Process of Barangay Ordinance

ORDINANCE

It is a legislative act of that is permanent in character and general in scope. It is subject for
review by the higher Sanggunian within 30 days upon receipt thereof.

REVIEW OF BARANGAY ORDINANCES

A] The Ordinance of the Barangay must be submitted within 5 days to the next higher
Sanggunian for review and must be posted in 3 conspicuous places in the barangay.

B] The SB concerned shall review the proposed Ordinance within 30 days. If it was not returned
to the barangay with the proposed amendment, then it is deemed presumed approved as a whole.

EFFECTIVITY OF THE ORDINANCE

 10 days from the date of posting


 Posting should be placed in at least 2 other conspicuous places
 Posting should be done not later than 5 days after its approval.
 After 10 days of posting, the said Ordinance may now be implemented unless the said
ordinance is returned by the Sangguniang Barangay with the proposed amendment.

REQUISITES OF A VALID ORDINANCE

1. It must not contravene the constitution or any statute;


2. It must not be unfair or oppressive;
3. It must not be partial or discriminatory;
4. It must not be prohibitive but may regulate trade;
5. It must be general and consistent with public policy;
6. It must not be unreasonable

NUMBER OF VOTES REQUIRED FOR AN ORDINANCE TO BE VALID

1] General Ordinances – Plurality of votes constituting a quorum.

2] Appropriation Ordinance – 2/3 of all the members of the Sangguniang concerned.

3] Ordinance enacted by the Citizen Assembly – ¾ votes of the citizen which cannot be amended
within 6 months.

3] Title – The title of an Ordinance must not embrace more than one subject and that the subject
must be expressed in the title thereof

(AN ORDINANCE REGULATING THE DISPOSAL OF GARBAGE, FILTH AND OTHER WASTE
MATTERS)

4] Enacting or Ordaining Clause – Indicates the enacting or ordaining authority or the source
of the Ordinance

(Be it ordained by the Sangguniang Barangay of Delpilar, Municipality of San Mariano,


Isabela)

5] Body – It indicates the provisions of the Ordinance

Ex. SECTION 1. No person shall use any portion of the public highway or any public road, park
or square within Barangay Delpilar, Municipality of San Mariano, and Province of Isabela for
drying of palay, corn or any cereal, or for the drying of clothes or any commodity, or for any
other similar purposes.

6] Penal Clause – Indicates the provision of penalty on the violation of the Ordinance. This is
part of an Ordinance is applicable only to General Ordinances and Tax Ordinances.

SECTION 3. PENALTY. Violation on any provisions of this Ordinance shall be penalized by a fine
of not less than P200 but not more than P 1,000.

7] Repealing Clause – Indicates the statement of amending, or repealing other earlier approved
Ordinances that is not consistent with the provision of the present Ordinance.

SECTION 4. Repealing Clause. All ordinances, rules and regulations, or part thereof, whose
provision is inconsistent or in in conflict or contrary to the provisions of this Ordinance are
hereby repealed, amended and/or modified accordingly.
8] Effectively Clause – Indicates the date when the Ordinances shall take effect.

SECTION 5. This Ordinance will take effect immediately or
