    CONTRACT OF LEASE

    KNOW ALL MEN BY THESE PRESENT:

    This Contract made and entered into by and between:

    NANCY L. LADESMA, of legal age, Filipino, and a resident of P-1,


    ENGR. RODUARD MICHAEL C. BUSTILLO

    Pinamanggan, Kadingilan, Bukidnon hereinafter referred to as the


    RFB CONSTRUCTION CORP./VP-

    LESSOR;

    - and -
    OPERATIONS

    RFB CONSTRUCTION CORPORATION, a corporation organized


    and existing under and by virtue of the laws of the Republic of the
    Philippines with main office address at P-1A, Bacolod St., Upper
    Doongan, Butuan City, represented herein by VP Operations, ENGR.
    RODUARD MICHAEL C. BUSTILLO, hereinafter referred to as the
    LESSEE.

    WITNESSETH that:

    WHEREAS, the LESSOR is the registered owner of a certain real


    property, situated in P-1 Pinamanggan, Kadingil consisting an area of 1.8
    hectares herein known as the subject lot of this agreement;

    WHEREAS, the LESSEE is a government contractor, who intends


    to set up a field office, motor pool, staff bunk houses and warehouse
    facility and proposes to LESSEE to lease the subject property for this
    purpose.

    NOW THEREFORE, PARTIES have come to an agreement and


    enter into this contract of lease, subject to the following, terms, and
    conditions as follows:

    1. Subject matter of the Lease: the subject matter of the lease


    shall be the lot described above.

    2. Rental Rate: The Rental Rate shall be in the amount of Five


    Thousand Pesos (Php 5,000.00) per month net of all

    deductions, taxes, and other expenses;


    LESSOR

    3. Terms of Payment: LESSEE shall pay under the following


    schedule:

    a. ADVANCE RENTAL: Fifteen Thousand Pesos


    (P15,000.00), to be charged or applied on the last
    three months of the Lease Period;

    b. MONTHLY RENTAL: (P5,000..00) Payable every


    first week of the preceding month.
    4. Duration: This lease contract shall be effective for 12
    months, commencing from March ___, 2022 until March
    ____, 2023, unless sooner terminated by LESSEE upon
    completion of the projects and there are no more projects to
    be implemented within the vicinity, whichever is earlier for
    the benefit of the LESSEE. In the event the

    5. Provision for Improvements: PARTIES agree that any


    backfill, improvement, construction of any temporary
    RFB CONSTRUCTION CORP./VP-

    structure and connection to utilities and its maintenance


    costs shall be for the costs of LESSEE, which shall all be
    removed upon termination of the contract. Provided further,
    OPERATIONS

    that the backfill materials shall not be removed or extracted,


    the same being part of the consideration of the lease;

    6. Utilities: Bills for power, water, communication and other


    utilities shall be the responsibility and costs of LESSEE and
    shall be fully settled and paid, disconnected upon the
    termination of the Lease.

    7. Security: the security details shall be for the costs and


    responsibility of LESSEE;

    8. Inspection of premises: LESSOR shall be allowed access to


    all the premises at any time at pre-arranged schedules;

    9. Applicable laws: the law on lease shall apply to all matters


    not covered under this agreement.

    10. Others:

    10.1. LESSOR shall not dispose, convey, assign, or sell,


    or mortgage the subject property during the term of the
    Lease Contract;

    10.2. LESSOR shall give the LESSEE the right of first


    refusal to buy the property in the event that the property
    will be offered for sale by the LESSOR, provided that
    any sale, mortgage, or conveyances shall only be

    executed with the consent of the LESSEE and


    respecting the prior right of the LESSEE under the terms
    and condition of this contract.
    LESSOR

    IN WITNESS WHEREOF, the parties have hereunto affixed their


    signatures this ____ day of March 2022 in the Municipality of Kadingilan,
    Province of Bukidnon.
