LEASE AGREEMENT

This AGREEMENT is made on this day, 1st July 2023 at Coimbatore

Between:

A.Sundaram S/o. V.Arumugam aged about 81 years residing at C.204,


Air force Navel housing enclave, Athipalayampirivu, Ganapathy (po)
Coimbatore – 641 006. Here in after called lessor (Which expression wherever
it so requires shall mean and include their heirs, legar representatives,
administrators, executors and assigns) of the ONE PART.

AND

Mr. S. Ganapathy, S/o. Somasundaram VM, Aged about 37 Years,


residing at 3/7, Vemankattu Valasu, Kallankattu Valasu (Po), Komarapalayam-
638183, E-mail: sganapathy@gmail.com, hereinafter called the LESSEE
(Which expression wherever it so requires shall mean and include his heirs,
legal representatives, administrators, executors and assigns) of the OTHER
PART.
WITNESSETH :

WHEREAS the lessor above named confirms and declares that he is the sole
owner by title and in actual possession and enjoyment of Apartment S-6,
Marutham Magnus, V K K Menon Road, new Sidhapudur, Coimbatore- 641
044 more fully described in the schedule herein and hereinafter called the
‘SCHEDULE PREMISES’.

Whereas the LESSEE above named has approached the Lessor and sought grant
of lease of the schedule Premises for his residential purposes and the Lessor has
agreed to the same and both the parties are hence desirous of reducing into
writing the mutually agreed terms and conditions of this Agreement of Lease.

NOW THIS AGREEMENT OF LEASE WITNESSETH AS FOLLOWS:

In consideration of the monthly rents hereinafter agreed to be paid by the Lessee


to the Lessor and the Lessee agreeing to comply promptly without any default
the terms and conditions of this Agreement, the Lessor hereby grants to the
Lessee the schedule premises on lease on the following terms and conditions.

1. DURATION: The Lease of the Schedule Property shall be for a period of


Eleven Months only, commencing from 1st July 2023.

2. RENEWAL AND INCREMENT: This Lease Agreement can be


renewed on mutual consent in wiring for a further period of eleven
months, with an enhancement of Five percent in the monthly rent, after
the eleventh month.

3. RENT: The Lessee shall pay to the Lessor a monthly rent of Rs.14,500/-
(Rupees Fourteen Thousand Five Hundred Only) excluding maintenance
charges per month hereinafter called “Lease Rent” which shall be
payable by the 5th of every month for the preceding month. Maintenance
charge should be paid to the association every month directly.
4. SECURITY DEPOSIT: The Lessee has paid a sum of Rs.70,000/-
(Rupees Seventy Thousands Only) as interest free security, by cash
which shall be refunded by the Lessor to the Lessee on the expiry or
sooner termination of this Lease Agreement simultaneously with the
Lessee giving to the Lessor vacant possession of the Schedule Premises
subject to Clause 10. This amount shall be refunded to the Lessee after
deducting any arrears of rent and cost of damages if any to the Schedule
Premises and fixtures and fittings, except for normal wear and tear.

5. ELECTRICITY CHARGES : The Lessee shall pay the Electricity


charges as per separate meter readings, to the LESSOR/ Directly to the
electricity office every month, in addition to the Lease rent, towards the
electricity consumed in the Schedule Premises.

6. REPAIRS AND MAINTENANCE: Day to day minor repairs and


maintenance arising in the course of normal use shall be carried out by
the Lessee at the own cost. In case of any major repairs or damage to the
Schedule Premises, the same shall be carried out by the Lessor at his own
cost.

7. USE OF PREMISES : The lessee shall use the schedule premises for
residential purposes only and shall not use it for any illegal purpose, or
any commercial purpose.

8. ADDITIONS AND ALTERATIONS: The Lessee shall not effect any


addition or alteration to the Schedule Premises, or any part thereof in any
manner whatsoever.

9. SUBLETTING: The Lessee shall not sub- lease, sub-let or under –let
the whole or any portion of the Schedule Premises to any person
whatsoever.
10.DELIVERY BACK : On expiry of the Lease, or on earlier termination,
the lessee shall duly deliver back the possession of the schedule premises
to the Lessor in the same condition in which it is let out, subject to
normal wear and tear, simultaneously with the Lessor handing over the
Security Deposit to the Lessee after deduction of any sum which might
have become due to the Lessor on account of breach of any of the
covenants agreed.

11.TERMINATION: Either The LESSOR or the LESSEE may terminate


the Lease agreement by giving written notice 1 (One) month in advance.
However the LESSEE is free to terminate the licensing agreement with a
shorter notice period in which case the monthly rental for the premises &
fixtures only, for the period of one month, shall be paid as compensation
to the LESSOR.

12.RATES AND TAXES : The Lessor shall pay and discharge property
taxes, assessments, society maintenance charges, and levies levied on the
Schedule property including periodical increases and enhancements and
additional cesses that are payable to the corporation of the city of
Coimbatore and other authorities incidental to the Lessor ship of the
Schedule premises.

13.INSPECTION: The Lessor and his duly authorized agents shall be


entitled to inspect the Schedule Premises at all reasonable hours during
the day, Subject to prior one week notice in that behalf, to the Lessee of
the Schedule Premises and shall do so only in the presence of the Lessee.

14.LESSOR’S COVENANTS:

A. The Lessee paying the rents hereby reserved and observing and
performing the conditions and covenants herein contained, shall be
entitled to peacefully hold, possess and enjoy the schedule premises
during the said term, without any interference or disturbance from the
Lessor or his representatives.
B. The lessor has assured the Lessee that they are the owners of the
Schedule Premises and has the right, title and interest and share in the
schedule premises and that there is no impediment or bar to the grant of
this lease by the lessor under any law, order, decree or contract, and that
the schedule premises is not subject to attachments, encumbrances,
execution or acquisition proceedings or charges of any kind.

15.LESSEE’S COVENANT: The Lessee shall take reasonable care of the


schedule Premises and fixtures and fittings, maintain the same in good
and tenantable condition, reasonable wear and tear, damage by fire,
earthquake, storm, floods, tempest, war or civil commotion and other
such acts of God or other irresistible force majure being excepted.

A. That the Lessee shall pay the rents regularly and duly carry out its
obligations as Lessee as per these presents and as required under any law.

B. That upon the receipt of any notice or orders from any authority relating
to the schedule Premises or the Lessor, the Lessee shall cause the
schedule Premises, to be delivered back to the Lessor and also comply
with the provisions of these presents so far as it relates to the Lessee’s
obligations in regard to the schedule premises.

C. Any charges, arising out of routing or need- based maintenance within the
apartment, would need to be borne by the tenant.
SCHEDULE

All that piece and parcel of the Apartment S-6, Marutham Magnus,
V.K.K. Menon Road, New Sidhapudur, Coimbatore – 641 044, Consisting
of one Hall, Dining, Two Bedrooms, Two bathrooms, one Kitchen, One balcony
and a Single car park along with Modular Furniture in Kitchen, Curtain Rods,
Wardrobes, Fixtures and Fittings.

IN WITNESS WHEROF THE PARTIES TO THE AGREEMENT HAVE


SINGED AND EXECUTED THIS LEASE AGREEMENT ON THE DAY,
MONTH AND YEARS FIRST ABOVE WRITTEN.
