinafter known as the
    TRANSFEROR.
    WITNESSETH THAT :
     
    1. That the TRANSFEROR is the registered owner of a motor vehicle (single motorcycle
    without sidecar ), more particularly described as follows :
    Make / Model : Yamaha Mio Aerox 2022
    Engine No. : G3P4E-0053644
    Color : Black
    Chassis No. : PAOSG7620M0004520335810
    Plate No. : 637PSS
    MV File No. : 1366-00000434586
    C.R. No. : 441881473

    2. That the above-mentioned motor vehicle is under a MORTGAGE/LOAN


    OBLIGATION / Contract to Sell with ______________________ with office address at
    ____________________________ , a copy of which is hereto attached ;

    3. That as of January 9, 2023, the TRANSFEROR still has a remaining balance in the
    amount of _______________________________ PESOS to be paid within 1 year according
    to the LOAN / MORTGAGE Agreement / Contract to Sell ;

    4. That by way of this AGREEEMENT, and for value received, the TRANSFEROR hereby
    relinquishes and hereby transfers all the rights, duties, and obligations under the
    above-mentioned LOAN / MORTGAGE AGREEMENT over the said motor vehicle in
    favor of herein TRANSFEREE, who hereby accepts the said assignment of rights ;

    5. That after signing this Agreement, the TRANSFEREE hereby undertakes to comply
    with the obligations set forth in the above-mentioned LOAN / MORTGAGE Contract
    covering the said motor vehicle ;

    6. That the TRANSFEROR shall no longer be liable for the monthly amortization of the
    said vehicle with the Financing Company ;

    7. That the parties have understood and read and agreed to all the terms and conditions
    of this Agreement and shall immediately comply with it ;

    8. That the TRASNFEROR shall sign a DEED OF ABSOLUTE SALE over the motor
    vehicle upon completion of the terms and conditions of the Loan / Mortgage
    Agreement with the Financing Company ;

    9. That all the rights and obligations of the TRANSFEROR shall now be relinquished and
    assumed by the herein TRANSFEREE ;

    10. That possession and safekeeping of the motor vehicle is also transferred to the herein
    TRANSFEREE ;

    11. That this is a bona fide transaction and freely and voluntarily entered into between
    the parties

            IN WITNESS WHEREOF, we have hereunder signed our names, this 9th day of January,
    2023 at Baliuag City, Bulacan, Philippines.
