2. The certificate is granted without any prejudice to the rights of the Kolkata Municipal Corporation to proceed for any penalty already incurred or for arrear
dues and does not cover liabilities under any other section of the Kolkata Municipal Corporation Act. 1980. Payment of such fee shall not absolve the holder of
certificate/licence/permission of any liability to take out any licence or permission under the Act, ibid or any other law for the time being in force.
3. Written permission of the Municipal Commissioner shall be obtained annually on payment of the prescribed fees in advance, where applicable.
4. Any person to whom a written permission/licence/certificate is granted under the Act. Ibid shall indemnify and keep the Corporation indemnified against all
claims, damages, actions, suits or any other legal proceedings which the Corporation may incur or be liable to in this behalf.
5. Any person committing breach of any one of the provisions of the Act, ibid or any other law for the time being in force of fails to comply with any requisition
lawfully made upon him shall be liable to be punished with such fines or imprisionment as are provided in the Act, ibid or any other law for the time being in
force.
6. That the premises shall not cause or be maintained in a manner which is likely to cause injury/danger, to life, health or property, nuisane, annoynance or
offence to the sense of sight, smell or hearing of persons residing in the neighbourhood, and shall not cause or be maintained in a manner so as to cause
any danger to life or injury to health of persons employed in business or residing in the neighbourhood or injury to property or in any other way cause to be
maintained in a manner so as to cause any inconvenience or any injury to the public and shall always be kept and maintained in a secure, neat and tidy
condition.
8. That is only relates to the premises or part of the premises and purposes for which it is granted and not otherwise.
9. That no addition, alteration be made in the area of the land or the building to which the licence relates.
10. That a board shall be kept affixed in a conspicuous part of the premises covered by licence/permission/certificate upon which shall be legibly written the
name, premises no, purpose, year etc.
11. In case of a failure to obtain licence under W B F S Act. 1950/any other law/rules/regulations/bye-laws/order for the time being in force where applicable,
permission/licence granted provissionally would be liable to be revoked/cencelled/suspended.
12. The licence shall at all times, during the continuance of the licence/permissionbe responsible for the due fulfillment and observance of all conditions of
the licence, permission and provisions of the Kolkata Municipal Corporation Act. And bye-laws, rules, regulations made thereunder so far as they relate to his
business, and if violated the licence/permission shall be liable to be cancelled and shall be subject to other penal action under provisions of the CMC Act 1980
and other laws for the time being in force.
13. The holder of the licence/permission/certificate shall give access to the premises to any officer/employee of the Kolkata Municipal Corporation for the
purpose of inspection etc. all reasonable hours.
14. Any person engaged in any profession, trade or calling shall keep the premises concerned free from water stagnation where mosquito are likely to breed.In
case water storage is essential the same shall be drained off completely at least once in a week and replaced by fresh water.
15. This certificate does not comply any right on the certificate holder.
