This is the final response to your Freedom of Information Act (FOIA) request, originally received
by the United States Secret Service (Secret Service) on July 31, 2023, for information pertaining to,
no response to your FOIA request, in which you requested the following:
• All email and text message communications sent to and from the following
Secret Service officials regarding the provision or possible provision of USSS
protective services to Democratic presidential candidate Robert F. Kennedy,
Jr: Secret Service Director Kimberly Cheatle, Deputy Director Ronald L.
Rowe, Jr., Assistant Director Michael Plati, Assistant Director David Torres,
Assistant Director David M. Smith, Chief Strategy Officer Gregory Try, and
Chief of the Uniformed Division Alfonso Tyson, and;
• All memoranda, reports, and directives sent to and from any federal agency,
department or office to the Secret Service regarding the provision or possible
provision of USSS protective services to Democratic presidential candidate
Robert F. Kennedy, Jr.
After a detailed review of all potentially responsive records, 63 pages were released. After
considering the "Foreseeable Harm" standard, outlined in Title 5 U.S.C § 552(a)(8)(A)(i) and
Department of Justice guidance, exemptions under FOIA Statute Title 5 U.S.C. § 552, and/or the
PA Statute Title 5 U.S.C. § 552a, have been applied where deemed appropriate.

Provisions of the Freedom of Information Act do not apply to matters that are:

expected to constitute an unwarranted invasion of personal privacy; (D) could reasonably be expected to disclose the identity of a confidential
source, including a State, local, foreign agency or authority, or any private institution that furnished information on a confidential basis, and/or
when records/information compiled by a criminal law enforcement authority in the course of a criminal investigation, or by an agency conducting
a lawful national security intelligence investigation, information furnished by a confidential source; (E) would disclose techniques and procedures
for law enforcement investigations or prosecutions, or would disclose guidelines for law enforcement investigations or prosecutions if such
disclosure could reasonably be expected to risk circumvention of the law;- (F) could reasonably be expected to endanger the life or physical safety
of any individual;
(b) (8) contained in or related to examination, operating, or condition reports prepared by, on behalf of, or for the use of an agency responsible for
regulation or supervision of financial institutions; and
(b) (9) geological and geophysical information and data, including maps, concerning wells.

(j) (2) material reporting investigative efforts pertaining to enforcement of criminal law including efforts to prevent, control, or reduce crime or
apprehend criminals;

(k) (2) material compiled during investigations for law enforcement purposes (with certain exemptions);
(k) (3) material maintained in connection with providing protective services to the President of the United States or other individuals pursuant to section
3056 of Title 18;
(k) (5) investigatory material compiled solely for the purpose of determining suitability, eligibility, or qualifications for Federal civilian employment,
military service, Federal contracts, or for access to classified information, but only to the extent that the disclosure of such material would reveal
the identity of the person who furnished information to the Government under an express promise that the identity of the source would be held in
confidence, or prior to September 27, 1975, under an implied promise that the identity of the source would be held in confidence; and
(k) (6) testing or examination material used solely to determine individual qualifications for appointment or promotion in the Federal service-the
disclosure of which would compromise the objectivity or fairness of the testing or examination process.

DHS has received the attached letter from the
Kt--K Jr.
campaign requesting protection. I he letter references an assessment the campaign has
conducted on its own - it is apparently a little large for scanning, so I am working with HLS to retrieve
and deliver to HQ - will advise as soon as we have it in hand. DHS is seeking input on the appropriate
process for response so they can task/ track in their systems appropriately. Once you've had a chance
to review, please let me know what the preference is so we can stay synced .
I've also attached the reference documents I provided earlier (2020 letter to the advisory committee

provide you with the materials compiled by the United States Secret Service (Secret Service) to
assist in your review of the request for Secret Service protection submitted on behalf of Robert
F. Kennedy, Jr. As set out in the Department of Homeland Security "Guidelines for
Authorizing Secret Service Protection to U.S. Presidential Candidates," the Secret Service has
prepared an analysis of the factors listed in Section II. The analysis and relevant supporting

The Secret Service does not determine who qualifies for protection, nor is the Secret Service
empowered to independently initiate candidate protection.
Title 18 U.S.c.' 3056(a)(7) authorizes the U.S. Secret Service to provide protection for major
presidential and vice presidential candidates:
• Protection is authorized by the OHS Secretary after consultation with the Congressional
Advisory Committee
• The Congressional Advisory Committee includes: Speaker of the House, House Minority
Leader, Senate Majority Leader, Senate Minority Leader, and one additional member
selected by the others
• Protection under these guid elines should only be granted wit hin one year prior t o the
general election. Prot ection more than one year prior to the general election should
only be granted in extraordinary, case by case circu mstances in consultat ion with the
com mittee, based on t hreat assessment and other factors.
Criteria have been established to assist the OHS Secretary and the advisory committee in their
decision making (as of 2017). Candidates must:
When determining whether a candidate for the Office of President or Vice President of the
United States qualifies as a major candidate, the Secretary has broad discretion and may
consider a variety of factors. These factors include, but are not limited to:
1. Whether the candidate has publicly announced his or her candidacy and has filed the
appropriate documentation with the Federal Election Commission (FEC) and is in
compliance with the Federal Election Campaign Act of 1971, as amended, and related
laws;
2. Whether the candidate is actively campaigning on a national basis for the office for
which his or her candidacy has been announced, as demonstrated by operating a
national campaign apparatus, regularly appearing at public events in multiple states,
producing and publishing campaign advertisements, and other similar indicia of a
campaign;
3. A threat assessment conducted by t he Secret Service of general or specific t hreats
directed towards the candidate. (for these purposes, "threats" should be defined as
explicit threats of bodily harm to the candidate or indications of inappropriate behavior
towards the candidate suggesting potential bodily harm);

4. Whether, during and within an active and competitive major party primary, the most
recent average of established national polls, as reflected by the Real Clear Politics
National Average or similar mechanism, the candidate is polling at 15% or more for 30
consecutive days;
5. Whether the candidate is the formal or de facto nominee of a major party for President
or Vice President;
6. Whether the candidate is an independent or third party candidate for President polling
at 20% or more of the Real Clear Politics National Average for 30 consecutive days;
7. Whether the candidate is the Vice Presidential running mate of the above independent
or third party candidate
Title 18 U.S.c.' 3056{a)(7) states that the U.S. Secret Service is also authorized to protect
spouses of major Presidential and Vice Presidential candidates, as identified by the DHS
Secretary, within 120 days of the general Presidential election. Some candidates have received
protection earlier in the campaign pursuant to Presidential memoranda.
Candidate and nominee protection was expanded to include major candidates for president
and vice president in 1968:
• Major candidates and their spouses began receiving protection after the assassination
of Robert Kennedy in 1968. PL-90-331 was passed June 6, 1968. {Language since
adopted into 3056).
• Prior to this event, candidates and t heir families did not receive Secret Service
protection
• Protection of a candidate/nominee is designed to maintain the integrity of the
democratic process and continuity of government
