    a committee has been appointed and no person not a party has an interest in the subject matter of

    the action, the above-entitled action is hereby discontinued with prejudice pursuant to New York

    Civil Practice Law and Rules 3217 and any other applicable law, and with each party to bear its

    attorneys'
    own costs, expenses and fees. All rights of appeal are hereby waived. This stipulation

    may be filed without further notice with the Clerk of the Court.
